And whereas the district known as the New River Hundred Rabbit District has been constituted under and for the purposes of the said Act:
And whereas the Board of the said district has, pursuant to the said section thirty-one of the said Act, requested that the boundaries of its district be altered and redefined by including an additional area therein:
And whereas the consent of a majority of the persons in such additional area qualified to be enrolled on the ratepayers' list for the said district has been given to the inclusion of such additional area in the said district:
And whereas it is deemed expedient to alter and redefine the boundaries of the said district accordingly:
Now, therefore, in pursuance and exercise of the powers and authorities conferred upon him by the said Act, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby—
(1) Alter and redefine the boundaries of the said district so constituted as aforesaid:
(2) Declare that the boundaries of the said district shall be those set forth in the Schedule hereto; and, further,
(3) Declare that this Order in Council shall come into force on the day following publication hereof in the Gazette.
SCHEDULE.
BOUNDARIES OF THE NEW RIVER HUNDRED RABBIT DISTRICT.
ALL that area in the Counties of Wallace and Southland, Southland Land District, containing by estimation 53,420 acres, more or less, and bounded as follows: Commencing at the mouth of the Waimatuku Stream, Block XIX, New River Hundred; thence in a northerly direction generally along the left bank of the said Waimatuku Stream to the southernmost corner of Section 67, Block IV, Oreti Hundred; thence in a north-easterly direction generally along the south-eastern boundary of the said Section 67 to a public road; thence in an easterly direction along the said public road to and across another public road forming the western boundary of Sections 43 and 80, Block V, Oreti Hundred; thence in a northerly direction along the last-mentioned public road to Drummond-Winton Road; thence in an easterly direction along the said Drummond-Winton Road to Woods Road; thence in a south-easterly direction along the said Woods Road to Spar Bush-Winton Road; thence in a south-easterly direction across the said Spar Bush-Winton Road, to and along the south-western boundary of Lot 9, D.P. 2162, Block VI, Oreti Hundred, and that line produced to the Oreti or New River; thence in a southerly direction generally along the right bank of the said Oreti or New River to a point in line with the north-western boundary of Sections 18 and 75, Block VI, New River Hundred; thence in a south-westerly direction to and along the north-western boundaries of the said Sections 18 and 75 to the northern boundary of Block XVII, New River Hundred; thence in a westerly, southerly, and westerly direction along the northern, western, and northern boundaries of the said Block XVII to the coast; thence in a north-westerly direction along the coast to the point of commencement.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
IN pursuance and exercise of the powers and authorities conferred by the Public Works Act, 1938, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby consent to the land described in the Schedule hereto being taken for protective works (the widening and the improvement of the bed of the stream called “Water of Leith”).

Consenting to the Raising of a Rural Housing Loan of £40,000 by the Franklin County Council and prescribing the Conditions thereof.

ORDER IN COUNCIL.
At the Government House at Wellington, this 20th day of August, 1941.
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
WHEREAS the Franklin County Council is desirous of raising from the State Advances Corporation of New Zealand (hereinafter referred to as “the Corporation”) a loan of forty thousand pounds (£40,000) (hereinafter called “Rural Housing Loan, 1941” (hereinafter called “the said loan”)) for the purpose of enabling the said Council out of the loan so raised to make advances to farmers under the Rural Housing Act, 1939:
And whereas the said Council has complied with the provisions of the Local Government Loans Board Act, 1926 (hereinafter called “the said Act”), and it is expedient that the precedent consent of the Governor-General in Council, as required by the said Act, should be given to the raising of the said loan:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section eleven of the said Act, as set out in section twenty-nine of the Finance Act, 1932 (No. 2), and of all other powers and authorities enabling him in this behalf, doth hereby consent to the raising by the said Council from the Corporation for the aforesaid purpose of a loan up to the amount of forty thousand pounds (£40,000), and in giving such consent doth hereby determine as follows:—
(1) The Council shall pay to the Corporation each half-year in reduction of the principal moneys advanced by the Corporation to the Council an amount equal to the sum of all the amounts which are expressed to be payable to the Council during such half-year by the agreements entered into with the said Council by the various farmers to whom the said Council has advanced any of the loan-moneys.
(2) The rate of interest that may be paid in respect of the said loan or so much thereof as is for the time being raised and not repaid shall be three pounds (£3) per centum per annum payable half-yearly, the first such payment to be made not later than six months after the date of the payment of the first instalment of the loan by the Corporation to the said Council, such interest to be computed on the daily-debtor balances in the accounts of the Corporation.
(3) No amount payable as either interest or principal in respect of the said loan shall be paid out of loan-moneys.
(4) No amount shall be payable for brokerage, underwriting, or procuration fees in respect of the raising of the said loan or any part thereof.
