The North-eastern Side of Portion of Wardlaw Street, in the City of Dunedin, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.

At the Government House at Wellington, this 28th day of January, 1942.

Present:

His Excellency the Governor-General in Council.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of every other power in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Dunedin City Council on the twenty-fourth day of November, one thousand nine hundred and forty-one, viz.:

“That the Dunedin City Council, being the local authority having control of the streets in the City of Dunedin, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the north-eastern side of the portion of Wardlaw Street adjoining Lot 3, D.P. 5379, being part Section 72, Block VII, Town District, such land being comprised and described in Certificate of Title, Register-book Volume 300, folio 39”; subject to the condition that no building or part of a building shall at any time be erected on the land fronting the north-eastern side of the portion of Wardlaw Street (described i. the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.

SCHEDULE.

The north-eastern side of all that portion of street situated in the Otago Land District, City of Dunedin, known as Wardlaw Street, fronting Lot 3, D.P. 5379, being part Section 72, Block VII, Town District. As the same is more particularly delineated on the plan marked P.W.D. 112987, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

“The Main Highways Board, being the authority having control of the Nelson-Westport Main Highway, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the north-western portion of the said main highway adjoining the south-eastern boundary of subdivision of Section 103, and part Section 102, Square 5, Block IV, Tadmor Survey District”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the north-western side of the portion of the Nelson-Westport Main Highway (described in the Schedule hereto) within a distance of thirty-five feet from the centre-line of the said portion of road.

SCHEDULE.

The north-western side of all that portion of the Nelson-Westport Main Highway, situated in the Nelson Land District, County of Waimca, fronting part Section 102, Square 5, Block IV, Tadmor Survey District. As the same is more particularly delineated on the plan marked P.W.D. 113054, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

The Northern, Eastern, and Southern Sides of Portions of Unnamed Roads, in the County of Waimca, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

At the Government House at Wellington, this 28th day of January, 1942.

His Excellency the Governor-General in Council.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of every other power in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Waimca County Council on the fourteenth day of November, one thousand nine hundred and forty-one, viz.:

“The Waimca County Council, being the local authority having control of the roads in the County of Waimca, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the northern portion of public road fronting the southern boundary, the eastern portion of public road fronting the western boundary, and the southern portion of public road fronting the northern boundary of subdivision of Section 103, and part Section 102, Square 5, Block IV, Tadmor Survey District, and contained in Certificate of Title, Volume 72, folio 106”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the northern, eastern, and southern sides of the portions of unnamed roads (described in the Schedule hereto) within a distance of thirty-five feet from the centre-lines of the said portions of roads.

SCHEDULE.

The northern side of all that portion of an unnamed road situated in the Nelson Land District, County of Waimca, fronting Section 103 and part Section 102, Square 5, Block IV, Tadmor Survey District; also the eastern side of all that portion of an unnamed road situated in the said land district and county fronting Section 103, Square 5, Block IV, Tadmor Survey District; also the southern portion of an unnamed road situated in the said land district and county, fronting Section 103, and part Section 102, Square 5, Block IV, Tadmor Survey District. As the same are more particularly delineated on the plan marked P.W.D. 113054, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

Regulations under the Naval Defence Act, 1913, amended.

IN pursuance and exercise of the powers and authorities conferred on him by section twenty-five of the Naval Defence Act, 1913, and of all other powers and authorities enabling him in that behalf, His Excellency the Governor-General, with the advice of the Executive Council, doth hereby amend and supplement the regulations referred to in the Schedule hereto as shown therein.
