  1. GENERAL DESCRIPTION OF WORKS
    The licensee is hereby authorized, subject to the conditions hereof, to construct, maintain, and use the following works for the purposes of this license, the approximate position of the said works being indicated on the said plan P.W.D. 118928 :
    (a) Headworks consisting of a weir and intake with a water-race leading to the Pelton wheel and power-house hereinafter referred to, giving a static head of approximately 125 ft.
    (b) A power-house, with all necessary equipment, for generating electricity:
    (c) Electric lines leading from the power-house aforesaid across Mangels River and part Section 5, Block XVI, Matiri Survey District, to the licensee’s dwelling in Section 5 aforesaid.

  2. SYSTEM OF SUPPLY
    The system of supply shall be classified under paragraph (d) of clause 21-01 of the Electrical Supply Regulations 1935. The generating voltage and the transmission voltage shall be approximately 230 volts direct current.

  3. DURATION OF LICENSE
    Unless sooner determined, this license shall continue in force until the 31st day of March, 1965, or until electrical energy is available from an Electric-power Board or other general public source, whichever is the earlier.

  4. RENTAL
    For the purpose of assessing the annual rental payable in respect of this license, the licensee may install a suitable maximum-demand indicator to the satisfaction of the Inspecting Engineer of the Public Works Department, and failing such installation the rental shall be assessed on the maximum generating capacity of the plant installed. The present plant is rated at 1 kilowatt.

His Excellency THE GOVERNOR-GENERAL IN COUNCIL
PURSUANT to the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby grant to Robert Arthur Aubrey, of Omarama, Sheep-farmer (hereinafter referred to as “the licensee”), a license subject to the conditions hereinafter set forth to obstruct, impound, or divert the waters of Omarama Stream, situated in Run 201b, Ahuriri Survey District, in the Land District of Otago, and to take and use therefrom for the purposes hereinafter set forth a stream of water not exceeding 3·5 cubic feet per second at any one time, and to erect the electric lines hereinafter described.

CONDITIONS

  1. IMPLIED CONDITIONS
    THE conditions directed to be implied in all licenses by the Water-power Regulations 1934 and the Electrical Supply Regulations 1935 shall be incorporated in and shall form part of this license, exceptin so far as the same may be inconsistent with the provisions hereof.

  2. LICENSE SUBJECT TO REGULATIONS
    This license is issued under the Water-power Regulations 1934, and is subject thereto and to the Electrical Supply Regulations 1935, and the Electrical Wiring Regulations 1935, and to any regulations made or to be made in amplification or amendment thereof or in substitution therefor.

  3. UTILIZATION OF WATER AND LOCATION OF HEADWORKS
    Water shall be used under this license solely for the purpose of generating electricity, and shall be taken from the said stream at a point in Run 201b, Ahuriri Survey District, in the Otago Land District, as indicated on the plan marked P.W.D. 119008, deposited in the office of the Minister of Works.

  4. GENERAL DESCRIPTION OF WORKS
    The licensee is hereby authorized, subject to the conditions hereof, to construct, maintain, and use the following works for the purposes of this license, the positions of the said works being indicated on the said plan P.W.D. 119008 :
    (a) Headworks consisting of a dam and intake giving a static head of approximately 18 ft.
    (b) Water-race leading from a point in the Omarama Stream in Run 201b to the power-house hereinafter described :
    (c) Water-turbine and power-house with all necessary equipment for generating electricity :
    (d) Electric lines leading from the power-house aforesaid across a public road to Run 201b, Ahuriri Survey District, the said lines being more particularly delineated on the aforementioned plan P.W.D. 119008.

  5. DURATION OF LICENSE
    This license shall continue in force until the 31st day of March, 1965, or until electrical energy is available from an Electric-power Board or other public source of supply, whichever is the earlier.

  6. SYSTEM OF SUPPLY
    The system of supply shall be as described in paragraph (d) of clause 21–01 of the Electrical Supply Regulations 1935. The generating voltage and the transmission voltage shall be approximately 230 volts direct current.

  7. RENTAL
    For the purpose of assessing the rental or annual sum payable in respect of this license, the licensee may install a suitable maximum-demand indicator to the satisfaction of the Inspecting Engineer of the Public Works Department, and, failing such installation, the rental shall be determined on the maximum capacity of the generating plant installed. The present plant is rated at 4 kilowatts.

Foreshore Licenses for Wharves in Great Barrier Island.—Prescribing Dues for the Use of Same and revoking Orders in Council

At the Government House at Wellington, this 21st day of June, 1944
Present:
His Excellency THE GOVERNOR-GENERAL IN COUNCIL
PURSUANT to the Harbours Act, 1923, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby license and permit the Great Barrier Island County Council (hereinafter called “the Council”), which term shall include its successors or assigns, unless the context requires a different construction) to use and occupy parts of the foreshore at Shoal Bay, Tryphena Harbour; Number l Wharf, Tryphena Harbour; Whangaparapara Harbour; Port Fitzroy Harbour; and Okupu (Blind Bay), all in Great Barrier Island, as shown on approved plans marked M.D. 7215, 7376; 7575, 4608; and 7618, and 8300 respectively, and deposited in the office of the Marine Department at Wellington, for the purpose of maintaining thereon wharves as shown on the said plans, such licenses to be held and enjoyed by the Council upon and subject to the terms and conditions set forth in the First Schedule hereto, and doth hereby prescribe that the regulations fixing dues and otherwise prescribed by Orders in Council of the eleventh day of April, one thousand nine hundred and twenty-four, and the fifteenth day of December, one thousand nine hundred and thirty-three, and published in the Gazette of the seventeenth day of April, one thousand nine hundred and twenty-four, at page 917, and the twenty-first day of December, one thousand nine hundred and thirty-three, at page 3408, respectively, shall apply to the said wharves; and doth hereby revoke as from the date hereof the respective Orders in Council set out in Second Schedule hereto licensing the Great Barrier Island County Council to occupy parts of the foreshore in the Great Barrier Island as sites for wharves.

FIRST SCHEDULE

CONDITIONS

  1. THE licensing of the said wharves is subject to the Foreshore License Regulations 1940, with the exception of clauses 20 and 21 of the said regulations which, for the purpose of this Order in Council, are hereby excluded, and the provisions of the said regulations shall, so far as applicable, apply hereto.

  2. The annual sum payable by the Council shall be one shilling (1s.) payable on demand.

  3. The term of the license shall be fourteen years from the date hereof.
