The North-eastern Side of Portion of Lynn Street, in the City of Dunedin, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.

At the Government House at Wellington, this 18th day of November, 1942.

Present:

HIS EXCELLENCE THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of every other power in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Dunedin City Council on the twenty-eighth day of September, one thousand nine hundred and forty-two, viz. :-

"That the Dunedin City Council, being the local authority having control of the streets in the City of Dunedin, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the north-eastern side of the portion of Lynn Street adjoining Allotment 8A, D.P. 157, Township of St. Leonard's on the Hill, such land being comprised and described in Certificates of Title 149/155 and 158/124";

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the north-eastern side of the portion of Lynn Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.

SCHEDULE.

THE north-eastern side of all that portion of street situated in the Otago Land District, City of Dunedin, known as Lynn Street, fronting parts Lots 8 and 8A, D.P. 157, Township of St. Leonard's on the Hill, being parts Section 1, Block III, Upper Kaikorai District. As the same is more particularly delineated on the plan marked P.W.D. 115460, deposited in the office of the Minister of Public Works at Wellington, and thereon edged red.

"That the Christchurch City Council, being the local authority having control of the streets in the City of Christchurch, hereby, by resolution, declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the south-eastern side of the portion of Andover Street, adjoining the land comprised in Certificate of Title, Volume 118, folio 168, being Lot 23, D.P. 362, and part R.S. 6";

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the portion of street (described in the Schedule hereto) within a distance of forty-eight feet from the centre-line of the said portion of street.

SCHEDULE.

THE south-eastern side of all that portion of street in the Canterbury Land District, City of Christchurch, known as Andover Street, fronting Lot 23, D.P. 362, part Rural Section 6, City of Christchurch. As the said portion of street is more particularly delineated on the plan marked P.W.D. 115626, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the south-eastern side of the portion of Dorset Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.

SCHEDULE.

THE south-eastern side of all that portion of street situated in the Canterbury Land District, City of Christchurch, known as Dorset Street, fronting part Town Reserve 25, City of Christchurch. As the same is more particularly delineated on the plan marked P.W.D. 115914, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.
