HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
IN pursuance and exercise of the powers vested in him by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and declare that the portion of road described in the Schedule hereto shall, on and after the date of this Order in Council, become Government road.
SCHEDULE
APPROXIMATE area of the piece of road declared to be Government road: 2 acres 2 roods 18 perches.
Adjoining or passing through part Allotment 378, D.P. 24471, and part Section 8, Block X, Waipu Survey District.

Portions of Roads, in the County of Waimea, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line

ORDER IN COUNCIL
At the Government House at Wellington, this 24th day of November, 1943
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Waimea County Council on the eighth day of October, one thousand nine hundred and forty-three, the portions of roads affected by such resolution being more particularly described in the Schedule hereto, viz.:
"The Waimea County Council, being the local authority having control of the roads in the County of Waimea, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the western side of public road (Swamp Road) fronting the eastern boundary of Sections 41 and 42, northern side of public road fronting the southern boundary of Section 42, eastern side of public road fronting the western boundary of Section 42 and part Section 41, western side of same public road fronting eastern boundary of Sections 14 and 45, southern side of public road fronting northern boundary of Sections 14, 45, and 269, and all that portion of public road adjoining or running through Sections 45, 269, 270, and 14, all the aforesaid sections being in the Motueka District, Block X, Kaiteriteri Survey District";
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the portions of roads (described in the Schedule hereto) within a distance of thirty-three feet from the centre-lines of the said portions of roads.
SCHEDULE
THE western side of all that portion of road, situated in the Nelson Land District, County of Waimea, known as Swamp Road, fronting Sections 41 and 42, District of Motueka.
Also the northern side of the public road, situated in the said land district and county, fronting the southern boundary of Section 42, District of Motueka.
Also the eastern side of the public road, situated in the said land district and county, fronting the western boundary of Section 42 and part Section 41, District of Motueka.
Also the western side of the public road, situated in the said land district and county, fronting the eastern boundary of Sections 14 and 45, District of Motueka.
Also the southern side of the public road, situated in the said land district and county, fronting the northern boundary of Sections 14, 45, and 269, District of Motueka.
Also all that portion of public road in the said land district and county, adjoining or passing through Sections 45, 269, 270, and 14, District of Motueka.
As the same are more particularly delineated on the plan marked P.W.D. 113564, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Dunedin City Council on the eleventh day of October, one thousand nine hundred and forty-three, viz.:
"That the Dunedin City Council, being the local authority having control of the streets in the City of Dunedin, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the undermentioned portions of streets, viz.:
"(a) The south-eastern side of portion of Botting Street adjoining Lot 42, D.P. 72, Township of Maybank;
"(b) The north-western side of the portion of Signal Hill Road adjoining Lot 35, D.P. 72, Township of Maybank;
such land being comprised and described in Certificate of Title 177/261";
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the south-eastern side of portion of Botting Street or the north-western side of portion of Signal Hill Road (described in the Schedule hereto) within a distance of thirty-three feet from the centre-lines of the said portions of streets.
SCHEDULE
THE south-eastern side of all that portion of street situated in the Otago Land District, City of Dunedin, known as Botting Street, fronting Lot 42, D.P. 72, Township of Maybank, and being part Section 49, Block IX, North Harbour and Blueskin District.
Also the north-western side of all that portion of street situated in the said land district and city, known as Signal Hill Road, fronting Lot 35, D.P. 72, Township of Maybank, and being part Section 49, Block IX, North Harbour and Blueskin District. As the same are more particularly delineated on the plan marked P.W.D. 118098, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

Changing the Purpose of a Reserve in Westerfield Survey District, Canterbury Land District

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
WHEREAS the land described in the Schedule hereto is a reserve duly set apart for a gravel-pit: And whereas it is expedient that the purpose of the reservation over such land shall be changed to a reserve for plantation purposes:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in exercise of the powers and authorities conferred upon him by subsection one (a) of section seven of the Public Reserves, Domains, and National Parks Act, 1928, doth hereby declare that the purpose of the reserve described in the Schedule hereto is hereby changed from a reserve for a gravel-pit to a reserve for plantation purposes.

RESERVE 1970, Block IX, Westerfield Survey District: Area, 5 acres, more or less.
