The Samoa Methodist Lands Order 1943

ORDER IN COUNCIL

At the Government House at Wellington, this 31st day of August, 1943

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

WHEREAS the lands described in the second column of the Schedule hereto are lands in Western Samoa belonging to the Methodist Overseas-Missions Trust Association: And whereas such lands have been granted or acquired and are now registered in the Land Register of Western Samoa in the respective volumes and folios thereof set out in the third column of the said Schedule in the several names respectively appearing in the first column of the said Schedule opposite to the description of the said several lands contained in the second column of the said Schedule: And whereas none of such names represents any existing person or body corporate: And whereas it is expedient that all such lands should be vested in the Methodist Overseas-Missions Trust Association, a company duly incorporated and existing under the laws of New South Wales in the Commonwealth of Australia, having its registered office at Sydney and carrying on business there and in Faleula in Western Samoa and elsewhere: And whereas legislation is necessary to enable such lands to be so vested:

Now, therefore, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, and in pursuance of the authority to make regulations for the peace, order, and good government of Samoa conferred upon him by the Samoa Act, 1921, and of all other powers and authorities enabling him in that behalf, doth hereby order as follows:—

  1. These regulations may be cited as the Samoa Methodist Lands Order 1943, and shall come into force on the first day of September, one thousand nine hundred and forty-three.

  2. The several freehold lands described in the second column of the Schedule which belong to the Methodist Overseas-Missions Trust Association and which are registered in the Land Register of Western Samoa in the respective names appearing in the first column of the Schedule under the respective references appearing in the third column of the Schedule shall vest in and be held by the Methodist Overseas-Missions Trust Association, a company duly incorporated and existing under the laws of New South Wales in the Commonwealth of Australia, and the successors and assigns forever of the said company, according to the tenure thereof, subject, nevertheless, to all such public rights over roads and all such encumbrances and other interests, if any, as the same are now subject to, and subject to the trusts and purposes for which such lands may have been granted or acquired.

3. The Australasian Wesleyan Methodist Conference All that parcel of land, situate in Saleiataua, Manono, called “Leleoa,” as the same is more fully described in Court Grant No. 507 Vol. 3, folio 237.
4. The Australasian Wesleyan Methodist Conference All that parcel of land, situate in Luflufi, called “Totomea,” containing 3 roods 22 perches, more or less, as the same is more fully described in Court Grant No. 650 Vol. 4, folio 25.
5. The Australasian Wesleyan Methodist Conference All those parcels of land, situate in Luflufi, containing together 1 acre 1 rood 19 perches, more or less, comprising the blocks called “Vaiui” and “Pipilipano,” as the same are more fully described in Court Grant No. 652 Vol. 4, folio 27.
6. The Australasian Wesleyan Methodist Conference All that parcel of land, situate in Luflufi, called “Vanu,” containing 1 rood 28 perches, more or less, as the same is more fully described in Court Grant No. 653 Vol. 4, folio 28.
7. The Australasian Wesleyan Methodist Conference All that parcel of land, situate in Luflufi, called “Laloaega,” containing 2 roods 36 perches, more or less, as the same is more fully described in Court Grant No. 654 Vol. 4, folio 29.
8. The Australasian Wesleyan Methodist Conference All that parcel of land, situate in Luflufi, Samoa, containing 32 acres 12 perches, more or less, called “Siumoo” and “Fatuse,” as the same is more fully described in Court Grant No. 655 Vol. 4, folio 30.
9. The Australasian Wesleyan Methodist Conference All that parcel of land, situate in Luflufi, called “Matasavai‘i,” “Falepapa,” and “Fanua-iti,” and containing 8 acres 3 roods 15 perches, more or less, as the same is more fully described in Court Grant No. 656. Vol. 4, folio 31.
10. The Australasian Wesleyan Methodist Conference All that parcel of land, situate in Luflufi, called “Falepapa,” containing 1 acre 1 rood, more or less, as the same is more fully described in Court Grant No. 657 Vol. 4, folio 32.
11. The Australasian Wesleyan Methodist Conference All that parcel of land, situate in Luflufi, called “Fatulatele,” containing 1 acre 2 roods 10 perches, more or less, as the same is more fully described in Court Grant No. 658 Vol. 4, folio 33.
