ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 13th day
of May, 1942.

Present:

THE HON. D. G. SULLIVAN PRESIDING IN COUNCIL.

WHEREAS the Waitemata County Council is a body of
persons having power to lease lands held in trust,
reserved, or set apart for public purposes, and has requested
the Governor-General in Council to declare it to be a leasing
authority within the meaning of the Public Bodies' Leases
Act, 1908:

Now, therefore, in compliance with such request, and in
exercise of the powers in this behalf conferred by the abov-
mentioned Act, His Excellency the Governor-General, acting
by and with the advice and consent of the Executive Council,
doth hereby order and declare that the Waitemata County
Council is a leasing authority within the meaning of the Public
Bodies' Leases Act, 1908.

Authorizing the Laying-off of a Street (Extension of Ormond
Avenue) in the Borough of Napier, of a Width less than
66 ft. but not less than 40 ft., subject to a Condition as to the
Building-line.

At the Government Buildings at Wellington, this 13th day
of May, 1942.

Present:

THE HON. D. G. SULLIVAN PRESIDING IN COUNCIL.

IN pursuance and exercise of the powers vested in him by
the Municipal Corporations Act, 1933, and the Public
Works Act, 1928, and of all other powers in anywise enabling
him in this behalf, His Excellency the Governor-General of
the Dominion of New Zealand, acting by and with the advice
and consent of the Executive Council of the said Dominion,
doth hereby authorize the Napier Borough Council to permit
the laying-off of the proposed street described in the Schedule
hereto of a width less than sixty-six feet, but not less than
forty feet, subject to the condition that no building or part of
a building shall at any time be erected on the land fronting
the said street within a distance of thirty-three feet from the
centre-line of the said street.

SCHEDULE.

THAT proposed street, in the Hawke's Bay Land District,
Borough of Napier, containing by admeasurement 18Β·5
perches, more or less, being part of Suburban Section 30,
and being also Lot 2 on D.P. 6993. As the same is more par-
ticularly delineated on the plan marked P.W.D. 112502, deposited
in the office of the Minister of Public Works at Wellington,
and thereon coloured red.

The Eastern Side of Portion of Selwyn Terrace, in the Borough
of Lyttelton, exempted from the Provisions of Section 128
of the Public Works Act, 1928, subject to a Condition as
to the Building-line.

At the Government Buildings at Wellington, this 13th day
of May, 1942.

Present:

THE HON. D. G. SULLIVAN PRESIDING IN COUNCIL.

IN pursuance and exercise of the powers conferred by the
Public Works Act, 1928, and of every other power in
anywise enabling him in this behalf, His Excellency the
Governor-General of the Dominion of New Zealand, acting
by and with the advice and consent of the Executive Council
of the said Dominion, doth hereby approve of the following
resolution passed by the Lyttelton Borough Council on the
thirteenth day of April, one thousand nine hundred and
forty-two, viz. :

"The Lyttelton Borough Council, being the local
authority having control of the streets in the Borough
of Lyttelton, by resolution declares that the provisions
of section one hundred and twenty-eight of the Public
Works Act, 1928, shall not apply to the eastern side of
the portion of Selwyn Terrace adjoining that part of
Rural Section 40, being the land comprised in Certificate
of Title, 414/49 ";

subject to the condition that no building or part of a building
shall at any time be erected on the land fronting the eastern
side of the portion of Selwyn Terrace (described in the Schedule
hereto) within a distance of thirty-three feet from the centre-
line of the said portion of street.

SCHEDULE.

THE eastern side of all that portion of street situated in the
Canterbury Land District, Borough of Lyttelton, known as
Selwyn Terrace, fronting part Rural Section 40, Borough of
Lyttelton, being all the land in Certificate of Title, Volume
414, folio 49, Canterbury Registry. As the same is more
particularly delineated on the plan marked P.W.D. 114071,
deposited in the office of the Minister of Public Works at
Wellington, and thereon coloured red.

Portion of Road in the County of Waimea exempted from the
Provisions of Section 128 of the Public Works Act, 1928,
subject to a Condition as to Building-line.

At the Government Buildings at Wellington, this 13th day
of May, 1942.

Present:

THE HON. D. G. SULLIVAN PRESIDING IN COUNCIL.

IN pursuance and exercise of the powers conferred by the
Public Works Act, 1928, and of every other power in
anywise enabling him in this behalf, His Excellency the
Governor-General of the Dominion of New Zealand, acting
by and with the advice and consent of the Executive Council
of the said Dominion, doth hereby approve of the following
resolution passed by the Waimea County Council on the
tenth day of April, one thousand nine hundred and forty-
two, viz. :

"The Waimea County Council, being the local
authority having control of the roads in the County of
Waimea, by resolution declares that the provisions of
section one hundred and twenty-eight of the Public
Works Act, 1928, shall not apply to the portion of public
road passing through Section 20, Square 44, Block XIII,
Waimea Survey District, and contained in Certificate
of Title, Volume 69, folio 264 ";

subject to the condition that no building or part of a building
shall at any time be erected on the land fronting the portion
of road (described in the Schedule hereto) within a distance of
thirty-three feet from the centre-line of the said portion of
road.

SCHEDULE.

ALL that portion of road situated in the Nelson Land District,
County of Waimea, passing through Section 20, Square 44,
Block XIII, Waimea Survey District. As the same is more
particularly delineated on the plan marked P.W.D. 114059,
deposited in the office of the Minister of Public Works at
Wellington, and thereon coloured red.

Domain Board appointed to have Control of the Cust Domain.

At the Government House at Wellington, this 20th day of
May, 1942.

Present:

His Excellency the GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred by
section forty-four of the Public Reserves, Domains, and
National Parks Act, 1928, His Excellency the Governor-
General of the Dominion of New Zealand, acting by and with
the advice and consent of the Executive Council of the said
Dominion, doth hereby appoint

George Cowens,
Charles Henry Talbott,
Benjamin Croft,
Henry Heinisch,
Clifton George Wallond Briggs,
James Brackenridge Struthers, and
Samuel Smith

to be the Cust Domain Board, having control of the land
described in the Schedule hereto; and doth hereby appoint
Saturday, the first day of August, one thousand nine hundred
and forty-two, at half past seven o'clock p.m., as the time
when, and the Club room, Cust, as the place where, the first
meeting of the Board shall be held.
