BUILDING SECTIONS

  1. Clause 48 of section 7 of By-law No. 1 of the said borough shall be repealed and the following clause substituted therefor :—

" No person shall erect any building intended wholly or in part for residential purposes on any section of land having a frontage of less than 50 ft. to some public or private street nor on any section of land having an area of less than 32 perches, but this clause shall not be deemed to forbid the erection of such a building on any section of land shown on any subdivisional plan which may have been lodged or deposited in the Deeds Register Office or the Land Transfer Office at Auckland before the passing of this clause, nor shall this clause be deemed to forbid the erection of such a building on any section of land owned or leased before the passing of this clause by any person not owning or leasing any land adjoining such section of land, nor shall this clause be deemed to forbid the erection upon any site of a shop with a dwellinghouse attached : Provided always that the Council may in its discretion in any particular case, and subject to such terms and conditions as it may deem proper and necessary, permit the erection of any building intended wholly or in part for residential purposes on any section of land notwithstanding that the said section of land may not have the frontage nor the area hereinbefore specified."

The foregoing by-law was made by a resolution of the Council of the Borough of Cambridge passed at a special meeting of the Council duly called and held at the Council Chamber in the Town Hall in Cambridge on the 17th day of November, 1943, and (meantime having been publicly notified) confirmed at an ordinary meeting of the said Council duly called and held at the Council Chamber on the 15th day of December, 1943, and ordered to come into force on the 1st day of March, 1944.
