The North-eastern Side of Portion of Songer Street and the South-eastern Side of Portion of Nayland’s Road, in the County of Waimea, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.
At the Government House at Wellington, this 17th day of June, 1942.
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of every other power in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Waimea County Council on the thirteenth day of May, one thousand nine hundred and forty-two, viz. :

“ The Waimea County Council, being the local authority having control of the roads in the County of Waimea, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the north-eastern side of portion of Songer Street nor to the south-eastern side of portion of Nayland’s Road adjoining part Section 51, Suburban South, Block III, Waimea Survey District (C.T. 59/286) ”;
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the north-eastern side of portion of Songer Street and the south-eastern side of portion of Nayland’s Road (described in the Schedule hereto) within a distance of thirty-three feet from the centre-lines of the said portions of roads.

SCHEDULE.
THE north-eastern side of all that portion of road situated in the Nelson Land District, County of Waimea, known as Songer Street, fronting part Section 51, Suburban South, Block III, Waimea Survey District.
Also the south-eastern side of all that portion of road situated in the said land district and county, known as Nayland’s Road, fronting part Section 51, Suburban South, Block III, Waimea Survey District.
As the same are more particularly delineated on the plan marked P.W.D. 114321, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

The Eastern Side of Portion of Exmouth Street, the Northern Side of Portion of Basque Road, and the Western Side of Portion of Dundonald Street, in the City of Auckland, exempted from the Provisions of Section 128 of the Public Works Act, 1928.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Auckland City Council on the fifth day of March, one thousand nine hundred and forty-two, in so far as it affects the sides and portions of the streets described in the Schedule hereto:

“ The Auckland City Council, being the local authority having control of the streets in the City of Auckland, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to portions of Exmouth Street, Basque Road, and Dundonald Street, adjoining part Allotments 1 and 2, Section 7, Suburbs of Auckland. ”

SCHEDULE.
THE eastern side of all that portion of street situated in the North Auckland Land District, City of Auckland, known as Exmouth Street, fronting part Allotments 1 and 2, Section 7, D.P. 20268, Suburbs of Auckland.
Also the northern side of all that portion of street situated in the said land district and city, known as Basque Road, fronting part Allotments 1 and 2, Section 7, D.P. 20268, Suburbs of Auckland.
Also the western side of all that portion of street situated in the said land district and city, known as Dundonald Street, fronting part Allotments 1 and 2, Section 7, D.P. 20268, Suburbs of Auckland.
As the said portions of street are more particularly delineated on the plan marked P.W.D. 113866, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured pink.

Lands permanently reserved.

C. L. N. NEWALL, Governor-General.
WHEREAS by the three-hundred-and-fifty-ninth section of the Land Act, 1924, it is enacted that the Governor-General may from time to time set apart temporarily as reserves, notwithstanding that the same may be then held under pastoral license, any Crown lands which in his opinion are required for any of the purposes in the said section mentioned:
And whereas by the three-hundred-and-sixtieth section of the said Act it is provided that land temporarily reserved under the said three-hundred-and-fifty-ninth section may, at the expiration of one month but not later than six months after the publication in the Gazette of notice of such temporary reservation, be permanently reserved, and that notice of such permanent reservation shall be published in the Gazette:
And whereas the lands specified in the first column of the Schedule hereto were, by the Warrant, the date of which is specified in the third column of the said Schedule, and the notification of which was published in the Gazette specified in the fourth column, temporarily reserved under the authority of the said Act for the purposes specified in the second column of the said Schedule:
Now, therefore, I, Cyril Louis Norton Newall, the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred upon me by the said Act, do hereby permanently reserve the lands so temporarily reserved as aforesaid, and enumerated in the first column of the Schedule hereto, for the purposes specified in the second column of the said Schedule, being the same purposes for which the said lands were so temporarily reserved as aforesaid.
