HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

IN pursuance and exercise of the powers and authorities conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby consent to the land described in the Schedule hereto taken for boys hostel.

SCHEDULE
APPROXIMATE area of the piece of land permitted to be taken: 2 roods 15·8 perches.
Being Lot 2, D.P. 16899, being part Allotment 56, Titirangi Parish.
Situated in Block IV, Titirangi Survey District (Borough of Mount Albert) (Auckland R.D.). (S.O. 33277.)
In the North Auckland Land District; as the same is more particularly delineated on the plan marked P.W.D. 119759, deposited in the office of the Minister of Works at Wellington, and thereon coloured yellow.

Portion of Roads, in the County of Clutha, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line

Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Clutha County Council on the twenty-fifth day of July, one thousand nine hundred and forty-four, viz.:

“ The Clutha County Council, being the local authority having control of the roads in the Clutha County, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the eastern side of portion of Swamp Road fronting Sections 12 and Part 10, Block XVI, Sections 2 and Part 4, Block XVII, and part of closed road, to the northern side of portion of the road fronting part Section 2, Block XII, to the northern side of portion of the road, fronting Sections 1, 3, and Part 6, Block XI, and Sections 5, 6, 13, and Part 4, Block VII, and to portion of the road fronting Sections 8, 10, 13, and Part 12, Block VII, and Sections 1 and Parts 5, 7, 8, and 9, Block XI, Clutha District, such land being comprised in C’s/T. 6/300, 80/43, and Parts 169/258, 235/49 Ltd., and 252/45 Ltd.”;

subject to the conditions that no building or part of a building shall at any time be erected on the land fronting the eastern side of portion of Swamp Road, the northern sides of portion of public roads, or the eastern or western side of portion of public road (described in the Schedule hereto) within a distance of thirty-three feet from the centre-lines of the said portions of roads.

SCHEDULE
THE eastern side of all that portion of Swamp Road situated in the Otago Land District, County of Clutha, fronting Section 12 and part Section 10, Block XVI, Section 2 and part Section 4, Block XVII, and part closed road, Clutha Survey District.
Also the northern side of all that portion of road situated in the said land district and county fronting part Section 2, Block XII, Clutha Survey District.
Also the northern side of all that portion of road situated in the said land district and county fronting Sections 1 and 3, and part Section 6, Block XI, and Sections 5, 6, 13, and part Section 4, Block VII, Clutha Survey District.
Also all that portion of road situated in the said land district and county fronting Sections 8, 10, 13, and part Section 12, Block VII, and Sections 1 and parts of Sections 5, 7, 8, and 9, Block XI, Clutha Survey District.
As the same are more particularly delineated on the plan marked P.W.D. 119834, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

The Western Side of Portion of Ebdentown Road, in the Borough of Upper Hutt, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of every other power in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Upper Hutt Borough Council on the sixth day of July, one thousand nine hundred and forty-four, the side and portion of street affected being described in the Schedule hereto, viz.:

“ That the Upper Hutt Borough Council, being the local authority having control of the streets in the Borough of Upper Hutt, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the western side of portion of Ebdentown Street adjoining part Section 121, Hutt District, being Lot 4 on a plan attached to a Deed of Grant, number 23830 (29/141), registered in the Deeds Registry Office at Wellington, and being part of the land comprised in Certificate of Title, Volume 348, folio 296 ”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the western side of the portion of Ebdentown Road (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.

SCHEDULE
THE western side of all that portion of street situated in the Wellington Land District, Borough of Upper Hutt, known as Ebdentown Road, fronting Lot 4 on plan attached to Grant 23830 (39/141) registered in the Deeds Registry Office at Wellington, and being the balance of the land comprised and described in Certificate of Title, Volume 348, folio 296 (Wellington Registry). As the said portion of street is more particularly delineated on the plan marked P.W.D. 119513, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

Vesting the Management of certain Wharves and other Structures in the Otamatea County Council, making Regulations in connection therewith, and prescribing the Dues to be charged and taken for the Use of such Wharves

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to the Harbours Act, 1923, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth thereby vest in the Otamatea County Council (hereinafter called “ the Council,” which term shall include its successors or assigns unless the context requires a different construction), the management of the wharves, road-metal hopper, and ferry-slips at Paparoa, Raupo, Pahi, Tokatoka, Whakapirau, Maungaturoto, Batley, Ruawai, Matiotitawa, Matakoe (Sterling’s), and Tinopai, the road-metal hopper at Hukatere, and the ferry-slips at Raupo and Ruawai in Kaipara harbour, as shown on approved plans marked M.D. 2378; 2161, 2489, and 5203; 1940, 5708, and 5758; 425 and 4072; 5709 and 5774; 2374 and 2489; 4058; 2918 and 4723; 6554; 5901; 6923; 4298; 2991, 4485, 4497, and 6552; 3086 respectively, and deposited in the office of the Marine Department at Wellington, for the purpose of maintaining thereon the wharves, road-metal hopper, and ferry-slips as shown on the said plans, such vesting to be subject to the terms and conditions set forth in the First Schedule hereto, and doth hereby make the regulations set forth in the Second Schedule hereto for the management of the said wharves, road-metal hopper, and ferry-slips, and doth hereby further prescribe that the dues and rates specified in the Third Schedule hereto shall be charged and taken by the Council for the use of the said wharves, road-metal hopper, and ferry-slips.

FIRST SCHEDULE
CONDITIONS OF MANAGEMENT

  1. THE vesting of the management of the said wharves, road-metal hopper, and ferry-slips is subject to the Foreshore License Regulations 1940, and the provisions of the said regulations shall, so far as applicable, apply hereto.
  2. The term of the vesting shall be fourteen years from the 28th day of August, 1944.
  3. The annual sum payable by the Council shall be one shilling (1s.) payable on demand.
