The Southern Side of Portion of Roxby Street and the Northern Side of Portion of Maude Street, in the County of Waitaki, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line

ORDER IN COUNCIL

At the Government Buildings at Wellington, this 8th day of December, 1943

Present:

THE HON. W. NASH PRESIDING IN COUNCIL

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of every other power in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Waitaki County Council on the twenty-second day of April, one thousand nine hundred and forty-three, viz. :

“ The Waitaki County Council, being the local authority having control of the roads in the Waitaki County, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the south side of Roxby Street abutting on the northern boundary of Allotments 86 and 87 and the north side of Maude Street abutting on the southern boundary of Allotments 96 and 97 on plan deposited in the Land Registry Office, Dunedin, as No. 203; and being all the land in Certificate of Title, Volume 112, folio 143 ”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the southern side of portion of Roxby Street and the northern side of portion of Maude Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portions of roads.

SCHEDULE

THE southern side of all that portion of road situated in the Otago Land District, County of Waitaki, known as Roxby Street, fronting Lots 86 and 87, D.P. 203, Township of South Oamaru, and being part Section 50, Block IV, Oamaru District.

Also the northern side of all that portion of road situated in the said land district and county, known as Maude Street, fronting Lots 96 and 97, D.P. 203, Township of South Oamaru, and being part Section 50, Block IV, Oamaru District.

As the same are more particularly delineated on the plan marked P.W.D. 117954, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

The Southern Side of Portion of Blackett Street, in the Borough of Rangiora, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line

At the Government Buildings at Wellington, this 8th day of December, 1943

Present:

THE HON. W. NASH PRESIDING IN COUNCIL

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of every other power in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Rangiora Borough Council on the twenty-second day of September, one thousand nine hundred and forty-three, viz. :

“ That the Rangiora Borough Council, being the local authority having control of the streets in the Borough of Rangiora, declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that portion of the street known as Blackett Street on its southern side for a distance of 146·65 links from its junction with Ashley Street and fronting the land comprised in Certificate of Title, Volume 91, folio 163, and part of the land comprised in Certificate of Title, Volume 232, folio 244, and being that portion of Blackett Street to the east of Ashley Street and from the junction of Blackett Street with Ashley Street as is not one chain wide ”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the southern side of portion of Blackett Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.

SCHEDULE

THE southern side of all that portion of street situated in the Canterbury Land District, Borough of Rangiora, known as Blackett Street, fronting part Rural Section 917. As the same is more particularly delineated on the plan marked P.W.D. 118101, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

The South-eastern Side of Portion of Public Street, in the Borough of Richmond, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line

Present:

THE HON. W. NASH PRESIDING IN COUNCIL

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of every other power in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Richmond Borough Council on the twelfth day of October, one thousand nine hundred and forty-three, viz. :

“ That the Richmond Borough Council, being the local authority having control of the streets of the Borough of Richmond, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the south-eastern side of the public street adjoining subdivision of 28 and Part 30 of Section 25, Waimea East, Block VII, Waimea Survey District, C.T. 40/116 ”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the south-eastern side of portion of public street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.

SCHEDULE

THE south-eastern side of all that portion of public street, situated in the Nelson Land District, Borough of Richmond, fronting Lot 28 of Section 25, Waimea East, Block VII, Waimea Survey District. As the same is more particularly delineated on the plan marked P.W.D. 118100, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

The North-eastern Side of Kyle Street, in the City of Dunedin, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line

Present:

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of every other power in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Dunedin City Council on the twenty-fourth day of November, one thousand nine hundred and forty-one, viz. :

“ That the Dunedin City Council, being the local authority having control of the streets in the City of Dunedin, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the north-eastern side of the portion of Kyle Street, adjoining subdivision of Sections 69 and part 70, Block XIX, Town of Dunedin, such land being comprised and described in Certificate of Title, Register-book, Volume 143, folio 283 ”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the north-eastern side of Kyle Street (described in the Schedule hereto) within a distance of twenty-five feet from the centre-line of the said street.

SCHEDULE

THE north-eastern side of all that street situated in the Otago Land District, City of Dunedin, known as Kyle Street, fronting Section 69 and part Section 70, Block XIX, Town of Dunedin. As the same is more particularly delineated on the plan marked P.W.D. 113613, deposited in the office of the Minister of Works at Wellington, and thereon edged red.
