resolution passed by the New Plymouth Borough Council on the second day of September, one thousand nine hundred and forty, viz.:

“That the New Plymouth Borough Council, being the local authority having control of the streets hereinafter mentioned, hereby resolves and declares that the provisions of section one hundred and twenty-eight, subsection one, of the Public Works Act, 1928, shall not apply—

“(a) To that portion of the southern side of Pendarves Street to which Sections 1037 and 1038, New Plymouth, respectively, have frontages; nor

“(b) To that portion of the western side of Gover Street to which Section 1038, New Plymouth, has frontage”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the southern side of the portion of Pendarves Street or the western side of the portion of Gover Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-lines of the said portions of streets.


SCHEDULE.

THE southern side of all that portion of street situated in the Taranaki Land District, Borough of New Plymouth, known as Pendarves Street, fronting Sections 1037 and 1038, Town of New Plymouth.

Also the western side of all that portion of street in the said land district and borough known as Gover Street, fronting Section 1038, Town of New Plymouth.

As the same are more particularly delineated on the plan marked P.W.D. 115828, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured lemon.

The South-eastern Side of Portion of Crichton Terrace, in the County of Heathcote, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

At the Government House at Wellington, this 16th day of December, 1942.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Heathcote County Council on the twenty-third day of October, one thousand nine hundred and forty-two, viz.:

“That the Heathcote County Council, being the local authority having control of the roads in the County of Heathcote, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the south-eastern side of the portion of Crichton Terrace, adjoining C.T. 305/240, being part of Lot 5, D.P. 1358, part R.S. 551, Block XV, Christchurch Survey District, and as coloured red on the plan”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the south-eastern side of the portion of Crichton Terrace (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of road.


SCHEDULE.

THE south-eastern side of all that portion of road situated in the Canterbury Land District, County of Heathcote, known as Crichton Terrace, fronting part Lot 5, D.P. 1358, part Rural Section 551, Block XV, Christchurch Survey District. As the same is more particularly delineated on the plan marked P.W.D. 115806, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of every other power in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Dunedin City Council on the ninth day of November, one thousand nine hundred and forty-two, viz.:

“That the Dunedin City Council, being the local authority having control of the streets in the City of Dunedin, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the southern side of the portion of Hawthorn Avenue adjoining subdivision of part of Lot 3, D.P. 228, being part of Section 79, Block VI, Town District, such land being comprised and described in Certificate of Title 238/36 ”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the southern side of portion of Hawthorn Avenue (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.


SCHEDULE.

THE southern side of all that portion of street situated in the Otago Land District, City of Dunedin, known as Hawthorn Avenue, fronting part Lot 3, D.P. 228, City of Dunedin, being part Section 79, Block VI, Town District. As the same is more particularly delineated on the plan marked P.W.D. 115880, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

“The Clutha County Council, being the local authority having control of the roads in the County of Clutha, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the eastern side of the portion of road adjoining Sections 13, 14, 15, and 16, Block Three (III), Greenvale Survey District, being the land comprised and described in Certificate of Title, Register-book, Volume 104, folio 192, and to the western side of the portion of road adjoining Sections Ten (10), Eleven (11), Twelve (12), and Seventeen (17), of the said Block Three (III) of the said Greenvale Survey District, being the land comprised and described in Certificate of Title, Register-book, Volume 106, folio 257 ”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the sides of the said portions of unnamed roads (described in the Schedule hereto) within a distance of thirty-three feet from the centre-lines of the said portions of roads.


SCHEDULE.

THE eastern side of all that portion of unnamed road situated in the Otago Land District, County of Clutha, adjoining Sections 13, 14, 15, and 16, Block III, Greenvale Survey District.

Also the western side of all that portion of unnamed road in the said land district and county adjoining Sections 10, 11, and 12, Block III, Greenvale Survey District.

As the same are more particularly delineated on the plan marked P.W.D. 115344, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.
