Exempting Crown Land from the Provisions of the Mining Act, 1926.

WHEREAS by section twenty of the Mining Act, 1926, it is, inter alia, enacted that the Governor-General may from time to time, by notice in the Gazette, exempt any Crown lands from mining, or from any specified mining purpose, or from that Act, or any specified provisions of that Act, and that the lands to which any such notice relates shall be specified therein by words or particular description:

And whereas it is desirable that the Crown land specified in the Schedule hereto should be exempted from the provisions of the Mining Act, 1926, and its amendments, subject to existing registered mining privileges.

Now, therefore, I, Cyril Louis Norton Newall, the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred on me by section twenty of the Mining Act, 1926, and of all other powers and authorities in anywise enabling me in that behalf, do hereby exempt the land particularly described in the Schedule hereto from the provisions of the Mining Act, 1926, subject to existing registered mining privileges; and do also hereby declare that such exemption shall take effect from the date of the publication of this notice in the Gazette.

SCHEDULE.

ALL that area in the Nelson Land District, Inangahua County, containing 44 acres, more or less, being part of Provisional State Forest No. 132, situated in Block XIV, Waitahu Survey District, and bounded generally as follows: Commencing at a point 806 links distant on a bearing of 197° 00′ from the south-eastern corner of Sawmill Area No. 7/132/29; thence toward the south-west, south, and east by the following right lines: 135° 15′ 320 links, 131° 15′ 1547 links, 127° 45′ 270 links, 154° 15′ 525 links, 166° 15′ 549 links, 195° 15′ 309 links, 176° 45′ 450 links, 141° 15′ 604 links, 145° 15′ 274 links, 164° 00′ 538 links, 200° 30′ 1041 links, 111° 00′ 537 links to the left-hand branch of Staircase Creek, 111° 00′ 86 links, 17° 00′ 352 links, 3° 30′ 945 links, 360° 00′ 559 links, 356° 00′ 316 links, 335° 00′ 683 links, 339° 30′ 695 links, 358° 30′ 1455 links, and 7° 30′ 670 links to a water-race (License No. 5399); towards the north by the said water-race, 302° 00′ 80 links, to its intersection with the left-hand branch of Staircase Creek, and by an area exempted from the provisions of the Mining Act, 1926 (Gazette, 1939, page 320) to the point of commencement: be all the aforesaid measurements more or less. As the same is more particularly delineated on plan No. N. 6/8, deposited in the Head Office of the Mines Department at Wellington, and thereon bordered red.

Vesting the Control of Scenic Reserves in the Hundalee Scenic Reserves Board.

IN pursuance and exercise of the powers and authorities conferred upon him by section thirteen of the Scenery Preservation Act, 1908, His Excellency the Governor-General of the Dominion of New Zealand doth hereby vest the control of the reserves described in the Schedule hereto (being land reserved under the said Act), in trust for the purposes of scenery preservation, as from the date of this notice until the twenty-eighth day of March, one thousand nine hundred and forty-three (unless previously altered or revoked under the said Act) in the Hundalee Scenic Reserves Board, as constituted by notification dated the twenty-ninth day of March, one thousand nine hundred and thirty-eight, and published in Gazette of the thirty-first day of that month.

SCHEDULE.

MARLBOROUGH LAND DISTRICT.

ALL that area containing by admeasurement 2 acres 1 rood 10 perches, being portion of 3B of 2, Mangamaunu Native Block, situated in Block XV, Puhipuhi Survey District, and being the land shown as Lot C on plan 1546/76, deposited in the office of the Chief Surveyor at Blenheim.

Also all that area containing by admeasurement 2 acres 3 roods 8·2 perches, being portion of 3A of 2 of the said Native block and being the land shown as Lot D on the said plan 1546/76.

Also all that area containing by admeasurement 2·4 perches, being portion of 3C of 2 of the said Native block, and being the land shown as Lot E on plan 1546/76.

Also all that area containing by admeasurement 14·9 perches, being portion of 3C of 2 of the said Native block, and being the land shown as Lot F on plan 1546/76.

As witness the hand of His Excellency the Governor-General, this 22nd day of November, 1941.

Vesting the Control of a Scenic Reserve in the Waitemata County Council.

IN pursuance and exercise of the powers and authorities conferred upon him by section thirteen of the Scenery Preservation Act, 1908 (hereinafter referred to as “the said Act”), His Excellency the Governor-General of the Dominion of New Zealand doth hereby vest the control of the scenic reserve described in the Schedule hereto (being land reserved under the said Act) in the Waitemata County Council, subject to the conditions hereinafter contained, that is to say,—

  1. The period for which the control of the reserve is hereby vested shall be ten years from the date hereof, unless the reservation is previously altered or revoked under the said Act.

  2. The said Council shall prepare a report each year ending on the thirty-first day of March, together with a statement of receipts and expenditure in connection with the said reserve. Such report and statement shall be sent to the Minister charged with the administration of the said Act as soon as possible after the close of the year.

  3. The said Council shall control the said reserve in accordance with the provisions of the said Act and of the regulations made thereunder.

SCHEDULE.

NORTH AUCKLAND LAND DISTRICT.

ALL that area in the Waitemata County, and situated in Blocks III and IV, Waiwera Survey District, containing by admeasurement 13 acres 1 rood 21 perches, more or less, being part Allotment 110A, Parish of Waiwera, and being the residue of the land comprised and described in Certificate of Title, Volume 393, folio 267, Auckland Registry. As the same is more particularly delineated on the plan marked L. and S. 6/9/27c, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon edged red. (North Auckland plan S.O. 29295L and D.P. 7552.)
