SCHEDULE

WESTLAND LAND DISTRICT
ALL that area containing 5·4 perches, more or less, being part Reserve
436, Town of Hokitika, situated in the Borough of Hokitika, and
bounded as follows: On the north-west and north-east by Lot 9,
Deposited Plan 335, 21·5 links and 175·32 links respectively, on
the south-east by Railway Reserve, 17·3 links, and on the south-
west by a line bearing 304° 15' for 179·7 links. As the same is
more particularly delineated on a plan marked L. and S. 52142A,
deposited in the Head Office, Department of Lands and Survey, at
Wellington, and thereon bordered red.

Cancelling the Vesting of a Reserve in the Waihola Athenæum
(Incorporated)

At the Government Buildings at Wellington, this 12th day of May,
1943
Present:
THE HON. D.G. SULLIVAN PRESIDING IN COUNCIL
WHEREAS the land described in the Schedule hereto is a
reserve for a site for an athenæum, and is vested in the
Waihola Athenæum (Incorporated):
And whereas it is expedient that the vesting of the said land
as hereinbefore referred to should be cancelled, and the Waihola
Athenæum (Incorporated) has duly consented to such cancellation:
Now, therefore, His Excellency the Governor-General of the
Dominion of New Zealand, acting by and with the advice and
consent of the Executive Council of the said Dominion, and in
pursuance and exercise of the powers and authorities conferred
upon him by subsection one of section ten of the Public Reserves,
Domains, and National Parks Act, 1928, doth hereby cancel the
vesting in the Waihola Athenæum (Incorporated) of the land described
in the Schedule hereto.

Vesting a Reserve in the Waitaki Hospital Board

At the Government Buildings at Wellington, this 12th day of May,
1943
Present:
THE HON. D. G. SULLIVAN PRESIDING IN COUNCIL
WHEREAS the lands described in the Schedule hereto have been
duly set apart as a reserve for hospital purposes: And
whereas, in the opinion of the Governor-General, it is expedient to
vest the said reserve in the Waitaki Hospital Board:
Now, therefore, His Excellency the Governor-General of the
Dominion of New Zealand, acting by and with the advice and consent
of the Executive Council of the said Dominion, and in exercise of the
powers and authorities conferred upon him by section nine of the
Public Reserves, Domains, and National Parks Act, 1928, doth
hereby declare that from and after the day of the date hereof, the
reserve described in the Schedule hereto shall become vested in the
Waitaki Hospital Board, in trust, for hospital purposes.

SCHEDULE
OTAGO LAND DISTRICT
ALL that area being parts of Reserve D, Town of Oamaru, and
being—
Firstly, part of Reserve D containing 8 acres 0 roods
34·66 perches, more or less: Bounded towards the north-east and
south-east by Devon Terrace, 1795·14 links, 138·12 links, 20·0 links,
and 99·15 links; again towards the south-east by a public street,
667·49 links and 296·22 links; towards the south-west by Devon
Terrace, 769·16 links; and towards the north-west by a public
street, 666·58 links: be all the aforesaid linkages more or less;
and
Secondly, part of Reserve D containing 32·88 perches, more or
less: Bounded towards the north-west by a public street, 511·56
links; towards the south-east by Devon Terrace, 220·0 links;
and towards the south-west by Devon Terrace, 317·13 links:
be all the aforesaid linkages more or less.
As the same are delineated on the plan marked L. and S. 6/8/69A,
deposited in the Head Office, Department of Lands and Survey, at

Vesting the Control of a Reserve in the Opotiki County
Council

ORDER IN COUNCIL
At the Government Buildings at Wellington, this 12th day of May,
1943
Present:
THE HON. D. G. SULLIVAN PRESIDING IN COUNCIL
WHEREAS the land described in the Schedule hereto
has been duly set apart as a reserve for a resting-
place for travelling stock: And whereas it is expedient
that the control of the said reserve should be vested in the
Opotiki County Council:
Now, therefore, His Excellency the Governor-General of
the Dominion of New Zealand, acting by and with the advice
and consent of the Executive Council of the said Dominion,
and in exercise of the powers and authorities conferred upon
him by section seventeen of the Public Reserves, Domains,
and National Parks Act, 1928, doth hereby vest the control
of the said reserve in the Opotiki County Council.

GISBORNE LAND DISTRICT
SECTION 4, Block X, Waiawa Survey District: Area, 1 acre
2 roods.

Vesting the Control of Part of the Foreshore on Coromandel Peninsula
in the Thames County Council

At the Government Buildings at Wellington, this 12th day of
May, 1943
Present:
THE HON. D. G. SULLIVAN PRESIDING IN COUNCIL
PURSUANT to the Harbours Act, 1923, His Excellency the
Governor-General, acting by and with the advice and consent
of the Executive Council, doth hereby grant to the Thames County
Council (hereinafter called “the Council,” which term shall include
its successors or assigns unless the context requires a different
construction), the control of the foreshore as described in the First
Schedule hereto, and subject to the terms and conditions set forth
in the Second Schedule hereto.

FIRST SCHEDULE
AREA GRANTED
ALL that land situated between high- and low-water mark at Penny’s
Bay, on the foreshore of Hauraki Gulf, Block VI, Hastings Survey
District, commencing at Peg II on Thames-Coromandel Road,
adjoining Hauraki Pastoral License 80, and continuing thence to
Peg XI on above road, a distance of approximately 35 chains
measured along high-water mark, indicated on plan by letters A
and B in red.
All that land situated between high- and low-water mark at
Cemetery Bay, on the foreshore of Hauraki Gulf, Block XI, Hastings
Survey District, commencing at a point marked C in red on plan
1½ chains northwards of Peg XLIV on Thames-Coromandel Road,
and continuing thence southwards across the estuary of Tapu Creek
to Peg XXI marked D in red on plan, a distance of approximately
35 chains measured along high-water mark, and across estuary of
Tapu Creek; as the same is delineated on the plan marked M.D.
5346, deposited in the office of the Marine Department at Wellington.

SECOND SCHEDULE
CONDITIONS

  1. In these conditions the term—
    “Foreshore” means such parts of the bed, shore, or banks of
    a tidal water as are covered and uncovered by the flow
    and ebb of the tide at ordinary spring tides:
    “Low-water mark” means low-water mark at ordinary
    spring tides:
    “Minister” means the Minister of Marine as defined by the
    Shipping and Seamen Act, 1908, and includes any officer,
    person, or authority acting by or under the direction of
    such Minister.
  2. The concessions and privileges conferred by this Order in
    Council shall extend and apply only to those parts of the foreshore
    as shown in red on plan marked M.D. 5346, and deposited in the
    office of the Marine Department at Wellington.
  3. His Majesty or the Governor-General, and all officers in the
    Government service acting in the execution of their duty, shall at
    all times have free ingress, passage, and egress out and over the said
    foreshore without payment.
  4. Nothing herein contained shall authorize the Council to do
    or cause to be done anything repugnant to or inconsistent with any
    law relating to the Customs, or with any regulation of the Minister
