Approving the Terms of a License granted to Butler Brothers, Limited, for a Tramway across the Greymouth-Waiho Main Highway.

At the Government House at Wellington, this 21st day of January, 1942.

Present:

His Excellency the Governor-General in Council.

IN pursuance and exercise of the powers conferred on him by the Tramways Act, 1908, and the Tramways Amendment Act, 1910, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the term of the license granted for a period of ten years from the twenty-third day of December, one thousand nine hundred and forty-one, by the Main Highways Board to Butler Brothers, Limited, a duly incorporated company having its registered office for New Zealand at Auckland (hereinafter referred to as “the licensee”), authorizing the licensee to construct and maintain a private tramway on and across the Greymouth-Waiho Main Highway, the position of such tramway being more particularly shown on the plan marked P.W.D. 110452, deposited in the office of the Minister of Public Works at Wellington.

The Southern Side of Portion of Cannon Street and the Western Side of Portion of the Dunedin—Port Chalmers Main Highway, in the Borough of West Harbour, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

At the Government Buildings at Wellington, this 14th day of January, 1942.

The Right Hon. P. FRASER PRESIDING IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of every other power in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the West Harbour Borough Council on the fourth day of November, one thousand nine hundred and forty-one, in so far as it affects the sides and portions of the streets described in the Schedule hereto, viz.:

“The West Harbour Borough Council, being the local authority having control of the streets in the Borough of West Harbour, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that portion of Cannon Street adjoining Allotment 45, Township of St. Leonards, and the Main Road fronting Allotments 45 and 46, Township of St. Leonards”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the southern side of portion Cannon Street or the western side of portion of the Dunedin—Port Chalmers Main Highway (described in the Schedule hereto) within a distance of thirty-three feet from the centre-lines of the said portions of streets.

SCHEDULE.

The southern side of all that portion of street, situated in the Otago Land District, Borough of West Harbour, known as Cannon Street, fronting part Lot 45, Deeds Plan 109, Township of St. Leonards, being part Section 19, Upper Harbour West District.

Also the western side of all that portion of street in the said land district and borough known as the Dunedin—Port Chalmers Main Highway fronting parts Lots 45 and 46, Deeds Plan 109, Township of St. Leonards, being part Section 19, Upper Harbour West District.

As the same are more particularly delineated on the plan marked P.W.D. 113139, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

Domain Board appointed to have Control of the Waikino Domain.

IN pursuance and exercise of the powers conferred by section forty-four of the Public Reserves, Domains, and National Parks Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby appoint

PURSUANT to the provisions of section forty-nine of the Native Purposes Act, 1931, and of the regulations made thereunder in respect of the Taranaki Maori Trust Board, and any other powers him enabling, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby appoint the persons whose names are set out in the Schedule hereto to be members of the said Taranaki Maori Trust Board constituted under the said section forty-nine.

PURSUANT to subsection (2) of section 442 of the Native Land Act, 1931, and all other powers him enabling, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, given on the recommendation of the Board of Native Affairs, doth hereby revoke the Order in Council made on the fourteenth day of March, one thousand nine hundred and thirty-two, and published in Gazette No. 19 of the seventeenth day of the same month, at page 547, and affecting Awaawakino A and other blocks in so far as it affects the lands described in the Schedule hereto.
