And whereas the said committee, not being satisfied that the Crown had decided not to acquire or arrange for the acquisition of the land, did on the 4th day of July, 1944, make an order determining the basic value of the land and no appeal from the said order was made within the time prescribed by the said Act or within any further time allowed by the Court :
And whereas the said land is not the land of any serviceman who is for the time being serving outside New Zealand in any of His Majesty’s Forces or in any British ship :
Now, therefore, I, Clarence Farringdon Skinner, Minister of Lands, acting in pursuance of section 51 of the said Act, do hereby declare that the said land is taken for the settlement of a discharged serviceman, and I hereby specify the 21st day of August, 1944, as the date on which the said land shall be deemed to be vested in His Majesty the King.

SCHEDULE
ALL those parcels of land containing one hundred and six (106) acres two (2) roods and three and two-tenths (3·2) perches, more or less, being Lot Two (2) on Deposited Plan 21497, and Lot One (1) on Deposited Plan 22390, being portions of Allotment Eighteen (18), Parish of Puni, and being all of the land comprised and described in certificate of title, Vol. 600, folio 127 (Auckland Registry), together with a grant of certain water rights created in and by Transfer 234618.
As witness my hand, this 25th day of July, 1944.
