The South-western Side of Portion of Nicholas Street, in the City
of Auckland, exempted from the Provisions of Section 128 of
the Public Works Act, 1928, subject to Conditions as to the
Building-line

At the Government House at Wellington, this 1st day of
December, 1943
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

IN pursuance and exercise of the powers conferred by the Public
Works Act, 1928, and of all other powers in anywise enabling
him in this behalf, His Excellency the Governor-General of the
Dominion of New Zealand, acting by and with the advice and consent
of the Executive Council of the said Dominion, doth hereby approve
of the following resolution passed by the Auckland City Council
on the twenty-second day of July, one thousand nine hundred and
forty-three (the portion of street affected by such resolution being
more particularly described in the Schedule hereto), viz. :

"The Auckland City Council, being the local authority
having control of the streets in the City of Auckland, by
resolution declares that the provisions of section one hundred
and twenty-eight of the Public Works Act, 1928, shall not apply
to that portion of Nicholas Street adjoining Lot 7 of sub-
division of Allotments 1, 2, 7–10, 23–27, and adjoining portion
of Allotment 24, both of Section 40, City of Auckland,
Certificates of Title 26/253, 81/42, and 599/263 ";

subject to the condition that no shop or other building with a public
entrance to Nicholas Street and no shop window fronting the said
street displaying wares for sale shall at any time be erected or
permitted to be used on the land fronting the south-western side
of portion of Nicholas Street (described in the Schedule hereto)
within a distance of twenty feet from the centre-line of the said
portion of street, and that no building for residential purposes shall
at any time be erected or permitted to be used on the said land
within a distance of thirty-three feet from the centre-line of the said
portion of street.

SCHEDULE

THE south-western side of all that portion of street situated in the
North Auckland Land District, City of Auckland, known as Nicholas
Street, fronting Lot 7 of subdivisions of Allotments 1, 2, 7, 8, 9, 10,
23, 24, 25, 27, and 26 of Section 40, City of Auckland, and portion
of Lot 24 of Section 40, City of Auckland. As the same is more
particularly delineated on the plan marked P.W.D. 117734, deposited
in the office of the Minister of Works at Wellington, and thereon
coloured red.

The Northern Side of Portion of Vogel Street, in the Borough of
Gisborne, exempted from the Provisions of Section 128 of the
Public Works Act, 1928, subject to a Condition as to the Building-
line

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

IN pursuance and exercise of the powers conferred by the Public
Works Act, 1928, and of every other power in anywise enabling
him in this behalf, His Excellency the Governor-General of the
Dominion of New Zealand, acting by and with the advice and consent
of the Executive Council of the said Dominion, doth hereby approve
of the following resolution passed by the Gisborne Borough Council
on the twenty-ninth day of June, one thousand nine hundred and
forty-three, the side of the street affected by such resolution being
more particularly described in the Schedule hereto, viz. :

"That the Gisborne Borough Council, being the local
authority having control of the roads of the Borough of Gisborne,
by resolution declares that the provisions of section one hundred
and twenty-eight of the Public Works Act, 1928, shall not apply
to the undermentioned portion of Vogel Street—viz., the
north-western side adjoining Lot 16, D.P. 1007, and C.T.
37/207 ";

subject to the condition that no building or part of a building shall at
any time be erected on the land fronting the northern side of portion
of Vogel Street (described in the Schedule hereto) within a distance
of thirty-three feet from the centre-line of the said portion of street.

SCHEDULE

THE northern side of all that portion of street situated in the Gisborne
Land District, Borough of Gisborne, known as Vogel Street, fronting
Lot 16, D.P. 1007, being part Section 130, Block A of Whataupoko
No. 6 Block. As the same is more particularly delineated on the
plan marked P.W.D. 118051, deposited in the office of the Minister
of Works at Wellington, and thereon coloured red.

exempted from the Provisions of Section 128 of the Public Works
Act, 1928, subject to a Condition as to the Building-line

him in this behalf, His Excellency the Governor-General of the

on the fourteenth day of September, one thousand nine hundred
and forty-three, viz. :

"The Motueka Borough Council, being the local authority
having control of the roads in the Borough of Motueka, by
resolution declares that the provisions of section one hundred
and twenty-eight of the Public Works Act, 1928, shall not
apply to the southern side of Poole Street adjoining Lot 21,
D.P. 1599, being part Section 160, N.R., Motueka District,
Block IV, Motueka Survey District, and contained in Certificate of Title, Volume 58, folio 77 ";

subject to the condition that no building or part of a building shall
at any time be erected on the land fronting the southern side of
portion of Poole Street (described in the Schedule hereto) within a
distance of thirty-three feet from the centre-line of the said portion
of street.

SCHEDULE

THE southern side of all that portion of street situated in the Nelson
Land District, Borough of Motueka, known as Poole Street, fronting
Lot 21, D.P. 1599, part Section 160, Native Reserve, District of
Motueka, Block IV, Motueka Survey District. As the same is more
particularly delineated on the plan marked P.W.D. 118097, deposited
in the office of the Minister of Works at Wellington, and thereon
coloured red.

Portion of Queen Street, in the Borough of Marton, exempted from
the Provisions of Section 128 of the Public Works Act, 1928,
subject to a Condition as to the Building-line

IN pursuance and exercise of the powers conferred by the Public
Works Act, 1928, and of every other power in anywise enabling
him in this behalf, His Excellency the Governor-General of the
Dominion of New Zealand, acting by and with the advice and consent
of the Executive Council of the said Dominion, doth hereby approve
of the following resolution passed by the Marton Borough Council
on the tenth day of November, one thousand nine hundred and
forty-three, in so far as it affects the side and portion of street
described in the Schedule hereto, viz. :

"The Marton Borough Council, being the local authority
having control of the streets in the Borough of Marton, by
resolution declares that the provisions of section one hundred
and twenty-eight of the Public Works Act, 1928, shall not
apply to the portion of the street known as Queen Street
adjoining that piece of land comprising Lots 48, 49, 50, 53, 54,
55, 59, 60, 61, and 62, and parts of Lots 51 and 52 on Deeds
Plan No. 177, part of Section 18, Rangitikei Agricultural
Reserve, Town of Marton, being all the land included in Certificate of Title, Register, book, Volume 494, folio 187 ";

subject to the condition that no building or part of a building shall
at any time be erected on the land fronting the western side of the
portion of Queen Street (described in the Schedule hereto) within
a distance of thirty-three feet from the centre-line of the said portion
of street.

SCHEDULE

THE western side of all that portion of street in the Wellington Land
District, Borough of Marton, known as Queen Street, fronting
Lots 48, 59, 60, 61, and 62, Deeds Plan 177, being part Section 18,
Rangitikei Agricultural Reserve. As the same is more particularly
delineated on the plan marked P.W.D. 118287, deposited in the
office of the Minister of Works at Wellington, and thereon coloured
red.
