The Apprentices Labour Legislation Modification Order 1943

IN pursuance of the Labour Legislation Emergency Regulations 1940, the Minister of Labour doth hereby order as follows :—

  1. This Order may be cited as the Apprentices Labour Legislation Modification Order 1943.

  2. This Order applies to each industry or branch thereof in respect of which an apprenticeship order has been made in pursuance of the Apprentices Act, 1923, requiring that a journeyman must be employed by an employer before such employer shall be entitled to take on an apprentice.

  3. The provisions of the apprenticeship orders referred to in paragraph 2 hereof are modified to the extent hereafter set forth.

  4. Any person who is in business on his own account, and who works full time at the trade in which he is engaged but who does not employ a journeyman may make application in writing to the District Registrar of Apprentices for permission to employ an apprentice.

  5. Such application shall be submitted by the District Registrar of Apprentices to the appropriate Apprenticeship Committee for its consideration, and the Apprenticeship Committee shall, if the applicant has been in business on his own account for at least twelve months or for such shorter period as the Committee may in the circumstances consider sufficient, grant the application, unless it is of opinion that there is insufficient proof of work being available for a sufficient period to justify the taking on of an apprentice, or that the facilities for training an apprentice are not up to a satisfactory standard.

  6. Where an Apprenticeship Committee refuses to grant an application made in pursuance of this Order, the applicant shall have a right of appeal to the Court of Arbitration.

  7. Where by this Order powers are conferred on an Apprenticeship Committee and there is no Apprenticeship Committee in the industry and locality concerned, then such powers may be exercised by the District Registrar of Apprentices.

  8. This Order shall come into force on the day of the date hereof.
