THE AUCKLAND BUTCHERY TRADE LABOUR LEGISLATION SUSPENSION ORDER 1943.

IN pursuance of the Labour Legislation Emergency Regulations 1940, the Minister of Labour doth hereby order as follows:—

  1. This Order may be cited as the Auckland Butchery Trade Labour Legislation Suspension Order 1943.
  2. This Order applies to workers in the retail butchery trade carried on within a twenty-one-mile radius of the Chief Post-office in the City of Auckland.
  3. The provisions of all Acts and all regulations thereunder, and of all awards and industrial agreements under the Industrial Conciliation and Arbitration Act, 1925, and of all other agreements affecting conditions of employment, shall be and are hereby suspended in so far as they operate to restrict or prevent the employment of female workers, subject, however, to the terms and conditions hereinafter set forth.
  4. Females of the age of twenty-one years or over may be employed in retail butchers’ shops at the following classes of work:—

Packing display trays.
Window-dressing.
Pricing and ticketing.
Weighing, wrapping, and serving to customers any joints, chops, steak, and small-goods that have been prepared for sale by male assistants.
Taking cash.
Sewing and tying prepared rolls of fresh meat.
Linking sausages.
Light cleaning, which shall not include the scrubbing and/or scraping of butchers’ blocks or the cleaning of sausage or similar machinery and brine tubs.
5. The minimum rates of pay for female assistants employed as provided in clause 4 hereof shall be as follows:—

£ s. d.
During the first three months .. 3 5 0 per week.
During the second three months .. 3 15 0 ”
Thereafter .. 4 10 0 ”
(a) The minimum rates of pay in this clause prescribed shall be paid to every female assistant in respect of every week in which she is employed at any time in any of the classes of work described in the next preceding clause hereof.
(b) For the purpose of determining the rate of payment to which any female assistant is entitled under this clause in respect of any period of employment, there shall be taken into account all periods of that person’s employment in any butcher’s shop, pork-butcher’s shop, butcher’s small-goods shop, or any delicatessen shop.
6. The rates of remuneration hereinbefore provided for shall be subject to the provisions of the general orders of the Court of Arbitration dated the 9th day of August, 1940, and the 31st day of March, 1942, made in pursuance of the Rates of Wages Emergency Regulations 1940, and to the provisions of any other general order that may hereafter be made by the Court of Arbitration in pursuance of the said regulations or of the Economic Stabilization Emergency Regulations 1942.
7. For the purpose of determining the proportion of youths and junior assistants to senior assistants, as prescribed by the award in force in the district, female assistants in receipt of a wage less than £4 10s. per week shall be classed as junior assistants, and those receiving a wage of £4 10s. per week or more shall be classed as senior assistants.
8. This Order shall come into effect on the day of the date hereof.

THE OVERTIME AND HOLIDAYS LABOUR LEGISLATION SUSPENSION ORDER 1941, VARIATION NO. 22.

IN pursuance of the Labour Legislation Emergency Regulations 1940, the Minster of Labour doth hereby order as follows:—

  1. This Order may be cited as the Overtime and Holidays Labour Legislation Suspension Order 1941, Variation No. 22.
  2. This Order shall be read together with and deemed part of the Overtime and Holidays Labour Legislation Suspension Order 1941 (hereinafter referred to as “the principal Order”):
  3. The principal Order is varied as follows, namely:—

“The provisions of the principal Order shall not apply to workers coming within the scope of the Dunedin City Corporation and Drainage and Sewerage Board Engineers, Electrical Workers, and Motor Mechanics’ industrial agreement dated the 24th April, 1941, and recorded in 41 Book of Awards 401.”

  1. This Order shall come into effect on and from the 16th day of December, 1942.

SCHEDULE.

THE WAITARA MILK DELIVERY SCHEME, 1942.

(1) For the purpose of the scheme, unless the context otherwise requires,—

“The district” means the Borough of Waitara:
“The plan” means the plan deposited for the purposes of the scheme in the Head Office of the Transport Department at Wellington under TT. 3364:
“Minister” means the Minister of Transport:
“Zone” means a zone of the district marked on the said plan.

(2) For the purposes of assisting in the administration of this scheme there shall be a committee which shall consist of the following members:—

(a) Two members to be appointed by the Waitara Borough Council;
(b) One member to be appointed by parties to the scheme;
(c) The Zoning Officer for the North Island.

(3) On the death or resignation of any member of the committee, the vacancy created thereby shall be filled by appointment in the manner in which the vacating member was appointed.

(4) The functions of the committee shall be to receive and investigate complaints affecting the administration of this scheme, to advise the Minister of any matters that may be referred to the committee by the Minister or that may be considered by it of its own motion, and to make recommendations to the Minister for amending this scheme.

(5) Subject to the foregoing provisions of this scheme, the committee may regulate its procedure in such manner as it thinks fit.

(6) The names of the vendors who are parties to this scheme and the areas in which they may deliver milk are as follows:—

Name. Area.
F. Green, Waitara .. All that zone marked in blue on the plan consisting of the area north of High Street West, all High Street West, east of Cra-croft Street, down West Quay, up the north side of McLean Street to the Cenotaph and all intermediate streets in that area, inclusive of the west side of Blake Street between Cameron Street and High Street West.
H. G. Old, Waitara All that zone marked in red on the plan.
F. R. Silby, Waitara All that portion of the district on the east side of the Waitara River.

THE HUTT VALLEY MILK DELIVERY NOTICE 1943.

PURSUANT to Regulation 4 of the Delivery Emergency Regulations 1942,* the Minister of Transport doth hereby give notice as follows:—

  1. This notice may be cited as the Hutt Valley Milk Delivery Notice 1943.
  2. This notice shall come into force on the seventh day after the date of publication thereof in the Gazette.
  3. The scheme set out in the Schedule hereto is hereby provided for the district described in the said Schedule.
  4. The Hutt Valley Milk Delivery Scheme, 1940, and the two amendments thereof† are hereby consequentially revoked.

SCHEDULE.

THE HUTT VALLEY MILK DELIVERY SCHEME, 1943.

(1) For the purposes of this scheme, unless the context otherwise requires,—

“The district” means the area constituted as follows: The City of Lower Hutt, the Borough of Petone, and portion of the Hutt County as delineated by the demarkation of zones on the plan:
“Minister” means the Minister of Transport:
“Zone” means a zone of the said district as marked on the plan:
“The plan” means the plan of the district deposited for the purposes of the scheme in the Head Office of the Transport Department and marked No. TT. 1180.

(2) For the purpose of assisting in the administration of this scheme there shall be a committee as follows:—

Hutt Valley Milk Zoning Committee

(a) One member to be appointed by the Lower Hutt City Council and one member appointed by the Petone Borough Council;
(b) One member to be appointed by the Hutt Valley and Bay Districts Milk-vendors’ Association;
(c) The Zoning Officer for the North Island.

(3) (a) The member to be appointed by the local authorities and the Hutt Valley and Bay Districts Milk-vendors’ Association under clause (2) of this scheme shall be appointed by resolution of the Councils and Association respectively as soon as may be after the coming into force of this scheme.
