Revoking Part of a Proclamation setting Crown Land apart for Defence Purposes in Blocks II and III, Cape Campbell Survey District, and Blocks XII and XIV, Clifford Bay Survey District

A PROCLAMATION
IN pursuance and exercise of the powers and authorities vested in me by the Public Works Act, 1928, and of every other power and authority in anywise enabling me in this behalf, I, Cyril Louis Norton Newall, the Governor-General of the Dominion of New Zealand, do hereby revoke so much of the Proclamation dated the twenty-eighth day of August, one thousand nine hundred and thirty-nine, and published in the New Zealand Gazette No. 66 of the thirty-first day of the same month at page 2251, and deposited in the Land Registry Office at Blenheim as No. 497, setting Crown land apart for defence purposes in Blocks II and III, Cape Campbell Survey District, and Blocks XII and XIV, Clifford Bay Survey District, as affects the land described in the Schedule hereto, such land being no longer required.
SCHEDULE
APPROXIMATE area of the piece of land not required: 1,167 acres. Being part reserve (New Zealand Gazette of 31st August, 1939, at page 2251).
Situated in Blocks II and III, Cape Campbell Survey District, and Blocks XII and XIV, Clifford Bay Survey District.
In the Marlborough Land District; as the same is more particularly delineated on the plan marked P.W.D. 118367, deposited in the office of the Minister of Works at Wellington, and thereon coloured edged red.
Given under the hand of His Excellency the Governor-General of the Dominion of New Zealand, and issued under the Seal of that Dominion, this 11th day of December, 1943.

Proclaiming a Road-line laid off in Block XII, Awaroa Survey District, Auckland Land District, to be a Public Road

A PROCLAMATION
WHEREAS the land described in the Schedule hereto was, by an order of the Native Land Court made on the first day of January, one thousand nine hundred and forty-three, duly laid off as a road-line in pursuance of sections four hundred and eighty-three and four hundred and eighty-four of the Native Land Act, 1931:
And whereas the said Court is of the opinion that it is in the public interest that the said road-line should be proclaimed as a public road, and a notification to that effect has been forwarded to the Minister of Lands, in terms of section four hundred and eighty-six of the said Act:
And whereas one month’s notice in writing of the intention to proclaim the said road-line as a public road has been given by the Surveyor-General to the local authority of the district concerned, in terms of subsection two of section four hundred and eighty-seven of the said Act:
And whereas it is now expedient that the said road-line should be proclaimed as a public road:
Now, therefore, I, Cyril Louis Norton Newall, the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers conferred by section four hundred and eighty-seven of the Native Land Act, 1931, do hereby proclaim as a public road the road-line described in the Schedule hereto.
SCHEDULE
APPROXIMATE area of the piece of land proclaimed as a road: 6 acres 2 roods 15 perches.
Being part Allotment 52, Whangape Parish, Block XII, Awaroa Survey District. (N.L. plan 16220.)
In the Auckland Land District; as the same is more particularly delineated on the plan marked L. and S. 16/2911, deposited in the Head Office, Department of Lands and Survey, at Wellington, under No. 2921, and thereon coloured blue.
Given under the hand of His Excellency the Governor-General of the Dominion of New Zealand, and issued under the Seal of that Dominion, this 11th day of December, 1943.

Authorizing Thomas Mooney, of Newton Flat, Hotelkeeper, to use Water for the Purpose of generating Electricity and to erect certain Electric Lines

PURSUANT to the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby grant to Thomas Mooney, of Newton Flat, Hotelkeeper (hereinafter referred to as “the licensee”), a license subject to the conditions hereinafter set forth to obstruct, impound, or divert the waters of Deep Creek, situated in Section 2, Block XV, Lyell Survey District, in the Land District of Nelson, and to take and use therefrom for the purposes hereinafter set forth a stream of water not exceeding one cubic foot per second at any one time, and to erect the electric lines hereinafter described.
CONDITIONS
- IMPLIED CONDITIONS
THE conditions directed to be implied in all licenses by the Water-power Regulations 1934 and the Electrical Supply Regulations 1935 shall be incorporated in and shall form part of this license, except in so far as the same may be inconsistent with the provisions hereof.
- LICENSE SUBJECT TO REGULATIONS
This license is issued under the Water-power Regulations 1934, and is subject thereto and to the Electrical Supply Regulations 1935 and the Electrical Wiring Regulations 1935, and to any regulations made or to be made in amplification or amendment thereof or in substitution therefor.
- UTILIZATION OF WATER AND LOCATION OF HEADWORKS
Water shall be used under this license solely for the purpose of generating electricity, and shall be taken from the said stream at a point in Section 2, Block XV, Lyell Survey District, in the Nelson Land District, as indicated on the plan marked P.W.D. 117550, deposited in the office of the Minister of Works.
- GENERAL DESCRIPTION OF WORKS
The licensee is hereby authorized, subject to the conditions hereof, to construct, maintain, and use the following works for the purposes of this license, the positions of the said works being indicated on the said plan P.W.D. 117550:—
(a) Headworks situated in Section 2, Block XV, Lyell Survey District, consisting of a dam and intake giving a static head of approximately 85 ft.:
(b) Head-race and pipe-line from such headworks to the power-house hereinafter described:
(c) Power-house with all necessary equipment for generating electricity, situated in Section 2, Block XV, Lyell Survey District:
(d) Electric lines leading from the power-house aforesaid across Deep Creek, Section 4, Scenic Reserve, Section 98, Block XV, Lyell Survey District, and the Westport-Nelson Main Highway to the licensee’s hotel situated on Section 98, Block XV, Lyell Survey District; the said lines being more particularly delineated by means of black lines on the said plan P.W.D. 117550.
- DURATION OF LICENSE
Unless sooner determined this license shall continue in force until the 31st day of March, 1964, or until electrical energy is available from an Electric-power Board or other public source of supply, whichever is the earlier.
- SYSTEM OF SUPPLY
The system of supply shall be as described in paragraph (d) of clause 21-01 of the Electrical Supply Regulations 1935. The generating voltage and the transmission voltage shall be approximately 240 volts direct current.
- RENTAL
For the purpose of assessing the rental or annual sum payable in respect of this license, the licensee may install a suitable maximum-demand indicator to the satisfaction of the Inspecting Engineer of the Public Works Department, and, failing such installation, the rental shall be determined on the maximum capacity of the generating plant installed. The present plant is rated at 4½ kilowatts.

IN pursuance and exercise of the powers vested in him by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and declare that the portion of road described in the Schedule hereto shall, on and after the date of this Order in Council, become Government road.
SCHEDULE
APPROXIMATE area of the portion of road declared to be Government road: 1 acre 1 rood 5 perches.
Adjoining or passing through Taumata makuku No. 2b Block.
Situated in Block XI, Kawakawa Survey District (Auckland R.D.). (S.O. 30677.)
In the North Auckland Land District; as the same is more particularly delineated on the plan marked P.W.D. 111533, deposited in the office of the Minister of Works at Wellington, and thereon coloured green.
