The Napier Groceries Delivery Notice 1943.

PURSUANT to Regulation 4 of the Delivery Emergency Regulations 1942, the Minister of Transport doth hereby give notice as follows :—

1. This notice may be cited as the Napier Groceries Delivery Notice 1943.
2. This notice shall come into force on the Monday following the date of publication thereof in the Gazette.
3. The scheme set out in the Schedule hereto is hereby provided for the district described in the Schedule hereto.

SCHEDULE.

THE NAPIER GROCERIES DELIVERY SCHEME, 1943.

(1) For the purposes of this scheme, unless the context otherwise requires,—

“ The district ” means the Borough of Napier as indicated by zones marked on the plan :

“ The plan ” means the plan of the district deposited for the purposes of the scheme in the Head Office of the Transport Department under No. TT. 3368 :

“ Minister ” means the Minister of Transport :

“ Zone ” means a zone of the district marked on the plan.

(2) For the purpose of assisting in the administration of this scheme there shall be a committee as follows :—

(a) Two members to be appointed by the Napier Borough Council ;

(b) One member to be appointed by the Hawke’s Bay Employers’ Association (Master Grocers’ Section) ;

(c) The Zoning Officer for the North Island.

(3) (a) The members to be appointed to the committee by the Napier Borough Council and the Hawke’s Bay Employers’ Association (Master Grocers’ Section) under clause (2) of this scheme shall be appointed by resolution of the Council and Association respectively as soon as may be after the coming into force of this scheme.

(b) Any committee member appointed by the said Council or Association, as the case may be, may in like manner be removed from office.

(4) Any committee member, other than the Zoning Officer, may resign his office by writing addressed to the Minister.

(5) On the death, resignation, or removal from office of any committee member, other than the Zoning Officer, the vacancy created thereby shall be filled by appointment in the manner in which the vacating member was appointed.

(6) The functions of the committee shall be to receive and investigate complaints affecting the administration of this scheme in its area, to advise the Minister on any matters that may be referred to the committee by the Minister or that may be considered by it of its own motion, and to make recommendations to the Minister for amending this scheme.

(7) Subject to the foregoing provisions of this scheme, each committee may regulate its procedure in such manner as it thinks fit.

(8) The conditions of this scheme are that no groceries shall be delivered for any household, family, or person—

(i) In a parcel of less than either 8 lb. in weight or 3 cubic feet in measurement ;

(ii) In zone numbered one other than on Tuesday, in zone numbered two other than on Wednesday, in zone numbered three other than on Friday morning, in zone numbered four other than on Friday afternoon, in zone numbered five other than on Thursday morning, in zone numbered six other than on Thursday afternoon ;

(iii) On Saturday to Monday (inclusive) in any week ;

(iv) On more than one occasion in any week.

(9) The names and addresses of the vendors who are parties to this scheme are as follows :—
