(h) In respect of any subcontract, the maximum charge shall be the contract price, plus 10 per cent. thereof.

(i) In respect of matters not specified in the foregoing provisions of this subclause and in respect of which an approved price has not been fixed or authorized by the Tribunal, the maximum charge shall be such as may be agreed to by the parties concerned, or, failing such agreement, such charge as the Tribunal may authorize.

(2) In respect of materials used for the purposes of any work to which this Order applies (including tools or other machinery used for the purposes of the work) no charge shall be made unless, if not actually incorporated in the work, they are rendered unfit for any further use and a certificate to that effect is given by or with the authority of the Controller of Shipbuilding.

(3) For the purposes of subparagraph (i) of paragraph (a) of subclause (1) hereof, the award rate of wages payable to any workman shall be deemed to include any cost-of-living allowance payable to that workman.

(4) For the purposes of this Order the references to “foremen” in paragraph (a) and paragraph (b) of subclause (1) of this clause shall not include any foreman who is in receipt of a salary, but shall be limited to include only foremen whose wages are computed on a time basis.

(5) No subcontract in relation to any work to which this Order applies shall be entered into without the approval of the Controller of Shipbuilding if the value of the subcontract or of all subcontracts let to the same subcontractor is £50 or more.

Price Order No. 281 (Amending Price Order No. 196) (Main Crop Potatoes)


PURSUANT to the powers conferred on it by the Control of Prices Emergency Regulations 1939,* the Price Tribunal, acting with the authority of the Minister of Industries and Commerce, doth hereby make the following amending Price Order:—

  1. (1) This Order may be cited as Price Order No. 281, and shall be read together with and deemed part of Price Order No. 196† (hereinafter referred to as “the principal Order”).

(2) Price Order No. 271‡ is hereby revoked.

(3) The revocation of the said Order shall not affect the liability of any person for any offence in relation thereto committed before the coming into force of this Order.

  1. This Order shall come into force on the 28th day of September, 1944.

APPLICATION OF THIS ORDER

  1. (1) This Order applies with respect to all potatoes which, being subject to the principal Order, are sold by a grower for delivery at any time after the commencement of this Order and on or before the 30th day of November, 1944.

(2) For the purposes of this Order no potatoes sold on the basis of f.o.b.s.i. or f.o.r.s.i. shall be deemed to be delivered to the purchaser after the commencement of this Order if—

(a) In the case of sales f.o.b.s.i., the vessel on which the potatoes are laden leaves the port of shipment at any time before midnight of the 27th day of September, 1944; or

(b) In the case of sales f.o.r.s.i., the trucks on which the potatoes are laden leave the grower’s station at any time before midnight of the said date.

(3) Except as provided in the last preceding subclause, potatoes sold f.o.b.s.i. or f.o.r.s.i. shall be deemed to be delivered to the purchaser after the commencement of this Order notwithstanding that they may have been actually laden on board any vessel or trucks before the commencement of this Order.

MODIFICATION OF PRINCIPAL ORDER WITH RESPECT TO POTATOES THAT ARE SUBJECT TO THIS ORDER

  1. (1) Notwithstanding anything to the contrary in the principal Order the actual price to be charged by any grower for f.a.q. potatoes and the maximum price to be charged by any such grower for under-grade potatoes shall be determined in accordance with the following scale, namely:—

(a) For Sutton’s Supreme or King Edward potatoes grown in the South Island and sold for delivery:—

Per ton f.o.b.s.i. a Port in the South Island.
Actual Price (f.a.q.)
From 28th September to 31st October, 1944 (both days inclusive) £ s. d. 10 15 0

During November, 1944: Pending the issue of an amending Price Order, and subject to the provisions of any such Order, the prices as at 31st October, 1944, shall also apply with respect to potatoes sold for delivery in the month of November.

(b) For any other variety of potatoes grown in the South Island and sold for delivery:—

Per Ton f.o.b.s.i. a Port in the South Island.
Actual Price (f.a.q.)
From 28th September to 31st October, 1944 (both days inclusive) £ s. d. 10 5 0

During November, 1944: Pending the issue of an amending Price Order, and subject to the provisions of any such Order, the prices as at 31st October, 1944, shall also apply with respect to potatoes sold for delivery in the month of November.

(c) For potatoes (other than “tagged” potatoes) grown in the North Island and sold for delivery:—

Per Ton f.o.r.s.i. the Grower’s Station.
Actual Price (f.a.q.)
From 28th September to 31st October, 1944 (both days inclusive) £ s. d. 12 10 0

During November, 1944: Pending the issue of an amending Price Order, and subject to the provisions of any such Order, the prices as at 31st October, 1944, shall also apply with respect to potatoes sold for delivery in the month of November.

(2) With respect to “tagged” potatoes the prices to be charged by the grower shall be not less than the prices fixed in accordance with paragraph (c) of the last preceding subclause for f.a.q. potatoes, but may exceed such prices by an amount not exceeding 10s. a ton in any case.

LAND TRANSFER ACT NOTICES

EVIDENCE of the loss of Memorandum of Lease No. 12062, affecting Lot 74 of Section 3 of the Suburbs of Opaheke, comprised in certificate of title, Vol. 132, folio 30 (Auckland Registry), given by His Majesty the King, as lessor, and REGINALD PLAISTER, of Bombay, Farmer, as lessee, having been lodged with me together with an application for a provisional lease in lieu thereof, notice is hereby given of my intention to issue such provisional lease after fourteen days from 28th September, 1944.

EVIDENCE having been lodged of the determination of the easement of right-of-way created by Transfer No. 25441, affecting part of the land in certificate of title, Vol. 317, folio 130, in the name of WALTER HENRY EDE, for part of Section 5, Kaiwarra District, and being Lot 5 on D.P. 6746, such right-of-way being formerly appurtenant to the land in certificate of title, Vol. 116, folio 165, in the names of JOHN ARMITAGE HOLMES, WILLIAM HENRY HOLMES, and ALFRED FRANKLAND HOLMES, for other parts of Sections 4 and 5 above, and application having been made for the noting of such determination upon the registers and relevant instruments of title, notice is hereby given that I will notify such determination at the expiration of one month from the date of the Gazette containing this notice.

APPLICATION having been made to me for the issue of a provisional lease for Section 14, Block IV, Takaka Survey District, containing 843 acres, being all the land comprised in Renewable Lease, Vol. 61, folio 99 (Nelson Registry), whereof JOSEPH FREDERICK WILLIAM SIXTUS, of Motueka, Farmer, is the registered lessee, and evidence having been lodged of the loss of the said lease, I hereby give notice that I will issue such provisional lease as requested after fourteen days from 28th September, 1944.
