“Reserves” means the areas declared to have been ceded to the Crown by the Proclamation dated the 30th day of May, 1931, and gazetted on the 4th day of June following:
“Minister” means the Minister of the Crown for the time being charged with the administration of the Scenery Preservation Act, 1908.

The first meeting of the Board shall be held in Rotorua during the month of February, 1943. Thereafter the Board shall meet for the transaction of business at such times and place as may from time to time be fixed by the Board.

The Board shall, at its first meeting, elect one of its members to be Chairman, who shall have an original as well as a casting vote, and who shall hold office until the election of his successor.

Special meetings may be convened by the Chairman, provided that two days’ notice of such meeting be given to each member, specifying the business to be transacted at such special meeting. No business other than that so specified shall be transacted at such meeting.

Any three members of the Board shall form a quorum. Any meeting may be adjourned from time to time.

All questions shall be determined by the majority of votes of the members of the Board present at a meeting.

If at any meeting the Chairman is not present at the time appointed for holding the same, the members present shall choose one of their number to be Chairman of such meeting.

If by resignation, death, incapacity, or otherwise the seat of any member shall be or become vacant, or if any member absents himself without reasonable cause from three consecutive meetings of the Board, the Governor-General shall have power, but subject always to the special provisions of section 17 of the Native Purposes Act, 1931, relating to the representation of the Ngati-Tarawhai Subtribe, to appoint any other person to be a member of the Board in his stead.

The Board shall control the reserves in accordance with the provisions of the Scenery Preservation Act, 1908, and of the regulations made thereunder.

The funds of the Board shall consist of all moneys received by it under or by virtue of the Scenery Preservation Act, 1908, or any other enactment dealing with the reserves, or in any other manner whatsoever in respect of the reserves under its control, and all such moneys shall forthwith after receipt by the treasurer or other proper officer of the Board be paid into such bank as the Board from time to time appoints to an account to be called “The Lake Okataina Scenic Board Account.”

The funds of the Board shall be applied in managing, administering, and improving the reserves under its control, and for no other purpose.

No moneys of the Board shall be disbursed except pursuant to a resolution passed at a meeting of the Board duly convened and held, but no bank or other person shall be concerned to inquire whether this requirement has been complied with or be affected by any notice of non-compliance therewith.

All cheques drawn on the bank account of the Board shall be signed, and all negotiable or transferable instruments requiring the endorsement of the Board shall be endorsed by three persons, one of whom shall be a member of the Board, another of whom shall be a member or officer of the Board, and the third of whom shall be a Field Inspector or other officer of the Department of Lands and Survey from time to time appointed for the purpose by the Under-Secretary for Lands. In the case of moneys of the Board being kept in the Post-office Savings-bank, the account shall be in the name of the Board, and shall be operated upon by three trustees, one of whom shall be a member of the Board, another of whom shall be a member or other officer of the Board, and the third of whom shall be a Field Inspector or other officer of the Department of Lands and Survey from time to time appointed for the purpose by the Under-Secretary for Lands.

Within twenty-eight days after the close of each financial year ending on the 31st day of March, the Board shall cause to be prepared and submitted to the Audit Office for audit a statement of assets and liabilities together with a statement of accounts (including a receipts and payments account) showing fully the financial position of the Board at the close of the year; the accounts shall be audited by the Audit Office, which for that purpose shall have all the powers it has under the Public Revenues Act, 1926, in respect of public moneys; and the statements shall, when duly audited, be submitted to the Minister accompanied by a report as to the operations of the Board for the year.

ORDER IN COUNCIL.
At the Government House at Wellington, this 17th day of February, 1943.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
PURSUANT to the Harbours Act, 1923, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby license and permit the Thames County Council (hereinafter called “the Council,” which term shall include its successors or assigns, unless the context requires a different construction), to use and occupy parts of the foreshore and land below low-water mark at Puriri, on the Waihou River, and at Whangamata, Whangamata Harbour, as shown on approved plans marked M.D. 6811 and 6597 respectively and deposited in the office of the Marine Department at Wellington, for the purpose of maintaining thereon wharves as shown on the said plans, such license to be held and enjoyed by the Council upon and subject to the terms and conditions set forth in the First Schedule hereto; and doth prescribe that the dues and rates specified in the Second Schedule hereto shall be charged and taken by the Council for the use of the said wharves, and doth hereby make the regulations set forth in the Third Schedule hereto governing the management and use of the said wharves.
FIRST SCHEDULE.
CONDITIONS.
(1) THIS license is subject to the Foreshore License Regulations 1940, and the provisions of those regulations shall, so far as applicable, apply hereto.
(2) The term of the license shall be fourteen years from the 11th day of February, 1943.
(3) The annual sum payable by the Council shall be one shilling (1s.) payable on demand.
SECOND SCHEDULE.
GOODS WHARFAGE.
EVERY person, firm, or company who uses the said wharves shall pay to the Council wharf dues as follows:—
