section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the undermentioned portions of streets, viz.:

“ (a) The north-western side of the portion of Macandrew Road adjoining subdivision of part Lot 1 and Lot 2, Block VIII, D.P. 8, Township of Forbury;

“ (b) The south-western side of the portion of Reid Road adjoining part Lot 1, Block VIII, D.P. 8, Township of Forbury, such land being comprised and described in Certificates of Title 58/51 and 153/17 ”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the north-western side of the portion of Macandrew Road or the south-western side of the portion of Reid Road (described in the Schedule hereto) within a distance of thirty-three feet from the centre-lines of the said portions of streets.

SCHEDULE.

THE north-western side of all that portion of street situated in the Otago Land District, City of Dunedin, known as Macandrew Road, fronting part Lot 1 and Lot 2, Block VIII, D.P. 8, Township of Forbury, Block VII, Town District.

Also the south-western side of all that portion of street situated in the said land district and city known as Reid Road, fronting part Lot 1, Block VIII, D.P. 8, Township of Forbury, Block VII, Town District.

As the same are more particularly delineated on the plan marked P.W.D. 115501, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

The North-western Side of Portion of Beach Road, in the Onerahi Town District, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

At the Government House at Wellington, this 16th day of December, 1942.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of every other power in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Onerahi Town Board on the tenth day of August, one thousand nine hundred and forty-two, viz.:

“ That the Onerahi Town Board, being the local authority having control of the roads in the Onerahi Town District, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the north-western side of the portion of Beach Road adjoining Allotment part 111, Town of Grahamtown ”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the north-western side of the portion of Beach Road (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of road.

SCHEDULE.

THE north-western side of all that portion of road situated in the North Auckland Land District, Onerahi Town District, known as Beach Road, adjoining part Allotment 111, Township of Grahamtown, Block XIII, Whangarei Survey District. As the same is more particularly delineated on the plan marked P.W.D. 115435, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

The Western Side of Portion of Eskvale Street, in the Borough of St. Kilda, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

At the Government House at Wellington, this 16th day of December, 1942.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of every other power in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the St. Kilda Borough Council on the third day of August, one thousand nine hundred and forty-two, in so far as it affects the side and portion of street described in the Schedule hereto:—

“ That the St. Kilda Borough Council, being the local authority having control of the streets in the Borough of St. Kilda, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that portion of street known as Eskvale Street fronting Lot 22, Block II, D.P. 68, Township of Musselburgh, being part of Section 67, Block VII, Town District ”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the western side of the portion of Eskvale Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.

THE western side of all that portion of street situated in the Otago Land District, Borough of St. Kilda, known as Eskvale Street, fronting Lot 22, Block II, D.P. 68, Township of Musselburgh, being also part Section 67, Block VII, Town District. “ The Lyttelton Borough Council, being the local authority having control of the streets in the Borough of Lyttelton, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the western side of the portion of College Road adjoining Certificate of Title 364/11 (part R.S. 1) ”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the western side of the portion of College Road (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.

SCHEDULE.

THE western side of all that portion of street situated in the Canterbury Land District, Borough of Lyttelton, known as College Road, fronting part Rural Section 1, Borough of Lyttelton, shown as Lots 1 and 2 on a plan lodged for checking and deposit as No. 12236, Canterbury Registry. As the same is more particularly delineated on the plan marked P.W.D. 115667, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.
