Revoking the Declaration of a Main Highway and Declaring
a Public Highway to be a Main Highway.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 22nd day
of April, 1942.

Present:

THE RIGHT HON. P. FRASER PRESIDING IN COUNCIL.

IN pursuance and exercise of the powers and authorities
vested in him by section three of the Main Highways
Act, 1922, and of all other powers in anyway enabling him in
this behalf, His Excellency the Governor-General of the
Dominion of New Zealand, acting by and with the advice and
consent of the Executive Council of the said Dominion, doth
hereby declare that on and after the date of publication of
this Order in Council in the Gazette, the portion of main
highway described in the First Schedule hereto shall cease to
be a main highway, and doth further declare that the road
described in the Second Schedule hereto shall be a main
highway within the meaning and for the purpose of the Main
Highways Act, 1922.

FIRST SCHEDULE.

HIGHWAY DISTRICT No. 1.

Whangarei-Awanui via Kawakawa.—All that portion of
the Whangarei-Awanui via Kawakawa Main Highway in the
Bay of Islands County, commencing opposite a point on the
northern boundary of Lot 2, Block XV, Kawakawa Survey
District, and proceeding thence generally in a westerly
direction and terminating at a point approximately 10 chains
west of the boundary between Te Hautapu and Honohere
Blocks in Block XIV, Kawakawa Survey District, being a
distance of 1 mile 55 chains, more or less; as the same is
more particularly delineated on plan P.W.D. 113921, deposited
in the office of the Main Highways Board at Wellington, and
thereon coloured yellow.

SECOND SCHEDULE.

HIGHWAY DISTRICT No. 1.

Whangarei-Awanui via Kawakawa.—All that portion of
the Whangarei-Awanui via Kawakawa Main Highway in the
Bay of Islands County, commencing opposite a point on the
northern boundary of Lot 2, Block XV, Kawakawa Survey
District, and proceeding thence generally in a westerly
direction and terminating at a point approximately 10 chains
west of the boundary between Te Hautapu and Honohere
Blocks in Block XIV, Kawakawa Survey District, being a
distance of 1 mile 25 chains, more or less; as the same is
more particularly delineated on plan P.W.D. 113921, deposited
in the office of the Main Highways Board at Wellington, and
thereon coloured green.

Officer authorized to take and receive Statutory Declarations.

PURSUANT to the authority conferred upon me by the
three-hundred-and-first section of the Justices of the
Peace Act, 1927, I, Cyril Louis Norton Newall, the Governor-
General of the Dominion of New Zealand, do hereby notify
and declare that Gessenox Alfred Hislop, Esquire, being an
officer in the service of the Crown holding the office of Acting
Registrar of Births, Deaths, and Marriages at Wellington, is
authorized to take and receive statutory declarations under
the three-hundred-and-first section of the Justices of the
Peace Act, 1927.

As witness the hand of His Excellency the Governor-
General, this 28th day of April, 1942.

Authorizing the Clifton County Council to sell Timber upon
Portion of a certain County Road in the Clifton County.

IN pursuance and exercise of the power and authority
vested in me by section one hundred and forty of the
Public Works Act, 1928, I, Cyril Louis Norton Newall, the
Governor-General of the Dominion of New Zealand, do hereby
authorize the Clifton County Council to sell or contract to
sell and remove timber upon portion of a certain county road
adjoining the southern boundary of Sections 3, 4, 5, and 6,
Block XI, Upper Waitara Survey District. As the same is
more particularly delineated on the plan marked P.W.D.
113845, deposited in the office of the Minister of Public Works
at Wellington, and thereon coloured red.

As witness the hand of His Excellency the Governor-
General, this 29th day of April, 1942.

Lands permanently reserved in the Wellington and Southland
Land Districts.

WHEREAS by the three-hundred and fifty-ninth section
of the Land Act, 1924, it is enacted that the Governor-
General may from time to time set apart temporarily as
reserves, notwithstanding that the same may be then held
under pastoral license, any Crown lands which in his opinion
are required for any of the purposes in the said section
mentioned:

And whereas by the three-hundred-and-sixtieth section of
the said Act it is provided that land temporarily reserved
under the said three-hundred-and-fifty-ninth section may, at
the expiration of one month, but not later than six months,
after the publication in the Gazette of notice of such temporary
reservation, be permanently reserved, and that notice of such
permanent reservation shall be published in the Gazette:

And whereas the lands described in the Schedule hereto
were, by the Warrant dated the ninth day of February,
one thousand nine hundred and forty-two, and published
in the Gazette of the twelfth day of that month, temporarily
reserved under the authority of the said Act for the purposes
in the Schedule of the said Warrant specified at the end
of the respective descriptions of the lands so intended to be
temporarily reserved;

Now, therefore, I, Cyril Louis Norton Newall, the Governor-
General of the Dominion of New Zealand, in pursuance and
exercise of the powers and authorities conferred upon me by
the said Act, do hereby permanently reserve the lands
described in the Schedule hereto for the purposes in the
said Schedule specified at the end of the respective descriptions
of the lands so intended to be permanently reserved for
which purposes the said lands were so temporarily reserved
as aforesaid.

SCHEDULE.

WELLINGTON LAND DISTRICT.

ALL that area in City of Wellington containing by admeasure-
ment 3 acres 2 roods 20.46 perches, more or less, being
Section 434 and parts of Sections 432, 433, and 435, Town
of Wellington: Bounded, commencing at the northernmost
corner of Lot 1 on D.P. 2438, along the north-eastern
boundaries of Lots 1, 2, 3, and 4 on D.P. 2438, Lot 4, part
Lot 5, and part Lot 2 on D.P. 4938, all being portions of
Section 431, Town of Wellington, for a total distance of
419.67 links; thence along right lines bearing 23° 51' distance
133.22 links, bearing 340° 16' 20" distance 77.62 links, bearing
43° 01' 40" distance 203.42 links, bearing 180° 23' 20" distance
63.24 links, bearing 190° 34' 20" distance 88.24 links, bearing
184° 04' 50" distance 38.79 links, and bearing 112° 59' distance
5.31 links to the north-western side of The Terrace; thence
along the north-western side of The Terrace for a distance of
401.22 links, 12.12 links, and 189.78 links to the southernmost
corner of part Section 435 described in section 4, subsection (1)
of Wellington City Empowering Act, 1931; thence along
the south-western boundary of part Section 435 aforesaid
to the south-eastern boundary of part Town Belt shown in
D.P. 10182; and thence along the south-eastern boundary of
part Town Belt, bearing 202° 56' 40" distance 790.55 links, to
the point of commencement: be all the aforesaid admeasure-
ments a little more or less. As the same is more particularly
delineated on a plan marked L. and S. 6/6/757A, deposited
in the Head Office, Department of Lands and Survey, at
Wellington, and thereon bordered red. (S.O. plan 20794.)

SOUTHLAND LAND DISTRICT.

ALL that area containing by admeasurement 24.7 perches,
more or less, being part Section 29, Block I, Invercargill
Hundred, and bounded as follows: Commencing at the
north-west corner of Lot 20, D.P. 1244, Block I, Township
of Wellesley; thence in a south-easterly direction along the
south-western boundary of the said Lot 20 and Hawke
Street, 333.8 links; thence in a north-westerly direction
along a railway reserve, 74.19 links and 283.8 links, to the
south-western end of Philip Street; thence in a south-
easterly direction along the southern end of the said Philip
Street, 50.23 links, to the point of commencement: be all
the aforesaid linkages a little more or less. As the same is
more particularly delineated on the plan marked L. and S.
22/2695A, deposited in the Head Office, Department of
Lands and Survey, at Wellington, and thereon coloured blue.
(Drainage purposes.)

As witness the hand of His Excellency the Governor-
General, this 30th day of April, 1942.
