The Eastern Side of Portion of Queen's Road, in the City of Nelson,
exempted from the Provisions of Section 128 of the Public Works
Act, 1928, subject to a Condition as to the Building-line

At the Government Buildings at Wellington, this 6th day of October,
1943
Present:
THE HON. D. G. SULLIVAN PRESIDING IN COUNCIL
IN pursuance and exercise of the powers conferred by the Public
Works Act, 1928, and of every other power in anyway enabling
him in this behalf, His Excellency the Governor-General of the
Dominion of New Zealand, acting by and with the advice and consent
of the Executive Council of the said Dominion, doth hereby approve
of the following resolution passed by the Nelson City Council on the
eighth day of July, one thousand nine hundred and forty-three,
viz.:—
“ That the Nelson City Council, being the local authority
having control of the streets in the City of Nelson, by resolution
declares that the provisions of section one hundred and twenty-
eight of the Public Works Act, 1928, shall not apply to the
eastern side of the portion of Queen’s Road adjoining part
Section 40, City of Nelson, as shown on the plan annexed to
this resolution in the Council’s minute-book”;
subject to the condition that no building or part of a building shall
at any time be erected on the land fronting the eastern side of
portion of Queen’s Road (described in the Schedule hereto) within a
distance of thirty-three feet from the centre-line of the said portion
of street.
SCHEDULE
THE eastern side of all that portion of street situated in the Nelson
Land District, City of Nelson, known as Queen’s Road, adjoining
parts Section 40, City of Nelson. As the same is more particularly
delineated on the plan marked P.W.D. 117526, deposited in the
office of the Minister of Works at Wellington, and thereon coloured
red.

The South-Western Side of Portion of Burke Street, in the City of
Dunedin, exempted from the Provisions of Section 128 of the
Public Works Act, 1928, subject to a Condition as to the Building-
line

Present:

IN pursuance and exercise of the powers conferred by the Public
Works Act, 1928, and of every other power in anyway enabling
him in this behalf, His Excellency the Governor-General of the
Dominion of New Zealand, acting by and with the advice and consent
of the Executive Council of the said Dominion, doth hereby approve

the thirtieth day of August, one thousand nine hundred and
forty-three, viz.:—
“ That the Dunedin City Council, being the local authority
having control of the streets in the City of Dunedin, by resolution
declares that the provisions of section one hundred and twenty-
eight of the Public Works Act, 1928, shall not apply to the
south-western side of the portion of Burke Street adjoining part
of Lot 251, Deeds Plan 253, Glen Estate, being part of Section 73,
Block VI, Town District, such land being comprised and
described in Certificate of Title 239/273 Ltd.”;
subject to the condition that no building or part of a building shall
at any time be erected on the land fronting the south-western side
of portion of Burke Street (described in the Schedule hereto) within
a distance of thirty-three feet from the centre-line of the said portion
of street.
SCHEDULE
THE south-western side of all that portion of street situated in the
Otago Land District, City of Dunedin, known as Burke Street,
fronting part Lot 251, Deeds Plan 253, Glen Estate, and being part
Section 73, Block VI, Town District. As the same is more particularly
delineated on the plan marked P.W.D. 117827, deposited in
the office of the Minister of Works at Wellington, and thereon
coloured red.

Partially cancelling a Condition as to setting back the Building-line of
Manaia Street, in the Borough of New Plymouth, imposed by
Order in Council under Section 125 of the Public Works Act, 1928

ORDER IN COUNCIL
At the Government Buildings at Wellington, this 6th day of October,

IN pursuance and exercise of the powers conferred by the Public
Works Act, 1928, and of all other powers in anyway enabling
him in this behalf, His Excellency the Governor-General of the
Dominion of New Zealand, acting by and with the advice and consent
of the Executive Council of the said Dominion, doth hereby amend
the Order in Council dated the fifth day of December, one thousand
nine hundred and twenty-nine, and published in the New Zealand
Gazette No. 83 of the twelfth day of the same month at page 3216,
and deposited in the Land Registry Office at New Plymouth under
No. 959, authorizing the laying-off of streets in the Borough of New
Plymouth of widths of less than 66 ft. but not less than 40 ft.,
subject to conditions as to the building-line, by cancelling the
condition as to the building-line imposed by the said Order in Council
in so far as it affects the northern side of the portion of Manaia
Street fronting Allotment 35, D.P. 4832.

Authorizing the Tauranga Harbour Board to sell and remove Timber
on Land vested in it for the Purpose of Harbour Works in Block VI,
Tauranga Survey District

IN pursuance and exercise of the power and authority vested in
me by section one hundred and forty of the Public Works Act,
1928, I, Cyril Louis Norton Newall, the Governor-General of the
Dominion of New Zealand, do hereby authorize the Tauranga
Harbour Board to sell or contract to sell and remove timber upon
all that piece of land comprising an area of approximately 110 acres
2 roods, being portion of Allotment 11B (Purakau Block), Katikati
Parish, Block VI, Tauranga Survey District. As the same is more
particularly delineated on the plan marked P.W.D. 117965, deposited
in the office of the Minister of Works at Wellington, and thereon
edged red.
As witness the hand of His Excellency the Governor-General,
this 7th day of October, 1943.

Lands temporarily reserved in the Hawke’s Bay, Wellington, Westland,
and Otago Land Districts

WHEREAS by the three-hundred-and-fifty-ninth section of
the Land Act, 1924, it is enacted that the Governor-General
may from time to time set apart temporarily as reserves, notwithstanding that the same may be then held under pastoral license,
any Crown lands which in his opinion are required for any of the
purposes in the said section mentioned:
Now, therefore, I, Cyril Louis Norton Newall, the Governor-
General of the Dominion of New Zealand, in pursuance and exercise
of the powers and authorities conferred upon me by the said Act,
do hereby temporarily reserve the lands in the Hawke’s Bay,
Wellington, Westland, and Otago Land Districts described in the
Schedule hereunder written for the purposes specified at the end
of the respective descriptions of the lands so intended to be
temporarily reserved.
SCHEDULE
HAWKE’S BAY LAND DISTRICT
ALL that area situated in the Borough of Hastings, containing by
admeasurement 27·08 perches, more or less, being Lot 3 as shown
on S.O. plan 1929 (red), deposited in the office of the Chief Surveyor
at Napier, being part Heretaunga Block, and being also part Lot 1,
D.P. 6545. As the same is more particularly delineated on the plan
marked L. and S. 1/1107/3, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon bordered
red. (Recreation.)
WELLINGTON LAND DISTRICT
Sections 8 and 9, Block XVIII, Town of Ohakune : Area,
2 acres, more or less. (Public-school site.)
Section 14, Block XVI, Kopuaranga Survey District : Area,
1 acre and 20·2 perches, more or less. (Resting-place for travelling
stock.)
Section 18, Block XVI, Kopuaranga Survey District : Area,
1 acre 3 roods 28 perches, more or less. (Resting-place for travelling
stock.)
Section 16, Block XVI, Kopuaranga Survey District : Area,
2 acres 2 roods 30·4 perches, more or less. (Gravel-pit.)
Section 17, Block XVI, Kopuaranga Survey District : Area,
2 acres 3 roods 12·6 perches, more or less. (Roadman’s cottage-site.)
All that area containing 1 acre, more or less, being Town
Section 33 on the plan of the Special Settlement, Township of
Kaitawa, and being all the land comprised in Certificate of Title,
Volume 62, folio 138 (Wellington Registry). (Recreation.)
WESTLAND LAND DISTRICT
Reserve 1827 (formerly part Section 230, Square 119), Block IV,
Cobden Survey District : Area, 1 acre 3 roods 23·5 perches, more
or less. (Recreation.)
OTAGO LAND DISTRICT
Sections 27 and 28, Block IV, Lower Hawea Survey District :
Area, 35 acres and 11 perches, more or less. (Recreation.)
