Varying the Determinations in respect of Portion (£106,700) of the Auckland Harbour Board’s Loan of £184,000.

ORDER IN COUNCIL.

At the Government House at Wellington, this 20th day of April, 1943.

Present:

His Excellency the Governor-General in Council.

WHEREAS by Order in Council made on the twenty-fourth day of March, one thousand nine hundred and forty-three (hereinafter referred to as “the said Order in Council”), and subject to the determinations as to borrowing and repayment therein set out, consent was given to the raising in New Zealand by the Auckland Harbour Board (hereinafter referred to as “the said local authority”) of a loan of one hundred and eighty-four thousand pounds (£184,000), to be known as “Auckland Harbour Board Redemption Loan, 1943”;

And whereas the authority conferred by the said Order in Council has not yet been exercised, and it is expedient to vary the determinations aforesaid in respect of portion thereof amounting to one hundred and six thousand seven hundred pounds (£106,700) (hereinafter referred to as “the said sum”):

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section eleven of the Local Government Loans Board Act, 1926, as set out in section twenty-nine of the Finance Act, 1932 (No. 2), and of all other powers and authorities enabling him in this behalf, doth hereby vary the determinations aforesaid in respect of the said sum by prescribing :—

(1) In lieu of a rate of interest not exceeding three pounds ten shillings (£3 10s.) per centum, as specified in clause two of the said Order in Council, the rate of interest that may be paid in respect of the said sum shall be such as shall not produce to the lender or lenders a rate exceeding three pounds five shillings (£3 5s.) per centum per annum.

(2) In lieu of repayment by equal aggregate annual or half-yearly instalments of principal and interest, as specified in clause three of the said Order in Council, no principal repayment shall be made over the first ten (10) years of the term and thereafter the said sum shall be repaid by twenty (20) half-yearly instalments in the half-years set out in the first column of the Schedule hereunder of the amounts set opposite each half-year in the second column of the said Schedule, the first such half-yearly instalment to be paid not later than ten (10) years and six (6) months after the raising of the said sum. Each such half-yearly instalment includes a repayment of principal of the amount set opposite such instalment in the third column of the said Schedule and a half-year’s interest calculated at the rate of three pounds five shillings (£3 5s.) per centum per annum on the amount of principal outstanding immediately prior to the date of payment of such instalment.

ORDER IN COUNCIL.

Present:

His Excellency the Governor-General in Council.

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section eleven of the Local Government Loans Board Act, 1926, as set out in section twenty-nine of the Finance Act, 1932 (No. 2), and of all other powers and authorities enabling him in this behalf, doth hereby vary the determinations aforesaid in respect of the said sum by prescribing :—

(1) In lieu of a term not exceeding twenty (20) years, as specified in clause one of the said Order in Council, the term for which the said sum may be raised shall not exceed ten (10) years.

(2) In lieu of a rate of interest not exceeding three pounds ten shillings (£3 10s.) per centum per annum, as specified in clause two of the said Order in Council, the rate of interest that may be paid in respect of the said sum shall be such as shall not produce to the lender or lenders a rate exceeding three pounds two shillings and sixpence (£3 2s. 6d.) per centum per annum.

(3) In lieu of repayment by equal aggregate annual or half-yearly instalments of principal and interest, as specified in clause three of the said Order in Council, the said sum shall be repaid by the half-yearly redemption of debentures in the half-years set out in the first column of the Schedule hereto of the amounts set out in the second column of the said Schedule hereto, the first such redemption to be made not later than six months after the raising of the said sum.

The Auckland Electric-power Board Election Postponement Emergency Regulations 1943.

ORDER IN COUNCIL.

At the Government House at Wellington, this 20th day of April, 1943.

Present:

His Excellency the Governor-General in Council.

PURSUANT to the Emergency Regulations Act, 1939, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby make the following regulations.

REGULATIONS.

  1. These regulations may be cited as the Auckland Electric-power Board Election Postponement Emergency Regulations 1943.

  2. The Order in Council dated the 4th day of February, 1942, and published in the Gazette on the 5th day of the same month at page 449, postponing the general election of members of the Auckland Electric-power Board, which was required to be held on a Saturday within the last fifteen days of the month of May in the year 1942, is hereby revoked.

  3. The holding of the general election referred to in the said Order in Council is hereby further postponed until a Saturday within the last fifteen days of the month of May in the year 1944.
