Revoking the Reservation over Portion of a Scenic Reserve in the Wellington Land District.

A PROCLAMATION.

WHEREAS the land described in the Schedule hereto is portion of a reserve duly set apart for scenic purposes:
And whereas the said land is no longer suitable for scenic purposes by reason of the absence of bush of scenic value thereon:
Now, therefore, I, Cyril Louis Norton Newall, the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers conferred upon me by section eight of the Scenery Preservation Amendment Act, 1910, do hereby revoke the reservation for scenic purposes over the land described in the Schedule hereto.

SCHEDULE.

WELLINGTON LAND DISTRICT.

ALL that area in the Wellington Land District, Hutt County, containing by admeasurement 28·9 perches, more or less, being part of Lot 4 on D.P. 12030, being part of Section 20, Harbour District, Block XVI, Belmont Survey District: Bounded towards the west by Cheviot Street, 30·3 links; towards the north by Lot 3 on D.P. 8299, 596·6 links; towards the east by other part of the said Lot 4 on D.P. 12030, 30·3 links; and towards the south by Lot 26 on D.P. 1714, 596·6 links: be all the aforesaid linkages more or less. As the same is delineated on the plan marked L. and S. 4/542c, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon edged red.

Given under the hand of His Excellency the Governor-General of the Dominion of New Zealand, and issued under the Seal of that Dominion, this 25th day of September, 1942.

PURSUANT to the Electric-power Boards Act, 1925, and section twenty-two of the Statutes Amendment Act, 1941, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby consent to the deposit by the Tauranga Electric-power Board of the sum of five thousand pounds (£5,000) at interest with the Tauranga County Council if and so far as such deposit may lawfully be received on deposit by the said Council pursuant to section three of the Local Bodies’ Finance Act, 1921–22.

Varying the Determinations in respect of the Taihape Borough Council’s Loan of £5,500.

THE RIGHT HON. P. FRASER PRESIDING IN COUNCIL.

WHEREAS by Order in Council made on the tenth day of June, one thousand nine hundred and forty-two (hereinafter called “the said Order in Council”), and subject to the determination as to borrowing and repayment therein set out, consent was given to the raising in New Zealand by the Taihape Borough Council (hereinafter called “the said local authority”) of a loan of five thousand five hundred pounds (£5,500), to be known as “Water-supply and No. 3 Drainage Area Redemption Loan, 1942” (hereinafter called “the said loan”):
And whereas the authority conferred by the said Order in Council has not yet been exercised, and it is expedient to vary certain of the determinations aforesaid in respect of the said loan:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section eleven of the Local Government Loans Board Act, 1926, as set out in section twenty-nine of the Finance Act, 1932 (No. 2), and of all other powers and authorities enabling him in this behalf, doth hereby vary certain of the determinations aforesaid in respect of the said loan by prescribing as follows:—
(1) In lieu of a rate of interest not exceeding three pounds five shillings (£3 5s.) per centum per annum, as specified in clause two of the said Order in Council, the rate of interest that may be paid in respect of the said loan or any part thereof shall be such as shall not produce to the lender or lenders a rate exceeding three pounds ten shillings (£3 10s.) per centum per annum.
(2) In lieu of making provision for the repayment of the said loan by establishing a sinking fund in respect thereof, as specified in clause three of the said Order in Council, the said local authority may raise the said loan or any portion thereof upon terms of making the same, together with interest thereon, repayable by equal aggregate annual or half-yearly instalments extending over the term of ten (10) years, as specified in clause one of the said Order in Council.

Delegating Powers under the Cemeteries Act, 1908.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 23rd day of September, 1942.

Present:

THE RIGHT HON. P. FRASER PRESIDING IN COUNCIL.

PURSUANT to the Cemeteries Act, 1908, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby delegate to the Inangahua County Council the powers conferred on him by section four of the said Act of appointing and removing trustees in respect of the Inangahua Junction Cemetery, as described in the Schedule hereto.

SCHEDULE.

ALL that area in the Inangahua County containing by admeasurement 1 rood and 28 perches, more or less, being part of Section 28, Square 134, situated in Block V, Inangahua Survey District, bounded towards the south-east by a public road 200·6 links, and towards the south-west, north-west, and north-east by the other portion of Section 28 aforesaid, 214 links, 198·2 links, and 213·5 links respectively. As the same is more particularly delineated on plan marked L. and S. 22/2881A, deposited in the Head Office of the Lands and Survey Department at Wellington, and thereon in outline bordered red. The Southern Side of Portion of Alexandra Street, in the City of Christchurch, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

At the Government House at Wellington, this 16th day of September, 1942.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of every other power in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Christchurch City Council on the seventeenth day of August, one thousand nine hundred and forty-two (the portion of street affected by such resolution being more particularly described in the Schedule hereto), viz.:—

“The Christchurch City Council, being the local authority having control of the streets in the City of Christchurch, hereby, by resolution, declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the southern side of the portion of Alexandra Street fronting subdivision, C.T. 8/141, being balance of part Lot 1, D.P. 339, part R.S. 41”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the southern side of the portion of Alexandra Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.

SCHEDULE.

THE southern side of portion of street situated in the Canterbury Land District, City of Christchurch, known as Alexandra Street, adjoining part Lot 1, D.P. 339, part Rural Section 41. As the same is more particularly delineated on the plan marked P.W.D. 115157, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.
