Vesting the Control of a Scenic Reserve in the Everett Road Scenic Board.

IN pursuance and exercise of the powers and authorities conferred upon him by section thirteen of the Scenery Preservation Act, 1908, His Excellency the Governor-General of the Dominion of New Zealand doth hereby vest the control of the reserve described in the Schedule below (being land reserved under the said Act), for the period of five years from the date hereof (unless previously altered or revoked under the said Act) in the undermentioned persons, namely :—
Elmer Clive Cooper,
John Alexander Ross,
Frederick Bracegirdle,
John Robson Gray Sutherland,
The Commissioner of Crown Lands for the Taranaki Land District (ex officio),
The Chairman of the Inglewood County Council (ex officio), and
The Mayor of the Borough of Inglewood (ex officio),
who are hereby constituted for that purpose a special Board by the name of the Everett Road Scenic Reserve Board (herein referred to as “the Board”), in trust, for the preservation of scenery, and with the powers and subject to the conditions hereinafter contained, that is to say :—

The first meeting of the Board shall be held in the Borough Council Chambers, Rata Street, Inglewood, at half-past two o’clock p.m. on Wednesday, the twenty-second day of April, one thousand nine hundred and forty-two, and thereafter the Board shall meet for the transaction of business on the first Wednesday in the months of June and December in each year at eight o’clock p.m., or at such other time or place as may from time to time be fixed by the Board.

The members of the Board shall at their first meeting, and thereafter at the annual meeting hereinafter mentioned, elect one of themselves to be Chairman, who may join in the discussion, and shall have an original as well as a casting vote. The chairman shall hold office until the election of his successor.

Special meetings may be convened by the Chairman, provided that two days’ notice of such meeting is given to each member, specifying the business to be transacted at such special meeting; and no other business than that so specified shall be transacted at such meeting.

Any four members of the Board shall form a quorum. Any meeting may be adjourned from time to time.

All questions shall be determined by the majority of votes of the members of the Board present at a meeting.

If at any meeting the Chairman is not present at the time appointed for holding the same, the members present shall choose one of their number to be Chairman of such meeting.

(a) The Board may make such rules as it deems necessary :—
(i) Governing trading within the reserve; and
(ii) Controlling or limiting the taking of collections within the reserve for any objects other than the improvement of the reserve.
(b) The Board may, with the approval of the Minister in Charge of Scenery Preservation, make such rules as it deems necessary for the good conduct of the public frequenting the reserves, and may set apart areas for camping-grounds or other purposes, and may fix reasonable charges for the use thereof in accordance with a scale to be approved from time to time by the Minister.

If, by resignation, death, incapacity, or otherwise, the seat of any member shall be or become vacant, or if any member absents himself, without reasonable cause, from three consecutive meetings of the Board, the Governor-General shall have power to appoint any other person to be a member of the Board in his stead.

The Board shall prepare and submit at an annual meeting to be held in the month of April in each year a report of the proceedings of the Board for the previous year ending on the thirty-first day of March, together with a statement of the receipts and expenditure of the Board for such year. A copy of every such report and statement, certified by the Chairman to be correct, shall be sent to the Minister in Charge of Scenery Preservation as soon as possible after each annual meeting.

The Board shall control the said reserve in accordance with the provisions of the said Act and of the regulations made thereunder.

EVERETT ROAD SCENIC RESERVE.—TARANAKI LAND DISTRICT.
SECTIONS 13, 18, and 19, Block XIII, Waitara Survey District: Area, 166 acres, more or less.
As witness the hand of His Excellency the Governor-General, this 18th day of April, 1942.

Revoking the Vesting of the Control of a Scenic Reserve in the Everett Road Scenic Reserve Board.

WHEREAS in pursuance of section thirteen of the Scenery Preservation Act, 1908, the control of the scenic reserve described in the Schedule hereto was vested in the Everett Road Scenic Reserve Board for a term of five years by a Warrant dated the twenty-fourth day of May, one thousand nine hundred and forty-one, and published in Gazette of the twenty-ninth day of that month:
And whereas it is expedient that the said Warrant should be revoked:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred upon him by the Scenery Preservation Act, 1908, doth hereby revoke the Warrant hereinbefore referred to.
