At the Government Buildings at Wellington, this 10th day of February, 1944

Present:

THE RIGHT HON. P. FRASER PRESIDING IN COUNCIL

IN pursuance and exercise of the powers and authorities conferred upon him by subsection one (b) of section seven of the Public Reserves, Domains, and National Parks Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby revoke the reservation for road and railway purposes over the land described in the Schedule hereto ; and doth hereby declare that the said land, being vested in the Crown, is Crown land available for disposal under the Land Act, 1924.

SCHEDULE

WESTLAND LAND DISTRICT

ALL that area containing 25 acres 1 rood 27·3 perches, more or less, being parts of Reserve 8, situated in Block I, Kaniere Survey District, and Block XIII, Waimaia Survey District. As the same is more particularly delineated on the plans marked L. and S. 16/17/3E and r, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon coloured orange.

Setting aside Land as a Native Reservation

ORDER IN COUNCIL

At the Government Buildings at Wellington, this 2nd day of February, 1944

Present:

THE RIGHT HON. P. FRASER PRESIDING IN COUNCIL

PURSUANT to section five of the Native Purposes Act, 1937, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby set apart and reserve the land described in the Schedule hereto as a Native reservation for the common use of the Natives of the Hutt Valley as a burial-ground.

SCHEDULE

ALL those parcels of land within the Township of Petone, being part of Section 3, Hutt District, Block XIII, Belmont Survey District, comprising a total area of 2 roods 22·2 perches, more or less, and being all the land shown on the plan lodged in the office of the Chief Surveyor at Wellington under number W.D. 3752, containing 1 rood 35·9 perches, also 6·7 perches and 10·8 perches, and 4·8 perches shown on plan W.D. 4016, and also 4 perches shown on plan W.D. 1762.

Variation of Order in Council prohibiting Alienations of certain Native Land

PURSUANT to section four hundred and forty-two of the Native Land Act, 1931, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby vary an Order in Council made on the eleventh day of April, one thousand nine hundred and thirty-two, and published in the Gazette on the fourteenth day of April, one thousand nine hundred and thirty-two, at page 761, and affecting Kaimanawa 1E 2B and other blocks, by excluding therefrom the land described in the Schedule hereto.

SCHEDULE

THAT part of the Waimanu 2D Block called Waimanu 2D 2B, containing 716 acres 3 roods 6 perches, more or less, situated in Block VIII, Puketi Survey District, and Block I, Pihanga Survey District.

PURSUANT to the authority conferred upon me by the three-hundred-and-first section of the Justices of the Peace Act, 1927, I, Cyril Louis Norton Newall, the Governor-General of the Dominion of New Zealand, do hereby notify and declare that the persons whose names are set out in the Schedule hereto, being officers in the service of the Crown holding the offices stated opposite their names respectively in the said Schedule, are authorized to take and receive statutory declarations under the three-hundred-and-first section of the Justices of the Peace Act, 1927.

Vesting the Control of Scenic Reserves in the Manginangina Scenic Board

IN pursuance and exercise of the powers and authorities conferred upon him by section thirteen of the Scenery Preservation Act, 1908, His Excellency the Governor-General of the Dominion of New Zealand doth hereby vest the control of the reserves described in the Schedule hereto (being lands reserved under the said Act), for the period of five years from the date hereof (unless previously altered or revoked under the said Act), in the undermentioned persons, namely,—

The Commissioner of Crown Lands for the North Auckland Land District, ex officio,
The Chairman, Bay of Islands County Council, ex officio,
The Chairman, Whangaroa County Council, ex officio,
John William McAulay,
John William Hayes,
Henry Robert Leslie, and
Desmond James Stancliffe Ogle,

who are hereby constituted for that purpose a special Board by the name of the Manginangina Scenic Board (hereinafter referred to as “the Board”), in trust, for the preservation of scenery, and with the powers and subject to the conditions hereinafter contained, that is to say :—

  1. The first meeting of the Board shall be held on Tuesday, the fifteenth day of February, one thousand nine hundred and forty-four, at two o’clock p.m., at the residence of Mr. D. J. S. Ogle, Puketi, and thereafter the Board shall meet for the transaction of business on the third Tuesday in each of the months of February, May, August, and November in each year, at the time and place aforesaid, or at such other time or place as may from time to time be fixed by the Board.

  2. The members of the Board shall at their first meeting, and thereafter at the annual meeting hereinafter mentioned, elect one of themselves to be Chairman, who may join in the discussion; and shall have an original as well as a casting vote. The Chairman shall hold office until the election of his successor.

  3. Special meetings may be convened by the Chairman, provided that two days’ notice of such meeting is given to each member, specifying the business to be transacted at such special meeting; and no other business than that so specified shall be transacted at such meeting.

  4. Any four members of the Board shall form a quorum. Any meeting may be adjourned from time to time.

  5. All questions shall be determined by the majority of votes of the members of the Board present at the meeting.

  6. If at any meeting the Chairman is not present at the time appointed for holding the same, the members present shall choose one of their number to be Chairman for such meeting.

  7. If by resignation, death, incapacity, or otherwise, the seat of any member shall be or become vacant, or if any member absents himself, without reasonable cause, from three consecutive meetings of the Board, the Governor-General shall have power to appoint any other person to be a member of the Board in his stead.

  8. The Board shall prepare and submit at an annual meeting to be held in the month of April in each year a report of the proceedings of the Board for the previous year ending on the thirty-first day of March, together with a statement of the receipts and expenditure of the Board for such year. A copy of every such report
