Notice by the Public Trustee under Part III of the Public Trust Office Act, 1908, and its Amendments
WHEREAS Helen Elizabeth Buining, wife of Johannes Gysbertus Buining, of Beverwijk, Holland, Retired Mercantile Marine Officer, is the owner of the property described in the Schedule hereto: And whereas the said Helen Elizabeth Buining is absent from New Zealand and has no agent in New Zealand with authority to take possession of and administer such property: And whereas by an order made by the Supreme Court of New Zealand on the 12th day of March, 1943, pursuant to the provisions of section 87 of the Public Trust Office Act, 1908, and its amendments, the Public Trustee was authorized to take possession of the whole of the real and personal property of the said Helen Elizabeth Buining in New Zealand, and to exercise in respect thereof all or any of the powers set out in subsections (b), (e), (f), (g), (h), (j), and (k) of section 87 (1) of the Public Trust Office Act, 1908: And whereas by a further order made by the Supreme Court of New Zealand on the 14th day of May, 1943, the Public Trustee was authorized to exercise the power of sale set out in section 87 (1) (c) of the Public Trust Office Act, 1908, in respect of the interest of the said Helen Elizabeth Buining in all that piece or parcel of land containing 3,072 acres 2 roods 13 perches, situated in Blocks V and XII of the Rangitoto Survey District, being part of the Island of Motutapu, and the whole of the land in certificate of title, Vol. 708, folio 166 (Auckland Land Registry), of which the said Helen Elizabeth Buining and her sister, Florence Jean Loomans, wife of Hendrikus Theodorus Loomans, of the Island of Motutapu, Sheep-farmer, are at present registered proprietors as tenants in common in equal shares, and to consent on behalf of the said Helen Elizabeth Buining to the sale by the said Florence Jean Loomans, as executrix of the will of Eliza Jane Reid, of all that piece of land containing 139 acres 3 roods 12 perches, being part of the land contained in certificate of title, Vol. 708, folio 165 (Auckland Land Registry), and to approve of the purchase-price being apportioned as between the owners of the said land on an acreage basis: And whereas it is provided by section 89 of the Public Trust Office Act, 1908, that on taking possession of any property under Part III of the said Act the Public Trustee shall publish in the Gazette and in some newspaper circulating in the district where the property is situated a notice of his intention to exercise the powers conferred upon him by virtue of Part III of the said Act: Now, the Public Trustee hereby gives notice of his intention to exercise the powers conferred upon him by the said orders of the Supreme Court of New Zealand.

HALF interest, as tenant in common along with the above-named Florence Jean Loomans, in all that piece or parcel of land containing 3,072 acres 2 roods 13 perches, situated in Blocks V and XII of the Rangitoto Survey District, being part of the Island of Motutapu, and the whole of the land in certificate of title, Vol. 708, folio 166 (Auckland Land Registry).
Life interest, along with the said Florence Jean Loomans under the will of Eliza Jane Reid, in all that piece or parcel of land containing 534 acres 2 roods 2 perches, situated in Blocks V and XII of the Rangitoto Survey District, being part of the Island of Motutapu, and being the whole of the land in certificate of title, Vol. 708, folio 165 (Auckland Land Registry).
Furniture.
Half interest in the residue of the estate of the said Eliza Jane Reid, late of the Island of Motutapu, near Auckland, Widow.
