Varying a Condition as to setting back the Building-line of Portion of a Street, formerly known as Botanical Gardens Road but now known as Salamanca Road, in the City of Wellington, imposed by Order in Council under Section 117 of the Public Works Act, 1905

NEWALL, Governor-General ORDER IN COUNCIL At the Government House at Wellington, this 23rd day of June, 1943 Present: HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anyway enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby amend the Order in Council dated the fifteenth day of July, one thousand nine hundred and seven, and published in the New Zealand Gazette No. 63 of the eighteenth day of the same month, at page 2138, and deposited in the Land Registry Office at Wellington as No. 285, exempting from the provisions of section one hundred and seventeen of the Public Works Act, 1905, Botanical Gardens Road (now known as Salamanca Road), in the City of Wellington, subject to a condition as to the building-line, by varying the condition as to the building-line imposed by the said Order in Council so that no building or part of a building shall at any time be erected on the land fronting the eastern side of portion of the said street (described in the Schedule hereto) within a distance of twenty-five feet from the centre-line of the said portion of street.
SCHEDULE
The eastern side of all that portion of street situated in the Wellington Land District, City of Wellington, formerly known as Botanical Gardens Road but now known as Salamanca Road, fronting all the land on D.P. 6282, Leasehold Certificate of Title, Volume 436, folio 279. As the same is more particularly delineated on the plan marked P.W.D. 116088, deposited in the office of the Minister of Works at Wellington, and thereon coloured red. C. A.
