Alteration of Boundaries, Christchurch Drainage District

A PROCLAMATION

IN pursuance of the powers and authorities vested in me by section two of the Christchurch District Drainage Amendment Act, 1920, and of all other powers and authorities enabling me in this behalf, I, Cyril Louis Norton Newall, the Governor-General of the Dominion of New Zealand, do hereby declare that the areas described in the Schedule hereto shall be added to and form part of the Christchurch Drainage District; and, with the like powers and authorities, do hereby also declare that the said areas shall be added to the Rural Heathcote Sub-district of the said district.

SCHEDULE

ALL that area of land in the County of Heathcote, of the Canterbury Land District, bounded by a line commencing at a point on the intersection of the north-eastern side of the Christchurch—Lyttelton Railway with the northerly production of the western boundary of Lot 3, Deposited Plan No. 389, being a point on the existing boundary of the Christchurch Drainage District; thence southerly by a right line to and along the said western boundary of Lot 3, Deposited Plan No. 389, to a point in line with the southern boundary of Lot 4, Deposited Plan No. 2128; thence westerly to and along that boundary and the southern boundary of Lot 3, Deposited Plan No. 2128; thence northerly and westerly along the eastern and northern boundaries of Lot 5, Deposited Plan No. 2128, to Opawa Road; thence north-westerly by a right line across that road to the intersection of its south-western side with the eastern boundary of Lot 1, Deposited Plan No. 118; thence southerly along the said eastern boundary of that lot to a point 300 links distant from the southern side of Garland’s Road; thence westerly by a right line parallel to and distant 300 links from the southern side of that road to a point on the eastern boundary of Lot 2, Deposited Plan No. 118; thence southerly along that boundary to its southern extremity; thence by a right line to the north-eastern corner of Lot 1, Deposited Plan No. 6660; thence westerly along the northern boundaries of Lots 1, 2, and 3, Deposited Plan No. 6660, and the eastern and southern boundaries of Lot 5, Deposited Plan No. 7605, to the north-western corner of the land in Certificate of Title, Volume 468, folio 178; thence southerly along the western boundary of the said land in Certificate of Title, Volume 468, folio 178, to Grange Street; thence south-westerly by a right line to and along the eastern boundary of Lot 10, Deposited Plan No. 11204; thence westerly along the southern boundary of that lot and its production to the south-eastern corner of Lot 8, Deposited Plan No. 11204; thence southerly and westerly along the eastern and southern boundaries of Lot 7, Deposited Plan No. 11204, to the eastern boundary of Lot 1, Deposited Plan No. 11204; thence northerly along the said eastern boundary of that lot and westerly along its northern boundary and that boundary produced to a point on the right bank of the Heathcote River, being a point on the existing boundary of the Christchurch Drainage District; thence northerly and easterly generally along that boundary to the point of commencement.

Authorizing Philip Tressillian Shand, of Port Ligar, Pelorus Sound, Farmer, to use Water for the Purpose of generating Electricity

At the Government Buildings at Wellington, this 12th day of May, 1943

THE HON. D. G. SULLIVAN PRESIDING IN COUNCIL

PURSUANT to the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby grant to Philip Tressillian Shand, of Port Ligar, Pelorus Sound, Farmer (hereinafter referred to as the licensee), a license subject to the conditions hereinafter set forth to take and use from an unnamed creek, situated in Section 4, Block VII, French Pass Survey District, in the Land District of Nelson; for the purpose hereinafter set forth a stream of water not exceeding one-thirtieth of a cubic foot per second at any one time.

CONDITIONS

  1. IMPLIED CONDITIONS

THE conditions directed to be implied in all licenses by the Water-power Regulations 1934 and the Electrical Supply Regulations 1935 shall be incorporated in and shall form part of this license except in so far as the same may be inconsistent with the provisions hereof.

  1. LICENSE SUBJECT TO REGULATIONS

This license is issued under the Water-power Regulations 1934, the Electrical Wiring Regulations 1935, and the Electrical Supply Regulations 1935, and is subject thereto and to any regulations made or to be made in amplification or amendment thereof or in substitution therefor.

  1. UTILIZATION OF WATER AND LOCATION OF HEADWORKS

Water shall be used under this license solely for the purpose of generating electricity up to a maximum capacity of 0·12 kilowatts at 12 volts direct current, and shall be taken from the stream at the point in Section 4, Block VII, French Pass Survey District, indicated on the plan marked P.W.D. 83960, deposited in the office of the Minister of Works at Wellington.

  1. GENERAL DESCRIPTION OF WORKS

The licensee is hereby authorized, subject to the conditions hereof, to construct, maintain, and use the following works for the purposes of this license, the approximate positions of the said works being indicated on the said plan P.W.D. 83960:—

(a) Headworks consisting of a dam and intake with a water-race leading to the water-wheel, and power-house hereinafter referred to, giving a static head of approximately 250 ft.:

(b) A power-house, with all necessary equipment, for generating electricity.

(c) Tail-race leading from the said water-wheel to the said stream.

  1. SYSTEM OF SUPPLY

The system of supply shall be classified under paragraph (j) of clause 21-01 of the Electrical Supply Regulations 1935. The generating voltage and the transmission voltage shall be approximately 12 volts direct current.

  1. DURATION OF LICENSE

Unless sooner determined, this license shall continue in force until the 31st day of March, 1963, or until electrical energy is available from an Electric-power Board or other general public source, whichever is the earlier.

  1. RENTAL

For the purpose of assessing the annual rental payable in respect of this license, the licensee may install a suitable maximum-demand indicator to the satisfaction of the Inspecting Engineer of the Public Works Department, and failing such installation the rental shall be assessed on the maximum generating capacity of the plant installed. The present plant is rated at 0·12 kilowatts.

IN pursuance and exercise of the powers conferred by section forty-four of the Public Reserves, Domains, and National Parks Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby appoint

Tokotahi Tokataua,
Hector McDonald Crowe,
Dugald Paterson,
William Ludemann, and
Stanley George Mackie

to be the Tarata Domain Board, having control of the land described in the Schedule hereto; and doth hereby appoint Saturday, the twenty-ninth day of May, one thousand nine hundred and forty-three, at eight o’clock p.m., as the time when, and the Tarata Hall, as the place where, the first meeting of the Board shall be held.

Conferring on Inangahua County Council certain Powers of Borough Councils with respect to Drainage and Sanitation

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

IN pursuance and exercise of the power and authority vested in him in that behalf by section one hundred and eighty-two of the Counties Act, 1920, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby confer on the Inangahua County Council all the powers with respect to drainage and sanitation exercisable by a duly constituted Borough Council under section ninety-one and Part XIX and section three hundred and forty-six of the Municipal Corporations Act, 1933, but subject to the restriction that such powers shall be exercisable only over that portion of the County of Inangahua described in the Schedule hereto.
