The South-western and Western Sides of Portions of Wairoa Gorge Road, in the County of Waimea, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Waimea County Council on the fourteenth day of May, one thousand nine hundred and forty-three, the portions of road effected by such resolution being more particularly described in the Schedule hereto, viz:—

“The Waimea County Council, being the local authority having control of the roads in the County of Waimea, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the western and south-western sides of the portions of Wairoa Gorge Road adjoining parts Section 8, Waimea South, Block X, Waimea Survey District, C.T. 71/1 and C.T. 71/4”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the south-western or western sides of portions of the Wairoa Gorge Road (described in the Schedule hereto) within a distance of thirty-five feet from the centre-lines of the said portions of road.

SCHEDULE

THE south-western side of all that portion of the Wairoa Gorge Road, situated in the Nelson Land District, County of Waimea, fronting part Section 8, District of Waimea South, Block X, Waimea Survey District.

Also the western side of all that portion of the said Wairoa Gorge Road, situated in the said land district and county, fronting part Section 1, Block I, and part Section 8, Waimea South, Block X, Waimea Survey District.

As the same are more particularly delineated on the plan marked P.W.D. 117366, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

Variation of Order in Council prohibiting Alienation of certain Native Land

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to section one hundred and sixty-seven of the Native Land Act, 1931, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby vary an Order in Council made on the fourth day of April, one thousand nine hundred and thirty-two, and published in the Gazette on the seventh day of April, one thousand nine hundred and thirty-two, at page 735, and affecting Hauturu East B 2 Section 2A 1A and other blocks, by excluding therefrom the lands described in the Schedule hereto.

Abolishing a Polling-place under the Electoral Act, 1927

IN pursuance and in exercise of the powers conferred upon me by the Electoral Act, 1927, I Cyril Louis Norton Newall, the Governor-General of the Dominion of New Zealand, do hereby abolish the polling-place as shown against the electoral district the name of which is specified in the following Schedule.

As witness the hand of His Excellency the Governor-General, this 17th day of September, 1943.

Declaring Crown Lands in the Otago Land District to be subject to the Land for Settlements Act, 1925

WHEREAS the lands described in the Schedule hereto (hereinafter referred to as “the said lands”) are Crown lands not acquired under the Land for Settlements Act, 1925, but are adjacent to certain land acquired under the said Act, and known as the Crosshill Settlement and can conveniently be disposed of therewith :

Now, therefore, I, Cyril Louis Norton Newall, the Governor-General of the Dominion of New Zealand, acting in pursuance and exercise of the powers and authorities conferred upon me by section one hundred and five of the said Act, and on the recommendation of the Land Settlement Board, and after considering the report of the Otago District Land Board, do hereby declare the said lands to be subject to the said Act, to the intent that they shall hereupon be deemed to be portion of the said Crosshill Settlement and may be disposed of accordingly.

SCHEDULE

OTAGO LAND DISTRICT ALL that area of land containing 5 acres 3 roods, more or less, being part Lot 2, D.P. 4656, and being part Section 1, situated in Block X, East Taieri Survey District. As the same is more particularly delineated on the plan marked P.W.D. 111756, deposited in the office of the Minister of Works at Wellington, and thereon coloured edged red. (S.O. 9231 and 9263.)

As witness the hand of His Excellency the Governor-General, this 21st day of September, 1943.
