BOUNDARIES OF THE PETANE RIDING OF THE COUNTY OF HAWKE’S BAY.

ALL that area in the Hawke’s Bay County commencing at a point in the middle of the Mohaka River in line with the eastern boundary of Block 106 (E.R.), Patoka Crown Grant District; thence easterly along the middle of the Mohaka River to its crossing by the Rotorua–Napier Main Highway; thence south-easterly, to and along the Rotorua–Napier Main Highway, to and along the old Taupo–Napier Road forming part of the southern boundary of Section 4a, Block IX, Maungaharuru Survey District; thence again along the Rotorua–Napier Main Highway, to and along the old Napier–Taupo Road forming part of the western boundary of Lot 1 on D.P. 3831; thence again along the Rotorua–Napier Main Highway to its junction with the old Napier–Taupo Road; thence along that road across the Esk River, to and along the southern boundaries of Sections 1 and 4, Block III, the western boundaries of Section 11, Block IV, Sections 11, 13, 6, 7, Block VIII, and the southern boundaries of Sections 7, 9, 8, Block VIII, all in the Puketapu Survey District; thence along the southern boundary of the Pakuratahi Block to the mean high-water mark of the ocean; thence southerly along a line bearing 79° 00′ from the southern corner of a formed road through Section 8, Block XVI, Puketapu Survey District, which corner is distant from road peg IX on the western side of the Napier–Gisborne Main Highway by lines bearing 345° 48′ distance 150·9, bearing 355° 35′ distance 717·1, and bearing 352° 27′ distance 42·7; thence following a bearing of 259° 00′ across a railway reserve to the eastern side of the Napier–Gisborne Main Highway; thence southerly along the eastern side of the Napier–Gisborne Main Highway to the southernmost corner of Lot 1 on D.P. 2531; thence by a right line across the Meeanee Quay to the northernmost corner of Lot 2 on D.P. 6408; thence along the eastern side of the Napier–Gisborne Main Highway to its intersection with the southern boundary of the said Lot 2 on the said D.P. 6408; thence easterly along the southern boundary of Lot 2 on the aforesaid D.P. 6408 to Meeanee Quay; thence south-westerly along the south-western side of Meeanee Quay, the western side of a native reserve to the southernmost corner of Lot 5 on Deeds Plan 211 (part old Survey Reserves); thence north-westerly by a right line to the westernmost corner of Lot 1 on D.P. 6408; thence by a right line to the south-western corner of Suburban Section 30, western side of harbour; thence generally southerly along the western boundary of Lot 1 on D.P. 6211 to the north-eastern corner of the Wharerangi Block; thence westerly along the northern boundary of the Wharerangi Block to the easternmost corner of Block 75, Puketapu Crown Grant District; thence generally northerly along the eastern boundaries of Block 75 and part Block 90, Puketapu Crown Grant District, the land on D.P. 1698 comprised in Certificate of Title, Volume 99, folio 246, Hawke’s Bay Registry, Lot 1 on D.P. 6541, and the southern and eastern boundaries of Block 90, Puketapu Crown Grant District, to the northernmost corner of the last-mentioned block; thence westerly along the northern boundaries of the said Block 90 and Lot 1 on D.P. 6541, the eastern and northern boundaries of Block 91, Puketapu Crown Grant District, the northern boundaries of part Block 90 and Block 71, Puketapu Crown Grant District, and along the northern boundary of the land on D.P. 1162 comprised in Volume 34, folio 159, Hawke’s Bay Registry, to the Mangaone River; thence up the Mangaone River to the southern boundary of Pohui Bush Rural Section 105; thence generally westerly along the southern and western boundaries of the said Section 105, the eastern, western, and northern boundaries of Pohui Bush Rural Section 102, the western boundary of Pohui Bush Rural Section 134, the northern boundaries of Pohui Bush Rural Sections 132, 137, and along the northern boundary of Block 116, Patoka Crown Grant District, to the eastern boundary of Block 96, Patoka Crown Grant District; thence along the eastern and northern boundaries of the said Block 96, the eastern boundary of Block 95, Patoka Crown Grant District, to the south-eastern corner of Block 122, Patoka Crown Grant District; thence northerly along the eastern boundary of the said Block 122, the southern and eastern boundaries of Block 100 (E.R.), Patoka Crown Grant District, and its production, to the point of commencement.

Amending Notice under Regulation 4 of the Import Certificates Emergency Regulations 1939.

Wellington, 1st April, 1942.

PURSUANT to Regulation 4 of the Import Certificates Emergency Regulations 1939, I hereby give notice as follows:—

The notification under the said regulations bearing date the 14th day of May, 1941, and published in the Gazette on the 15th day of May, 1941, at page 1343, is hereby modified by adding at the end of clause 2 thereof the words “or from Liberia or Turkey.”

The Manawatu Gorge Road Stock Traffic By-laws, 1942.

WHEREAS by section 9 of the Main Highways Act, 1922 (hereinafter called “the said Act”), the powers, rights, duties, and liabilities vested in or imposed on the Governor-General or Minister of Public Works (in the case of Government roads), or vested in or imposed on any local authority (in the case of highways other than Government roads) are, in the case of main highways, transferred to and vested in or imposed on the Main Highways Board (hereinafter called “the said Board”);

And whereas the road hereinafter referred to is a main highway, and it is desirable that by-laws should be made in respect thereof:

Now, therefore, the said Board, acting by authority of the said Act, and of the Public Works Act, 1928, and of all other powers in anywise enabling it in this behalf, doth hereby make the following by-laws.

BY-LAWS.

I. INTERPRETATION.

(1) These by-laws may be cited as the “Manawatu Gorge Road Stock Traffic By-laws, 1942.”

(2) These by-laws shall come into force on the 8th day of April, 1942.

(3) These by-laws shall apply to the Napier–Palmerston North State Highway between the Upper Gorge Bridge over the Manawatu River and the Fitzherbert East Road junction, this section being more particularly delineated on plan P.W.D. 113790, deposited in the office of the Main Highways Board at Wellington, marked A–B thereon, and coloured yellow. An alternative route is available via the Woodville–Ashhurst Main Highway.

(4) In these by-laws, unless inconsistent with the context,—
“Engineer” means the Engineer of the Public Works Department for the time being a member of the No. 9 and No. 10 District Highways Councils:
“Authorized person” means and includes “Engineer” as hereinbefore defined, and any Traffic Inspector and overseer in charge of any portion of the said highway to which these by-laws apply:
“Cattle” includes any bull, cow, ox, steer, heifer, or calf:
“Sheep” includes any ram, ewe, wether, or lamb.
“The said highway” means the road described in sub-clause (3) of this clause.

  1. PROHIBITION OF STOCK TRAFFIC.

(1) No person shall drive, or cause to be driven, or allow any horse, ass, mule, goat, sheep, ox, or other cattle not in harness or yoke upon or along the said highway except with the prior permission in writing of the Main Highways Board or a Transport Department Inspector, and then only in all respects with any condition imposed in granting such permission.

(2) If any person is charged with an offence under sub-clause (1) of this clause it shall be a sufficient defence to the charges if such person proves that the cattle or sheep in question were being driven to or from some property having a frontage on or entrance from the said highway and to which no other reasonable route was available.

  1. ASCERTAINMENT OF OFFENDERS.

(1) Any authorized person or police officer may require any person driving, or causing or permitting to be driven, or allowing cattle along or upon the said highway, to supply on demand information as to his name and address and the name and address of the owner of the cattle, together with particulars relating to the place from which the cattle were driven, their intended destination, the route by which they travelled, and any other information which may be required by such authorized person or police officer in the exercise of his duties.

(2) If any person driving, or causing or permitting to be driven, or allowing cattle along or upon the said highway, shall refuse to give any of the information required to be given by him in pursuance of these by-laws, or shall give false information, or shall withhold information so as to create a false impression, he shall be guilty of an offence.
