Notification of Approval of Rules, Auckland Acclimatization Society

Wellington, 12th April, 1944.

PURSUANT to the provisions of section 25 of the Animals Protection and Game Act, 1921–22, I hereby notify that copies of the rules made by the Auckland Acclimatization Society at a special general meeting held at Auckland on 12th December, 1929, amended at a special general meeting held on 10th September, 1931, further amended at a special general meeting held at Hamilton on the 27th April, 1938, further amended at a special general meeting held at Auckland on 21st February, 1939, and further amended at a special general meeting held at Auckland on 5th February, 1944, have been forwarded to me and were approved on the 5th day of April, 1944.

Notice respecting proposed Alteration of Boundaries, Borough of Huntly

Department of Internal Affairs,
Wellington, 19th April, 1944.

IT is hereby notified that a petition has been presented to His Excellency the Governor-General, under the Municipal Corporations Act, 1933, praying that the area described in the Schedule hereto may be excluded from the County of Raglan and included in the Borough of Huntly.

All persons affected are hereby called upon to lodge any written objections to or petitions against the proposed alteration of boundaries which they desire to lodge within one month from the first publication of this notice, such objections or petitions to be addressed to the Minister of Internal Affairs, Wellington.


SCHEDULE

AREA PROPOSED TO BE EXCLUDED FROM THE COUNTY OF RAGLAN AND INCLUDED IN THE BOROUGH OF HUNTLY

ALL that area in the Auckland Land District, in the Raglan County, bounded by a line commencing at a point on the Waikato River, being the northern corner of Lot 1, D.P. 24180, and being the northern corner of Allotment 41B, Pepepe Parish; thence running in a southerly direction generally along the western bank of the said river, to and along the north-eastern and north-western boundaries of part Allotment 38, D.P. 23130, and western side of a public road to the Huntly–Ngaruawahia Road; thence westerly generally along the north side of the said Huntly–Ngaruawahia Road to the south-western corner of Allotment 251, along a right line across that road, to and along the south-eastern boundary of the land taken for the sites for dwellings for employees of the Government Railway Department by Proclamation published in New Zealand Gazette No. 79 of the 12th November, 1925, page 3160, and being part of Allotments 38, 39, and 40; thence in a northerly direction generally along the western boundary of the land taken as aforesaid, the south-eastern side of the Huntly–Awaroa Railway Reserve, across that reserve along a right line, being the production southward of the western boundary of Lot 4, D.P. 31559, along the western boundary of the said Lot 4, being part of Allotment 39, and a right line from its north-western corner to the south-western corner of Lot 3 on the aforesaid D.P. 31559, being part Allotment 40; thence along the western boundary of the aforesaid Lot 3 to and across the Rotowaro Road, along the western boundary of Lot 2 of the said D.P. 31559, being part of Allotments 40, 43A, and 43, along a right line from its north-western corner to and along the western boundary of Lot 1 on the said D.P. 31559, and along the south-western boundary of Lots 2 and 3, D.P. 21449, being parts of Allotments 41E and 249; thence eastward generally along the northern boundary of the aforesaid Lot 3 to and across Waahi Road, along the north-eastern boundary of Lot 5, D.P. 9141, being part Allotment 41E, and along the north-western boundary generally of Lot 1, D.P. 24180, being part of Allotments 40, 40A, and 41B, to the point of commencement.

All the aforementioned allotments being of Pepepe Parish.

Open Seasons for Imported Game and Native Game in Hobson Acclimatization District

IN exercise of the powers vested in him by the Animals Protection and Game Act, 1921–22, the Minister of Internal Affairs of the Dominion of New Zealand doth hereby amend the Warrant dated 3rd April, 1944, made under the Animals Protection and Game Act, 1921–22, and published in the New Zealand Gazette No. 28 of even date therewith, at page 329, by deleting all that portion of such Warrant included under the heading “Hobson Acclimatization District”, and doth hereby declare open seasons for the taking or killing of imported game and/or native game of the kinds hereinafter specified in the Hobson Acclimatization District, as described in the New Zealand Gazette No. 17 of 12th March, 1925, at page 750, during the periods set forth in each case and subject in all cases to the conditions set out hereunder:—

  1. Season for cock pheasants, Californian and Australian quail: 6th May to 30th June, 1944 (both days inclusive).
  2. Season for grey duck, black swan, and pukeko: 6th May to 21st May, 1944 (both days inclusive).

CONDITIONS

  1. No person shall commence shooting earlier than one hour before sunrise or continue shooting later than one hour after sunset on any day during the open season concerned.
  2. (a) No person shall use live birds of any species as decoys nor shall use more than fifteen artificial decoys at any one time, and no such artificial decoys shall be spread over a greater area than thirty yards square.
    (b) No person shall place any artificial decoys within 100 yards of the nearest of any other artificial decoys set out by any other person.
    (c) No person shall in any place during the period in that place of the open season, hereby declared, use in connection with the taking or killing of imported and/or native game, any form of decoying game by the aid of corn, wheat, oats, barley, maize, or any other grain or any products of grain or any other food placed by any person in or near the margin of any river, stream, lagoon, pond, swamp, estuary, or other water.
  3. No person shall use or cause to be used any motor-vehicle in connection with the taking or killing or imported game and/or native game: Provided that this condition shall not be so construed as to prohibit the use of any motor-vehicle for the purpose of travelling either generally to or from a rendezvous.
  4. No person shall use or cause to be used for the purpose of taking or killing any imported or native game any unmoored floating stand, pontoon, hide, mai-mai, or loo, or any boat artificially dressed or covered in any way.
  5. No person engaged in shooting from any shelter, mai-mai, mudhole, boat, louvre, or other contrivance shall use more than one gun: Provided that a person so engaged may have a second gun in a condition not immediately suitable for use, and held for use only in the event of the first gun becoming damaged or otherwise unfit for use.
  6. Licenses to take or kill such imported game and native game within the Hobson Acclimatization District will be issued to any person on payment of the sum of thirty shillings (30s.) each: Provided that licenses to take or kill imported game and native game within the said district will be issued to persons receiving an age benefit or a miner’s benefit under the Social Security Act, 1938, on payment of the sum of twenty shillings (20s.) each; and the Secretary to the Hobson Acclimatization Society, or any person authorized by such Secretary in that behalf, is hereby authorized to sign and issue the said licenses.
  7. No person shall in any one day take or kill more than—
    (a) Twenty-five head in all of cock pheasants, grey duck, and black swan;
    (b) Eight head of cock pheasants;
    (c) Two head of black swan;
    (d) Fifteen head of grey duck;
    (e) Twenty-five head of Californian and/or Australian quail; and
    (f) Eight head of pukeko.
  8. No person shall take or kill native or imported game on the 6th, 7th, or 8th days of May, 1944, while occupying any stand, hide, loo, or position, as commonly used by duck-shooters (hereinafter referred to as “a stand”), which has been duly claimed by any other license-holder in accordance with the following provisions:—
    (a) A stand may be claimed by the planting thereon at any time after noon on the 29th day of April, 1944, of a stake with a board attached having plainly marked thereon the name and address of the claimant and the number of his license:
    (b) No person shall claim more than one stand:
    (c) No stand shall be claimed on or within 100 yards of a stand which has already been duly claimed by any other person, except with the consent of such last-mentioned person:

Provided, however, that any stand which is not occupied by the claimant within half an hour after sunrise on any of the aforesaid days may be occupied on that day by any other license-holder: Provided further that nothing in this clause contained shall be deemed to affect in any way whatsoever the rights of owners or occupiers of any lands in respect of shooting on such lands.
