Price Order No. 69.

IN pursuance of the powers conferred upon the Price Tribunal by the Control of Prices Emergency Regulations 1939, and with the authority of the Minister of Industries and Commerce, the Price Tribunal hereby makes the following Price Order:—

(1) This Order may be cited as Price Order No. 69.

(2) This Order shall apply only to the Auckland Metropolitan Area comprising the City of Auckland and the Boroughs of Birkenhead, Northcote, Takapuna, Devonport, New Lynn, Newmarket, Mount Eden, Mount Albert, Onehunga, One Tree Hill, Otahuhu, and Ellerslie, and to the Wellington Metropolitan Area comprising the Cities of Wellington and Lower Hutt, the Boroughs of Petone and Upper Hutt, and the Johnsonville Town District.

(3) The maximum price which may be charged for an unreconditioned second-hand apple fruit-case of standard bushel size shall be not more than as follows:—

When the case has been opened the wide way (where side cleats are): 4d. per case.

When the case has been opened the narrow way: 3d. per case.

The Second-hand Fruit-case Control Notice, 1942.

NOTICE is hereby given that in pursuance of the Supply Control Emergency Regulations 1939, and the Timber Emergency Regulations 1939, I, Alexander Robert Entrican, Timber Controller, hereby require and direct as follows:—

  1. This notice may be cited as the Second-hand Fruit-case Control Notice, 1942.

  2. This notice shall come into force on the day following publication thereof in the Gazette,

  3. In this notice, unless the context otherwise requires:—

“Used fruit-case” means a standard bushel fruit-case of either of the types of package numbered 1 or 2 in the First Schedule to the New-Zealand-grown Fruit Regulations 1940, which has been used as a container for apples or pears:

“Vendor” means a person whose business includes the sale by wholesale or by retail of fruit.

  1. Except with the precedent consent of a District Manager of the Internal Marketing Division of the Marketing Department (as delegate of the Timber Controller), no vendor carrying on business in any city, borough, or town district referred to in the Schedule hereto, shall sell, or offer for sale or contract to sell, or otherwise dispose of any used fruit-case to any person other than—

(a) A person who is the occupier of an orchard registered under the Orchard Registration Regulations 1937; or

(b) The New Zealand Fruitgrowers’ Federation, Limited; or

(c) A duly incorporated Association of Fruitgrowers; or

(d) A person carrying on the business of fruit-packing or of reconditioning fruit-cases.

  1. Except with the precedent consent of a District Manager of the Internal Marketing Division of the Marketing Department (as delegate of the Timber Controller), no person other than a person referred to in paragraphs (a), (b), (c), or (d) of the last preceding clause hereof shall, in any city, borough, or town district referred to in the Schedule hereto, purchase or offer to purchase or contract to purchase or otherwise acquire from any vendor any used fruit-case.

  2. Except with the precedent consent of a District Manager of the Internal Marketing Division of the Marketing Department (as delegate of the Timber Controller), no person referred to in paragraphs (a),
