Price Order No. 138 (Cabbages and Silver Beet)
PURSUANT to the powers conferred on it by the Control of Prices Emergency Regulations 1939,* the Price Tribunal, acting with the authority of the Minister of Industries and Commerce, doth hereby make the following Price Order:-
I. This Order may be cited as Price Order No. 138, and shall come into force on the 24th day of May, 1943.
APPLICATION OF THIS ORDER
- (1) This Order applies with respect to the sale for human consumption of cabbages and silver beet.
(2) Every sale of any such vegetables shall be deemed to be a sale for human consumption unless at the time of sale there is a bona fide agreement or stipulation between the buyer and the seller that the vegetables to which the sale relates are intended for a specific purpose other than human consumption. - The maximum prices fixed by this Order apply with respect to sales by auction, as well as to other sales.
- The wholesale prices fixed by this Order apply with respect to sales of the following classes, namely:-
(a) Sales to retailers (whether made by the grower or any other person); and
(b) Sales to users in any case where a lot of not less than 5 cwt. of any one kind of vegetable to which this Order applies is sold to any one purchaser for delivery at one time. - The provisions of this Order fixing prices by reference to the weight of the vegetables to which any sale relates shall apply notwithstanding that in any such case the seller may sell or purport to sell otherwise than by weight.
FIXING MAXIMUM PRICES OF VEGETABLES TO WHICH THIS ORDER APPLIES
Wholesalers' Prices
- (1) The maximum price that may be charged or received by any wholesaler for any vegetables to which this Order applies shall be:-

(d) For silver beet sold elsewhere.. 9 0
(2) The wholesale prices fixed by this Order are fixed as for delivery at the wholesaler's store or other premises from which delivery to the purchaser is effected.
(3) Where delivery is effected by a wholesaler elsewhere than at premises occupied by him, he may add to the appropriate price fixed in accordance with the foregoing provisions of this clause the reasonable cost of delivery, not exceeding in any case the cost that would have been incurred by him if delivery had been effected by a common carrier at current rates of freight.

Retailers' Prices
- (1) The maximum price that may be charged or received by any retailer for any vegetables to which this Order applies shall be:-

(2) The retail prices fixed by this Order are fixed as for delivery at the retailer's shop or other premises occupied by the retailer.

Note.-It is the intention of the Tribunal, by an amending Price Order, or by a series of amending Price Orders, to provide for such alterations to the prices fixed by this Order as may be warranted by conditions relating to production and marketing that may be found to prevail on or after the 30th June, 1943.
Price Order No. 121, Amendment No. 1 (Honey)
PURSUANT to the powers conferred on it by the Control of Prices Emergency Regulations 1939,* the Price Tribunal, acting with the authority of the Minister of Industries and Commerce, doth hereby make the following Price Order:-
- This Order may be cited as Price Order No. 121, Amendment No. 1, and shall be read together with and deemed part of Price Order No. 121† (hereinafter referred to as "the principal Order").
- This Order shall come into force on the 24th day of May, 1943.
- (1) Clause 5 of the principal Order is hereby extended to apply with respect to honey that is packed in retail containers of a kind that is not described in the first column of the Schedule to the principal Order, as amended by this Order or by any subsequent amending Order that may hereafter be issued: Provided that where the price of any honey to which this clause applies, computed in accordance with clause 5 of the principal Order, is not an exact number of pence or half-pence, the maximum price of the lot shall be the nearest upward halfpenny.
(2) The several prices fixed by clause 5 of the principal Order, in its application to any honey referred to in the last preceding subclause, shall include the price of the containers.
