said aerodrome nearest that portion of the said land upon
which any building, pole, mast, or other structure is proposed
to be erected, placed, or constructed, or upon which any tree
or shrub is proposed to be grown or is allowed to grow
increased by one-fortieth part of the distance measured on a
horizontal plane between the said boundary and the said
portion of the said land.
SCHEDULE.
ALL that piece of land containing approximately 44 acres
2 roods 32 perches, situated in the North Auckland Land
District, being part Lot 2, D.P. 24416, being part Allotment
59, Waipareira Parish, Block X, Waitemata Survey District,
comprised and described in Certificate of Title, Vol. 105,
folio 37, Auckland Registry, such land being shown by a green
border on the plan marked P.W.D. 111264, deposited in the
office of the Minister of Public Works at Wellington.

Notice of Intention to take Land in Block VI, Te Mata Survey
District, for a Road.
NOTICE is hereby given that it is proposed, under the
provisions of the Public Works Act, 1928, to execute
a certain public work—to wit, the construction of a road—
and for the purposes of such public work the land described
in the Schedule hereto is required to be taken: And notice
is hereby further given that the plan of the land so required
to be taken is deposited in the post-office at Opapa and is
there open for inspection; and that all persons affected by
the execution of the said public work or by the taking of
the said land should, if they have any well-grounded objections
to the execution of the said public work or to the taking
of such land, set forth the same in writing, and send such
writing, within forty days from the first publication of this
notice, to the Minister of Public Works at Wellington.
SCHEDULE.
APPROXIMATE area of the piece of land required to be taken:
12·4 perches.
Being part Kahumoko D 11 Block.
Situated in Block VI, Te Mata Survey District (S.O. 2053,
red.)
In the Hawke’s Bay Land District; as the same is more
particularly delineated on the plan marked P.W.D. 113628,
deposited in the office of the Minister of Public Works at
Wellington, and thereon coloured blue.

Agreement for Grant of Easement in favour of the Public Trustee
of the Dominion of New Zealand over Land in Block V, Te
Atiamuri Survey District, assented to.
WHEREAS by a Proclamation dated the 22nd day of
August, 1939, and published in the New Zealand
Gazette No. 65 of 24th August, 1939, at page 2211, all those
pieces of land containing 29 acres 0 roods 16·3 perches, 2 acres
3 roods 4·6 perches, and 27 perches, being portion of Whakamaru–Maungaiti E Block, situated in Block V, Te Atiamuri
Survey District, were taken for the purposes of a quarry:
And whereas the Public Trustee of the Dominion of New
Zealand was entitled to compensation for his freehold interest
in the said areas of 29 acres 0 roods 16·3 perches, 2 acres
3 roods 4·6 perches, and 27 perches:
And whereas the Minister of Public Works has agreed to
grant to the said Public Trustee of the Dominion of New
Zealand, his successors in office and assigns an easement of
right-of-way over the aforesaid areas of 29 acres 0 roods 16·3
perches and 2 acres 3 roods 4·6 perches and 27 perches in
part satisfaction of the compensation aforesaid, and to
provide a sum of money in satisfaction of the residue of the
said compensation:
And whereas the said Public Trustee of the Dominion of
New Zealand has agreed to accept such grant of easement
and sum of money in satisfaction of the said compensation:
Now, therefore, I, Hubert Thomas Armstrong, the Minister
of Public Works, do hereby give notice, in pursuance of
section 97 of the Public Works Act, 1928, and I assent to the
agreement hereinbefore referred to.

of Essential Undertaking (No. 53).

Regulation 9 of the National Service Emergency Regulations 1940, the Minister of National Service doth hereby
declare the undertaking set forth hereunder to be an essential
undertaking for the purposes of these regulations:—

National Service Emergency Regulations 1940.—Declaration
of Essential Undertaking (No. 67).
IN pursuance of the powers conferred upon him by
Regulation 9 of the National Service Emergency
Regulations 1940, the Minister of National Service doth hereby
declare the undertaking of the Department of Scientific
and Industrial Research, in respect only of the Physical
Testing Laboratory, the Dominion Laboratory, the Radio
Development Laboratory, the Engineering and Physical
Testing Laboratory, and of those employees of the Department engaged full time on defence works under the direction
of the Director of Scientific Developments, to be an essential
undertaking for the purposes of those regulations.
