Varying the Determinations in respect of the Cook Hospital Board’s
Loan of £55,000

At the Government House at Wellington, this 14th day of July,
1943
Present:
His Excellency the Governor-General in Council
WHEREAS by Order in Council made on the nineteenth day of
May, one thousand nine hundred and forty-three (hereinafter
referred to as “the said Order in Council”), and subject to the
determinations as to borrowing and repayment therein set out,
consent was given to the raising in New Zealand by the Cook Hospital
Board (hereinafter referred to as “the said local authority”) of
the sum of fifty-five thousand pounds (£55,000), by a loan to be
known as “Building Extension Loan, 1942” (hereinafter referred to
as “the said loan”);
And whereas the authority conferred by the said Order in
Council has not yet been exercised, and it is expedient to vary the
determinations aforesaid in respect of the said loan:
Now, therefore, His Excellency the Governor-General of the
Dominion of New Zealand, acting by and with the advice and
consent of the Executive Council of the said Dominion, and in pur-
suance and exercise of the powers and authorities conferred on
him by section eleven of the Local Government Loans Board Act,
1926, and of all other powers and authorities enabling him in
this behalf, doth hereby vary the determinations aforesaid in respect
of the said loan by prescribing as follows:—
(1) In lieu of a term of twenty (20) years, as specified in clause
one of the said Order in Council, the term for which the said loan
may be raised shall not exceed twenty (20) years.
(2) In lieu of a rate of interest not exceeding three pounds
ten shillings (£3 10s.) per centum per annum, as specified in clause
two of the said Order in Council, the rate of interest that may be
paid in respect of the said loan shall be such as shall not produce
to the lender or lenders a rate exceeding three pounds seven shillings
and sixpence (£3 7s. 6d.) per centum per annum.
(3) In lieu of repayment by equal aggregate annual or half-
yearly instalments of principal and interest, as specified in clause
three of the said Order in Council, the said loan shall be repaid by
half-yearly instalments in the half-years set out in the first column
of the Schedule hereunder of the amounts set opposite each half-
year in the second column of the said Schedule. Each such half-
yearly instalment includes a repayment of principal amounting to
one thousand three hundred and seventy-five pounds (£1,375) and
a half-year’s interest calculated at the rate of three pounds seven
shillings and sixpence (£3 7s. 6d.) per centum per annum, as specified
in clause two above, on the amount of principal outstanding
immediately prior to the date of payment of such instalment.

The Southern Side of Portion of Eton Street, in the Borough of Ashburton
exempted from the Provisions of Section 128 of the Public Works
Act, 1928, subject to a Condition as to the Building-line

His Excellency the Governor-General in Council
IN pursuance and exercise of the powers conferred by the Public
Works Act, 1928, and of all other powers in anywise enabling
him in this behalf, His Excellency the Governor-General of the
Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve
of the following resolution passed by the Ashburton Borough Council
on the thirty-first day of May, one thousand nine hundred and
forty-three, viz.:—
“The Ashburton Borough Council, being the local authority
having control of the streets in the Borough of Ashburton, by
resolution declares that the provisions of section one hundred
and twenty-eight of the Public Works Act, 1928, shall not
apply to the southern side of the portion of Eton Street adjoining
Certificates of Title 103/21 (Lot 44, D.P. 187), 32/239 (Lot 45,
D.P. 187), 304/98 (Lot 46, D.P. 187), 43/41 (Lot 47, D.P. 187),
55/156 (Lot 48, D.P. 187), 43/194 (Lot 49, D.P. 187), 43/193
(Lot 60, D.P. 187), 39/194 (Lot 51, D.P. 187), 32/236 (Lot 52,
D.P. 187), 474/56 (Lot 53, D.P. 187), 32/238 (Lot 54, D.P. 187),
59/211 and 38/125 (Lot 56, D.P. 187), 32/20 (Lot 57, D.P. 187),
70/4 (Lot 58, D.P. 187), 429/281 (Lot 59, D.P. 187), 424/7
(Lot 60, D.P. 187), 431/116 (Lot 61, D.P. 187), 296/201 (Lot 1,
D.P. 3401), and the portions of Rural Section 4904 comprised
in Certificates of Title 221/172, 352/56, 352/234, 296/273,

subject to the condition that no building or part of a building shall
at any time be erected on the land fronting the southern side of the
portion of Eton Street (described in the Schedule hereto) within a
distance of thirty-three feet from the centre-line of the said portion
of street.

SCHEDULE
The southern side of all that portion of street situated in the
Canterbury Land District, Borough of Ashburton, known as Eton
Street, fronting Lots 44, 45, 46, 47, 48, 49, 50, 51, 52, 53, 54, 56, 57,
58, 59, 60, and 61, D.P. 187, being parts Rural Section 4904, Lot 1,
D.P. 4301, being part Rural Section 4904, and also parts Rural
Section 4904. As the same are more particularly delineated on the
plan marked P.W.D. 117320, deposited in the office of the
Minister of Works at Wellington, and thereon coloured red.

County of Peninsula, exempted from the Provisions of
Section 128 of the Public Works Act, 1928, subject to a
Condition as to the Building-line

At the Government House at Wellington, this 14th day of July,

IN pursuance and exercise of the powers conferred by the
Public Works Act, 1928, and of every other power in
anywise enabling him in this behalf, His Excellency the
Governor-General of the Dominion of New Zealand, acting
by and with the advice and consent of the Executive Council
of the said Dominion, doth hereby approve of the following
resolution passed by the Peninsula County Council on the
eighteenth day of February, one thousand nine hundred and
forty-three, viz.:—
“The Peninsula County Council, being the local authority
having control of the roads in the Peninsula County, by
resolution declares that the provisions of section one
hundred and twenty-eight of the Public Works Act, 1928,
shall not apply to the southern side of portion of Kenil-
worth Street and the western side of portion of Shandon
Road, fronting Lots 10, 11, 12, and 13, and parts of
9 and 14, Block I, D.P. 289, Township of Waverley,
being parts of Sections 4 and 5, Block IV, Andersons
Bay District”;
subject to the condition that no building or part of a
building shall at any time be erected on the land fronting
the southern side of portion of Kenilworth Street or the
north-western side of portion of Shandon Road (described in the Schedule hereto) within a distance of thirty-three feet
from the centre-lines of the said portions of roads.

SCHEDULE
The southern side of all that portion of road situated in the
Otago Land District, County of Peninsula, known as
Kenilworth Street, fronting Lots 10 and 11 and part
Lot 9, Block I, D.P. 289, Township of Waverley, being part
Sections 4 and 5, Block IV, Andersons Bay District.
Also the north-western side of portion of road situated
in the said land district and county, known as Shandon Road,
fronting Lots 11, 12, and 13, and part Lot 14, Block I,
D.P. 289, Township of Waverley, being parts of Sections 4
and 5, Block IV, Andersons Bay District.
As the same are more particularly delineated on the
plan marked P.W.D. 117137, deposited in the office of the
Minister of Works at Wellington, and thereon coloured red.
