Exempting Crown Land from the Provisions of the Mining Act, 1926.

WHEREAS by section twenty of the Mining Act, 1926, it is, inter alia, enacted that the Governor-General may from time to time, by notice in the Gazette, exempt any Crown lands from mining, or from any specified mining purpose, or from that Act, or any specified provisions of that Act, and that the lands to which any such notice relates shall be specified therein by words of particular description:

And whereas it is desirable that the Crown land specified in the Schedule hereto should be exempted from the provisions of the Mining Act, 1926, and its amendments, subject to existing registered mining privileges:

Now, therefore, I, Cyril Louis Norton Newall, the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred on me by section twenty of the Mining Act, 1926, and of all other powers and authorities in anywise enabling me in that behalf, do hereby exempt the land particularly described in the Schedule hereto from the provisions of the Mining Act, 1926, subject to existing registered mining privileges, and do also hereby declare that such exemption shall take effect from the date of the publication of this notice in the Gazette.

SCHEDULE.

ALL that area of State forest and Crown land in the Auckland Land District, Thames County, situated in Blocks II, V, and VI, Thames Survey District, containing approximately 4,350 acres, being Sections 4 and 7, Block V, Section 8 and part Section 9, Block VI, Thames Survey District, Waiokauri A, parts Mangarehu, Mangakirikiri No. 3 and South No. 1, and Mangotahi Blocks, and intersecting roads, reserves, and streams: Bounded towards the east generally by part Waiwhakaurunga Block (State forest, Gazette, 1942, page 1451), Section 8, Block III, and Section 6, Block VI, Thames Survey District (State forest, Gazette, 1938, page 2145); towards the south generally by Section 7 of the aforesaid Block VI, by a right line from the western corner of the aforesaid Section 7 across a public road, the Mangarehu Stream, and another public road to the northern corner of Section 3, Block V, Thames Survey District, by the aforesaid Section 3 (State forest, Gazette, 1938, page 2415), part Mangakirikiri No. 4, as shown on D.P. 17602, the Mangakirikiri Stream, Waiokauri B Block, Lot 1, D.P. 18557, being part of Section 6 of the aforesaid Block V, and part Mangakirikiri 3A Block; towards the west generally by Hape South 1A Block, Hape North 2 and 1B Blocks, Sections 2 and 5, Block V, Thames Survey District, part Karaka North No. 3 Block (State forest, Gazette, 1942, page 1451), a right line across a public road, again by part Karaka North No. 3 Block, again by the aforesaid Section 5, by Section 5, Block II, Thames Survey District, Mangakirikiri North part No. 1 Block, a right line across a public road, again by Mangakirikiri North part No. 1 Block, again by the aforesaid Section 5, Block II, and Te Wharau Block (State forest, Gazette, 1942, page 1451). As the same is more particularly delineated on the plan numbered N. 10/13/2000, deposited in the Head Office of the Department of Mines at Wellington, and thereon edged red.

Lieutenant-Commander Philip Percival Mancha Green, R.N., appointed H.M.N.Z. ship in continuation, and for duty as Naval Member of New Zealand Joint Staff Mission, Washington, D.C., vice Vereker, to date 10th December, 1942. (Granted the acting rank of Commander whilst holding this appointment.)

Paymaster Lieutenant-Commander Robert Henry Allen, R.N., lent Royal New Zealand Navy and appointed H.M.N.Z. ship as directed, to date 21st September, 1942. (Granted the acting rank of Paymaster-Commander whilst holding this appointment.)
