Price Order No. 159 (Fish within Auckland Metropolitan Area)

PURSUANT to the powers conferred on it by the Control of Prices Emergency Regulations 1939,* the Price Tribunal, acting with the authority of the Minister of Industries and Commerce, doth hereby make the following Price Order:—

  1. This Order may be cited as Price Order No. 159, and shall come into force on the 28th day of September, 1943.

  2. (1) Price Order No. 66† and Price Order No. 105‡ are hereby revoked.

(2) The revocation of the said Orders shall not affect the liability of any person for any offence in relation thereto committed before the coming into force of this Order.

  1. In this Order the term “licensed” in relation to any fisherman, fish-wholesaler, or fish-retailer means “licensed pursuant to the Industrial Efficiency Act, 1936.”

APPLICATION OF THIS ORDER

  1. (1) This Order applies only with respect to sales of fish to a purchaser carrying on business or resident within the Auckland Metropolitan Area which for the purposes of this Order shall be deemed to comprise the City of Auckland, the boroughs of Devonport, Northcote, Takapuna, Avondale, Newmarket, New Lynn, Mount Albert, Mount Eden, Onehunga, One Tree Hill, and Otahuhu, the Town District of Ellerslie, and the road districts of Mount Roskill and Mount Wellington.

(2) Subject to the last preceding subclause, this Order applies with respect to—

(a) Sales by a licensed fisherman to a licensed fish-wholesaler of any fish of a kind and in the state of preparation described or referred to in the First Schedule hereto ;

(b) Sales by a licensed fish-wholesaler to a licensed fish-retailer of any fish of a kind and in the state of preparation described or referred to in the Second Schedule hereto ;

(c) Sales by a licensed fish-retailer to a consumer for consumption off the premises of the retailer of any fish of a kind and in the state of preparation described or referred to in the Third Schedule hereto.

FIXING MAXIMUM PRICES FOR FISH TO WHICH THIS ORDER APPLIES

  1. (1) The maximum price that may be charged or received by any licensed fisherman for any fish to which this Order applies shall be the appropriate maximum price specified in the First Schedule hereto.

(2) The maximum price that may be charged or received by any licensed fish-wholesaler for any fish to which this Order applies shall be the appropriate maximum price specified in the Second Schedule hereto.

(3) The maximum price that may be charged or received by any licensed fish-retailer for any fish to which this Order applies shall be the appropriate maximum price specified in the Third Schedule hereto.
