The Butchery Trade Labour Legislation Suspension Order 1943.

IN pursuance of the Labour Legislation Emergency Regulations 1940, the Minister of Labour doth hereby order as follows :—

  1. This Order may be cited as the Butchery Trade Labour Legislation Suspension Order 1943.
  2. This Order applies to workers in the retail butchery trade in the Taranaki, Wellington, Nelson, Marlborough, Canterbury, Westland, and Otago and Southland Industrial Districts, and to the employers of such workers.
  3. The provisions of all Acts and all regulations thereunder, and of all awards and industrial agreements under the Industrial Conciliation and Arbitration Act, 1925, and of all other agreements affecting conditions of employment, shall be and are hereby suspended in so far as they operate to restrict or prevent the employment of female workers, subject, however, to the terms and conditions hereinafter set forth.
  4. Females of the age of twenty-one years or over may be employed in retail butchers’ shops at the following classes of work :— Packing display trays.
    Window-dressing.
    Pricing and ticketing.
    Weighing, wrapping, and serving to customers any joints, chops, steak, and small-goods that have been prepared for sale by male assistants.
    Taking cash.
    Tying (only) prepared rolls of fresh meat.
    Rolling of sausage meat in bread crumbs.
    Light cleaning, which shall not include the scrubbing and/or scraping of butchers’ blocks, or the cleaning of sausage or similar machinery and brine tubs.
  5. The minimum rates of pay for female assistants employed as provided in clause 4 hereof shall be as follows :—

(a) The minimum rates of pay in this clause prescribed shall be paid to every female assistant in respect of every week in which she is employed at any time in any of the classes of work described in the next preceding clause hereof.
(b) For the purpose of determining the rate of payment to which any female assistant is entitled under this clause in respect of any period of employment, there shall be taken into account all periods of that person’s employment in any butcher’s shop, pork-butcher’s shop, butcher’s small-goods shop, or any delicatessen shop.
6. The rates of remuneration hereinbefore provided for shall be subject to the provisions of the general orders of the Court of Arbitration dated the 9th day of August, 1940, and the 31st day of March, 1942, made in pursuance of the Rates of Wages Emergency Regulations 1940, and to the provisions of any other general order that may hereafter be made by the Court of Arbitration in pursuance of the said regulations or of the Economic Stabilization Emergency Regulations 1942.
7. For the purpose of determining the proportion of youths and junior assistants to senior assistants, as prescribed in the respective awards in force in the industrial districts concerned, female assistants in receipt of a wage less than £4 10s. per week shall be classed as junior assistants, and those receiving a wage of £4 10s. per week or more shall be classed as senior assistants.
8. This Order shall come into effect on the day of the date hereof.
