P URSUANT to section ninety-two of the Public Revenues Act, 1926, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby declare that all moneys payable to or received by the Pharmacy Industry Account established under the Industrial Efficiency (Pharmacy) Regulations 1938, shall come within the provisions of the said section ninety-two.

Vesting the Management of certain Wharves, in Akaroa Harbour, in the Akaroa County Council.

ORDER IN COUNCIL.

Present : HON. W. NASH PRESIDING IN COUNCIL.
P URSUANT to the Harbours Act, 1923, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council, doth hereby vest in the Akaroa County Council (hereinafter called "the Council," which term shall include its successors or assigns unless the context requires a different construction), the management of the wharf at Duvauchelles, Robinson's Bay, and Wainui, as shown on approved plans marked M.D. 3290 ; 4304, 4305 ; 1548 and 1549 respectively, and deposited in the office of the Marine Department at Wellington, such vesting to be subject to the terms and conditions set forth in the First Schedule hereto, and doth hereby prescribe that the regulations set forth in the Second Schedule hereto shall apply to the wharf at Wainui only.
FIRST SCHEDULE.
- THE vesting of the said wharves is subject to the Fore- shore License Regulations 1940, and the provisions of those regulations shall, so far as applicable, apply hereto.
- The term of the vesting shall be fourteen years from the 21st day of December, 1941.
- The Master of every vessel discharging ballast at the said wharves shall have all such ballast taken away and deposited at high-water mark, or at such place as may be approved by the Minister or by any person appointed by the Minister for that purpose.
SECOND SCHEDULE. - No person shall, without the special permission of the Council or their appointee, store any goods in the wharf shed for a longer period than fourteen days.
- Every person shall stack the goods in the shed to the satisfaction of the Council or its appointee in such manner that the full storing-capacity of the wharf shed shall not be restricted.
- The shed may be locked up between the hours of 6 p.m. and 8 a.m., and during Sundays, whenever the Council may deem it advisable.
- The Council shall not be liable for loss or damage to goods stored.
- No person shall stack firewood, timber, or other goods within 4 ft. of the wharf-gangway or of the tramway-rails, and no person shall leave goods of any description on the wharf for a longer period than four days.
- No person shall leave the trolley on the public road, but shall replace the trolley on the wharf after using same.
- Any person opening the shed door to remove goods or for any other purpose shall reclose the door before leaving.
- Any person infringing these regulations shall be liable to a penalty not exceeding Β£2.

Authorizing Whakatane County Council to fix Water Charges according to Quantity used.

ORDER IN COUNCIL.
At the Government House at Wellington, this 21st day of January, 1942.

WHEREAS by Order in Council made on the eleventh day of April, one thousand nine hundred and twenty- four, and published in the Gazette on the fifteenth day of the same month, at page 895, there were conferred on the Whakatane County Council (hereinafter referred to as "the said Council") in respect of the County of Whakatane all the powers with respect to the supply of water for domestic or industrial purposes exercisable by a duly constituted Borough Council under sections eighty-two to eighty-seven, Part XXIV (with the exception of sections two hundred and forty-five and two hundred and forty-seven) and section three hundred and thirty-nine of the Municipal Corporations Act, 1920, and also section eleven of the Municipal Corporations Amendment Act, 1921β22 :
And whereas by virtue of the provisions of the Acts Inter- pretation Act, 1924, and the Municipal Corporations Act, 1933, the powers conferred by the Order in Council aforesaid enure and are exercisable by the said Council under the corresponding provisions of the Municipal Corporations Act, 1933 :
And whereas it is expedient that further powers be con- ferred on the said Council in respect of that portion of the County of Whakatane described in the Schedule hereto :
Now, therefore, in pursuance and exercise of the powers and authorities conferred on him by section one hundred and eighty-two of the Counties Act, 1920, and section eighty- five of the Municipal Corporations Act, 1933, and of all other powers and authorities enabling him in this behalf, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby confer on the said Council all the powers of a Borough Council under the said section eighty-five of the Municipal Corpora- tions Act, 1933, and doth hereby accordingly consent to the said Council making and levying over that portion of the County of Whakatane described in the Schedule hereto water rates and charges in respect both of the ordinary as well as of any extraordinary supply, according to the quantity of water consumed by any person receiving the same as measured by meter, at such rates or charges as may from time to time be fixed by any by-law of the said Council in that behalf, or as may be agreed on with any such person.
SCHEDULE.
ALL that area in the Whakatane County situated in Block III, Rangitaiki Upper Survey District, bounded by a line commencing at the point where the south boundary of the Railway Reserve meets the left bank of the Rangitaiki River ; thence running north-west generally by the south boundary of the said Railway Reserve to and across the Whakatane-Rotorua State Highway ; thence along the western side of the said State highway to the south-eastern corner of Lot 32, D.P. 21561 ; thence along the southern and western boundaries of that lot, part of the south-western boundaries of Lots 3 and 4, D.P. 26077, and part of the eastern boundary of Lot 17, D.P. 21561, the south-western boundaries of Lots 6 to 17, inclusive, on the last-mentioned plan, the north-western boundary of the said Lot 6 to Edgecumbe Station Road, along the said Edgecumbe Station Road to Lot 3, D.P. 21561, and along the south-eastern, south-western, and north-western boundaries of Lots 3 and 2 of the said D.P. 21561, to and across the said Edgecumbe Station Road to the south side of the Edgecumbe Railway-station Reserve, and along the said Station Reserve to a public road ; thence running north-easterly along the east side of the said public road to Railway Road West ; thence running south-easterly generally along the south side of the last-mentioned road to a point being the production of the western boundary of Lot 3, D.P. 19599 ; thence running across the said road, along the north-western boundary of the said Lot 3 to a public road ; along the western side of the said public road, to and across the eastern end of Railway Road West to the north boundary of the Railway Reserve ; along the said Railway Reserve, to and across a public road, and again by the said Railway Reserve to the left bank of the Rangitaiki River ; thence southward along the said left bank to the point of commencement. As the same is more particularly delineated on the plan marked I.A. 103/35/25, deposited in the Head Office of the Department of Internal Affairs at Wellington, and thereon edged red.
