Consenting to the Raising of a Portion (£38,000) of the Marlborough
Hospital Board Loan of £100,000 and prescribing the Conditions
thereof

ORDER IN COUNCIL
At the Government House at Wellington, this 24th day of
November, 1943
Present:
His Excellency the Governor-General in Council
WHEREAS by Order in Council made on the nineteenth day of
November, one thousand nine hundred and forty-one, and
subject to the determinations as to borrowing and repayment
therein set out, consent was given to the raising by the Marlborough
Hospital Board (hereinafter called “the said local authority”) of
a loan of one hundred thousand pounds (£100,000), to be known as
“Building Extension Loan, 1941” (hereinafter called “the said
loan”):
And whereas the authority conferred by the said Order in Council
has not been fully exercised:
And whereas the authority has lapsed in accordance with the
provisions of clause six of the said Order in Council, and it is not
now lawful or competent for the said local authority to raise the
said loan or any portion thereof except in accordance with the
provisions of a further Order in Council that may be issued pursuant
to section eleven of the Local Government Loans Board Act, 1926
(hereinafter called “the said Act”):
And whereas the said local authority is now desirous of raising
a portion of the said loan amounting to thirty-eight thousand
pounds (£38,000) (hereinafter called “the said sum”), and it is
expedient to authorize the said local authority to raise the said sum
on the conditions hereinafter set out:
Now, therefore, His Excellency the Governor-General of the
Dominion of New Zealand, acting by and with the advice and consent
of the Executive Council of the said Dominion, and in pursuance and
exercise of the powers and authorities conferred on him by section
eleven of the said Act, as set out in section twenty-nine of the Finance
Act, 1932 (No. 2), and of all other powers and authorities enabling
him in this behalf, doth hereby consent to the raising in New Zealand
by the said local authority of the said sum up to the amount of
thirty-eight thousand pounds (£38,000) for the purpose for which the
said loan was authorized, and in giving such consent doth hereby
determine as follows:—
(1) The term for which the said sum or any part thereof may be
borrowed shall not exceed twenty-five (25) years.
(2) The rate of interest that may be paid in respect of the said
sum or any part thereof shall be such as shall not produce to the
lender or lenders a rate exceeding three pounds twelve shillings and
sixpence (£3 12s. 6d.) per centum per annum.
(3) The said sum or any part thereof, together with interest
thereon, shall be repaid by equal aggregate annual or half-yearly
instalments extending over the term as determined in (1) above.
(4) The payment of such instalments shall be made in New
Zealand, and no such instalment shall be paid out of loan-moneys.
(5) The rate payable for brokerage, underwriting, and procuration fees in respect of the borrowing of the said sum or any part
thereof shall not in the aggregate exceed one-half per centum of any
amount raised.
(6) No moneys shall be borrowed under this consent after the
expiration of two years from the date hereof.

Varying the Determinations in respect of the Marlborough Hospital
Board's Loan of £33,000

At the Government House at Wellington, this 24th day of

His Excellency the Governor-General in Council
WHEREAS by Order in Council made on the tenth day of
November, one thousand nine hundred and forty-three
(hereinafter called “the said Order in Council”), and subject to
the determinations as to borrowing and repayment therein set out,
consent was given to the raising in New Zealand by the Marlborough
Hospital Board (hereinafter called “the said local authority”) of
a loan of thirty-three thousand pounds (£33,000), to be known as
“Building Extension Loan, 1943” (hereinafter called “the said
loan”):
And whereas the said loan has not yet been raised, and it is
expedient to vary the determinations in respect of the said loan:
Now, therefore, His Excellency the Governor-General of the
Dominion of New Zealand, acting by and with the advice and consent
of the Executive Council of the said Dominion, and in pursuance and
exercise of the powers and authorities conferred on him by
section eleven of the Local Government Loans Board Act, 1926,
as set out in section twenty-nine of the Finance Act, 1932 (No. 2),
and of all other powers and authorities enabling him in this behalf,
doth hereby vary the determinations aforesaid in respect of the said
loan by prescribing that in lieu of repayment by equal aggregate
annual or half-yearly instalments of principal and interest, as
specified in clause three of the said Order in Council, the said loan
shall be repaid by the half-yearly redemption of debentures in the
half-years set out in the first column of the Schedule hereto of the
amounts set opposite such half-years in the second column of the
said Schedule, the first such redemption to be made not later than
six months after the raising of the said loan or any portion thereof.

Licensing the Dargaville Sawmilling Company, Limited, to use and
occupy a Part of the Foreshore at Dargaville as a Site for a Wharf

At the Government House at Wellington, this 17th day of November,

His Excellency the Governor-General in Council
PURSUANT to the Harbours Act, 1923, His Excellency the
Governor-General, acting by and with the advice and consent
of the Executive Council, doth hereby license and permit the Dargaville Sawmilling Company, Limited, of Dargaville (hereinafter
called “the company,” which term shall include its successors or
assigns, unless the context requires a different construction), to use
and occupy a part of the foreshore and land below low-water mark
at Dargaville, as shown on approved plans marked M.D. 2050 and
4278, and deposited in the office of the Marine Department at
Wellington, for the purpose of maintaining thereon a wharf as shown
on the said plans, such license to be held and enjoyed by the company
upon and subject to the terms and conditions set forth in the Schedule
hereto.
SCHEDULE
(1) This license is subject to the Foreshore License Regulations 1940,
and the provisions of those regulations shall, so far as applicable,
apply hereto.
(2) The term of the license shall be five years from the 1st day of
December, 1943.
(3) The premium payable by the company shall be one pound
(£1), and the annual sum so payable five pounds (£5).
(4) The master of every vessel discharging ballast at the said
wharf shall have all such ballast taken away and deposited above
high-water mark, or at such other places as may be approved by the
company.
