The South-eastern Side of Portion of Waimea West Road and
the North-western Side of Portion of an unnamed Road, in
the County of Waimea, exempted from the Provisions of
Section 128 of the Public Works Act, 1928, subject to a
Condition as to the Building-line.

At the Government Buildings at Wellington, this 7th day
of January, 1942.

THE HON. W. NASH PRESIDING IN COUNCIL.

IN pursuance and exercise of the powers conferred by the
Public Works Act, 1928, and of every other power in
anywise enabling him in this behalf, His Excellency the
Governor-General of the Dominion of New Zealand, acting
by and with the advice and consent of the Executive Council
of the said Dominion, doth hereby approve of the following
resolution passed by the Waimea County Council on the
tenth day of October, one thousand nine hundred and forty-
one, viz. :

"The Waimea County Council, being the local
authority having control of the roads in the County of
Waimea, by resolution declares that the provisions of
section one hundred and twenty-eight of the Public
Works Act, 1928, shall not apply to the south-eastern
side of the portion of Waimea West Road, nor to the
north-western side of the portion of public road adjoining
Section 134, District of Waimea West, Block V, Waimea
Survey District (C.T. 63/203) ";

subject to the condition that no building or part of a building
shall at any time be erected on the land fronting the south-
eastern side of the portion of Waimea West Road or the
north-western side of the portion of an unnamed road
(described in the Schedule hereto) within a distance of thirty-
three feet from the centre-lines of the said portions of roads.

SCHEDULE.

THE south-eastern side of all that portion of road situated in
the Nelson Land District, County of Waimea, known as
Waimea West Road, and the north-western side of all that
portion of an unnamed road in the said land district and
county fronting section 134, Waimea West, Block V, Waimea
Survey District. As the same are more particularly delineated
on the plan marked P.W.D. 112852, deposited in the office
of the Minister of Public Works at Wellington, and thereon
coloured red.

Domain.

General of the Dominion of New Zealand, acting by and
with the advice and consent of the Executive Council of the
said Dominion, doth hereby appoint

John McIntosh Clark,
John Atkins,

to be the Maromaku Domain Board, having control of the

appoint Friday, the ninth day of January, one thousand
nine hundred and forty-two, at half past eight o'clock p.m.,
as the time when, and the Maromaku School as the place
where, the first meeting of the Board shall be held.

to be the Kowai Pass Domain Board, having control of the
land described in the Schedule hereto; and doth hereby
appoint Monday, the twelfth day of January, one thousand
nine hundred and forty-two, at eight o'clock p.m., as the
time when, and the Tawera County Council Chambers,
Springfield, as the place where, the first meeting of the Board
shall be held.

Exempting Crown Land from the Provisions of the Mining
Act, 1926.

WHEREAS by section twenty of the Mining Act, 1926,
it is, inter alia, enacted that the Governor-General may
from time to time, by notice in the Gazette, exempt any Crown
lands from mining, or from any specified mining purpose, or
from that Act, or any specified provisions of that Act, and
that the lands to which any such notice relates shall be
specified therein by words of particular description :
And whereas it is desirable that the Crown land specified
in the Schedule hereto should be exempted from the provisions
of the Mining Act, 1926, and its amendments :
Now, therefore, I, Cyril Louis Norton Newall, the Governor-
General of the Dominion of New Zealand, in pursuance and
exercise of the powers and authorities conferred on me by
section twenty of the Mining Act, 1926, and of all other
powers and authorities in anywise enabling me in that behalf,
do hereby exempt the land particularly described in the
Schedule hereto from the provisions of the Mining Act, 1926,
and do also hereby declare that such exemption shall take
effect from the date of the publication of this notice in the
Gazette.

SCHEDULE.

ALL that area in the Westland Land District containing
1 rood 0·7 perches, more or less, being Sections 129 and 130
in the Township of Ross. As the same is delineated on the
plan marked N. 6/4/58, deposited in the Head Office of the
Mines Department, and thereon bordered red.

As witness the hand of His Excellency the Governor-
General, this 7th day of January, 1942.

PURSUANT to section sixty-five of the Cook Islands Act,
1915, and to an Order in Council made on the twentieth
day of December, one thousand nine hundred and twenty-six,
His Excellency the Governor-General doth hereby appoint

Yala Tamuta, of Ato, Pukapuka,

to be a member of the Island Council of Pukapuka during his
pleasure as from the date hereof, in lieu of Kuru (retired).
