The Shipping Safety (Whangaroa Harbour) Order 1942.

Pursuant to Regulation 4A of the Shipping Safety Emergency Regulations 1940,* the Minister of Defence doth hereby make the following Order:

  1. This Order may be cited as the Shipping Safety (Whangaroa Harbour) Order 1942.

  2. This Order shall take effect on the day following the date of publication thereof in the Gazette.

  3. This Order shall apply with respect to all small craft, as defined in the Shipping Safety Emergency Regulations 1940†, to which the Shipping Control Emergency Regulations 1939‡ do not apply.

  4. No master or person in charge of any small craft to which this Order applies shall cause or permit the craft to be anchored in any part of the waters described in the Schedule hereto.

  5. No master or person in charge of any small craft engaged in fishing, being a craft to which this Order applies, shall cause or permit the craft while so engaged to be in any part of the waters described in the Schedule hereto.

  6. Except in accordance with the terms and conditions of a written permit granted by an officer at Whangaroa, authorized in that behalf by the Naval Officer in Charge, Auckland, or his representative at Whangaroa, or the Army Board, no master or person in charge of any small craft to which this Order applies shall cause or permit the craft to enter, leave, or move in any part of the waters described in the Schedule hereto.

SCHEDULE.

PROHIBITED AREA.

THE waters in Whangaroa Harbour within the following limits: From North Head 004° 1'38 miles from Jones Point (lat. 35° 02' 15" S., long. 173° 46' 00" E.), in a 111° 30' direction for 7·3 cables to the shore; thence along the shore to the northern entrance point of Owanga Bay; thence in a 222° direction to the northern extremity of Peach Island; thence along the shore to the western extremity of Peach Island; thence in a 274° direction to the northern entrance point of Tararuni Cove; thence along the shore to North Head.

The Shipping Control (Whangaroa Harbour) Notice 1942.

Pursuant to the Shipping Control Emergency Regulations 1939,* the Naval Board hereby gives notification as follows:

  1. This notification may be cited as the Shipping Control (Whangaroa Harbour) Notice 1942.

  2. This notification shall take effect on the day following the date of publication thereof in the Gazette.

  3. In this notice, unless the context otherwise requires,

“Local small craft” means any small craft for the time being kept in Whangaroa Harbour;

“Small craft” has the same meaning as in the Shipping Safety Emergency Regulations 1940†.

  1. No master or person in charge of any ship to which the Shipping Control Emergency Regulations 1939 for the time being apply shall cause or permit the ship to be anchored in any part of the waters described in the Schedule hereto.

  2. No master or person in charge of any ship engaged in fishing, being a ship to which the Shipping Control Emergency Regulations 1939 for the time being apply, shall cause or permit the ship while so engaged to be in any part of the waters described in the Schedule hereto.

  3. Except in accordance with the terms and conditions of a written permit granted by an officer at Auckland, authorized in that behalf by the Naval Officer in Charge, Auckland, or his representative at Whangaroa, no master or person in charge of any ship to which the Shipping Control Emergency Regulations 1939 for the time being apply, other than a local small craft, shall cause or permit the ship to enter, leave, or move in any part of the waters described in the Schedule hereto.

  4. Except in accordance with the terms and conditions of a written permit granted by an officer at Whangaroa, authorized in that behalf by the Naval Officer in Charge, Auckland, or his representative at Whangaroa, or the Army Board, no master or person in charge of any local small
    craft to which the Shipping Control Emergency Regulations 1939 for the time being apply shall cause or permit the craft to enter, leave, or move in any part of the waters described in the Schedule hereto.

Notice to Persons affected by Applications for Licenses under Part III of the Industrial Efficiency Act, 1936.

Taking of Fish for Sale.

Applications have been received from F. G. Cookson and F. Richards for licenses to take fish for sale by means of the fishing-vessel “Kukupa” (to be registered), using set-nets, drag- nets, catches to be landed at Kaituna or Birdlings Flat.

An application has been received from J. E. Baker, Ross Point, Broad Bay, Dunedin, for a license to take fish for sale by means of the 40 ft. 20 h.p. fishing-vessel “Marion,” using long lines, hand- lines, set-nets, and drag-nets, catches to be landed at Port Chalmers.

An application has been received from T. C. McDowell, Tauranga, for a license to take fish for sale by means of a 33 ft. 28 h.p. fishing- vessel “Eros” (to be registered), using set-nets, drag-nets, long lines, hand-lines, and crayfish-pots, catches to be landed at Tauranga.

Any persons who consider they will be materially affected by the decision of the Bureau of Industry on the above applications, and who wish to make representations accordingly, must furnish them in writing not later than the 26th November, 1942.

Including Additional Land in the Uawa Development Scheme.

Pursuant to section 4 of the Native Land Amendment Act, 1936, the Board of Native Affairs hereby declares the land described in the Schedule hereto to be subject to Part I of the said Act and to be included in the Uawa Development Scheme.

Appointment of Deputy District Public Trustee.

Notice is hereby given that, in pursuance of the power and authority vested in me by section 3 of the Public Trust Office Amendment Act, 1921-22, I, the Public Trustee of the Dominion of New Zealand, have appointed Charles Earnshaw White, of the Public Trust Office, Wellington, to be deputy of the District Public Trustee Hawera, during the absence of such District Public Trustee from his headquarters from any cause, and all previous Warrants appointing any deputy of the said District Public Trustee have been revoked.
