Amending Order in Council delegating Powers under the Cemeteries
Act, 1908

ORDER IN COUNCIL
At the Government House at Wellington, this 28th day of July,
1943
Present :
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
IN pursuance and exercise of the powers and authorities conferred
on him by the Cemeteries Act, 1908, His Excellency the
Governor-General, acting by and with the advice and consent of
the Executive Council, doth hereby revoke, in so far as it relates
to the Greendale Cemetery, the Order in Council delegating powers
under the said Act made on the eighteenth day of September, one
thousand nine hundred and thirty-three, and published in the
Gazette on the twenty-first day of the same month at page 2429.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
IN pursuance and exercise of the powers and authorities conferred
by the Public Works Act, 1928, His Excellency the Governor-
General of the Dominion of New Zealand, acting by and with the
advice and consent of the Executive Council of the said Dominion,
doth hereby consent to the land described in the Schedule hereto
being taken for the use, convenience, and enjoyment of a public
school.

SCHEDULE
APPROXIMATE area of the piece of land permitted to be taken :
1 acre 3 roods 33 perches.
Being portion of Snowden’s Grant.
Situated in Block III, Kaeo Survey District (Auckland R.D.).

The North-eastern Side of Portion of Bishops Road, in the City of
Dunedin, exempted from the Provisions of Section 128 of the
Public Works Act, 1928, subject to a Condition as to the Building-
line

At the Government House at Wellington, this 4th day of August,
1943

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
IN pursuance and exercise of the powers conferred by the Public
Works Act, 1928, and of every other power in anywise enabling
him in this behalf, His Excellency the Governor-General of the
Dominion of New Zealand, acting by and with the advice and consent
of the Executive Council of the said Dominion, doth hereby approve
of the following resolution passed by the Dunedin City Council on
the twelfth day of April, one thousand nine hundred and forty-
three, viz. :—
“That the Dunedin City Council, being the local authority
having control of the streets in the City of Dunedin, by resolution
declares that the provisions of section one hundred and twenty-
eight of the Public Works Act, 1928, shall not apply to the
north-eastern side of the portion of Bishops Road adjoining
part of Section 80, Block XII, Town of Dunedin, such land
being comprised and described in Certificate of Title 284/243,
Ltd.” ;
subject to the condition that no building or part of a building shall
at any time be erected on the land fronting the north-eastern side
of portion of Bishops Road (described in the Schedule hereto)
within a distance of twenty-five feet from the centre-line of the
said portion of street.

The north-eastern side of all that portion of street situated in the
Otago Land District, City of Dunedin, known as Bishops Road,
fronting part Section 80, Block XII, Town of Dunedin. As the same
is more particularly delineated on the plan marked P.W.D.

exempted from the Provisions of Section 128 of the Public Works
Act, 1928, subject to a Condition as to the Building-line

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
IN pursuance and exercise of the powers conferred by the Public
Works Act, 1928, and of every other power in anywise enabling
him in this behalf, His Excellency the Governor-General of the
Dominion of New Zealand, acting by and with the advice and
consent of the Executive Council of the said Dominion, doth hereby
approve of the following resolution passed by the Taieri County
Council on the eighteenth day of December, one thousand nine
hundred and forty-two, viz. :—
“The Taieri County Council, being the local authority having
control of the roads in the County of Taieri, by resolution
declares that the provisions of section one hundred and twenty-
eight of the Public Works Act, 1928, shall not apply to the
western side of portion of road fronting subdivision of part of
Section 1 of 16, Block VIII, Dunedin and East Taieri District ” ;
subject to the condition that no building or part of a building shall
at any time be erected on the land fronting the western side of
portions of public road (described in the Schedule hereto) within
a distance of thirty-three feet from the centre-line of the said portions
of road.

SCHEDULE
The western side of those portions of public road situated in the
Otago Land District, County of Taieri, fronting part Section 1
of 16, Block VIII, Dunedin and East Taieri District. As the same
are more particularly delineated on the plan marked P.W.D. 117284,
deposited in the office of the Minister of Works at Wellington, and
thereon coloured red.

IN pursuance and exercise of the powers conferred by the Public
Works Act, 1928, and of every other power in anywise enabling
him in this behalf, His Excellency the Governor-General of the
Dominion of New Zealand, acting by and with the advice and consent
of the Executive Council of the said Dominion, doth hereby approve
of the following resolution passed by the Auckland City Council on
the twenty-fourth day of June, one thousand nine hundred and
forty-three, in so far as it affects the side and portion of street
described in the Schedule hereto, viz. :—
“The Auckland City Council, being the local authority
having control of the streets in the City of Auckland, by resolution
declares that the provisions of section one hundred and twenty-
eight of the Public Works Act, 1928, shall not apply to
that portion of Awarua Crescent adjoining Section 220,
Town of Orakei ” ;
subject to the condition that no building or part of a building shall
at any time be erected on the land fronting the western side of
the portion of Awarua Crescent (described in the Schedule hereto)
within a distance of forty feet from the centre-line of the said
portion of street.

SCHEDULE
The western side of all that portion of street situated in the North
Auckland Land District, City of Auckland, known as Awarua
Crescent, fronting Section 220, Town of Orakei. As the same is
more particularly delineated on the plan marked P.W.D. 117500,
deposited in the office of the Minister of Works at Wellington, and
thereon coloured red.

on him by section twenty-five of the Naval Defence Act, 1913,
and of all other powers and authorities enabling him in that behalf,
His Excellency the Governor-General, with the advice of the
Executive Council, doth hereby amend and supplement the regu-
lations referred to in the Schedule hereto as shown therein.
