Fixing Sittings of the Court of Appeal

ORDER IN COUNCIL
At the Government House at Wellington, this 24th day of November, 1943
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
WHEREAS by the Judicature Amendment Act, 1913, it is enacted that the Court of Appeal shall hold its sittings at such times and places as are from time to time appointed by the Governor-General in Council and notified in the Gazette twenty-one days at least before the times so fixed respectively, and that such appointment shall determine the division by which such sittings shall be held:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby appoint and declare that sittings of the Court of Appeal of New Zealand shall be held within the Supreme Court House, in the City of Wellington, upon the following days at eleven o'clock in the forenoon, and doth hereby determine that such sittings shall be held by the respective divisions of the said Court as are shown hereunder:—
Monday, the sixth day of March, one thousand nine hundred and forty-four: By the First Division of the said Court.
Monday, the twelfth day of June, one thousand nine hundred and forty-four: By the Second Division of the said Court.
Monday, the eleventh day of September, one thousand nine hundred and forty-four: By the First Division of the said Court.

Directing the Sale of Land under the Public Works Act, 1928, in Block IX, Waitemata Survey District

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
IN pursuance and exercise of the powers and authorities conferred upon him by the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby direct the sale of the land described in the Schedule hereto, such land being no longer required for the purpose for which it was acquired.
SCHEDULE
APPROXIMATE area of the piece of land directed to be sold: 1 rood.
Being part Lot 1, D.P. 22456, being portion of Allotment 1, Waipareira Parish.
Situated in Block IX, Waitemata Survey District (Auckland R.D.). (S.O. 32783.)
In the North Auckland Land District; as the same is more particularly delineated on the plan marked P.W.D. 116301, deposited in the office of the Minister of Works at Wellington, and thereon coloured yellow.

IN pursuance and exercise of the powers and authorities conferred upon him by the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby direct the sale of the land described in the Schedule hereto, such land being no longer required for the public work for which it was acquired.

The South-eastern Side of Portions of Bay Road, in the County of Waikouaiti, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line

ORDER IN COUNCIL
At the Government House at Wellington, this 1st day of December, 1943
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of every other power in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Waikouaiti County Council on the twenty-seventh day of September, one thousand nine hundred and forty-three, viz.:—
“That the Waikouaiti County Council, being the local authority having control of the roads in the Waikouaiti County, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the south-east side of portion of Bay Road fronting Lot 20 and part Lots 21 and 22, Warrington Estate, such land being comprised and described in Certificate of Title, Register-books, Volume 304, folio 227, and Volume 119, folio 96⁸; subject to the condition that no building or part of a building shall at any time be erected on the land fronting the south-eastern side of portions of Bay Road (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portions of road.
SCHEDULE
The south-eastern side of those portions of road, situated in the Otago Land District, County of Waikouaiti, known as Bay Road, fronting Lot 20 and part Lots 21 and 22, D.P. 139, Warrington Estate, and being part Section 1 of 50 and 2 of 50, Waikouaiti District. As the same are more particularly delineated on the plan marked P.W.D. 118058, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.
