The Western Side of Portion of Prosser Street, in the Borough of Green Island, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.
At the Government House at Wellington, this 18th day of June, 1941.
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of every other power in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Green Island Borough Council on the twenty-ninth day of April, one thousand nine hundred and forty-one, in so far as it affects the side and portion of street described in the Schedule hereto, viz. :—
“ That the Green Island Borough Council, being the local authority having control of the streets in the Borough of Green Island, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that portion of Prosser Street, adjoining Allotments 2–7, Block IV, Township of Burnside East ” ;
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the western side of the portion of Prosser Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.
SCHEDULE.
THE western side of all that portion of street, situated in the Otago Land District, Borough of Green Island, known as Prosser Street, fronting Lots 2, 3, 4, 5, 6, and 7, Block IV, D.P. 168, Township of Burnside East.
As the same is more particularly delineated on the plan marked P.W.D. 111234, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

The South-eastern Side of Portion of Lee Street and the South-western Side of Portion of Freemont Street, in the City of Auckland, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

“ The Auckland City Council, being the local authority having control of the streets in the City of Auckland, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the south-eastern side of portion of Lee Street and the south-western side of portion of Freemont Street, fronting subdivision of Lots 8, 9, and 10 of Section 3, Allotment 6, Section 4, Suburbs of Auckland ” ;
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the south-eastern side of the portion of Lee Street or the south-western side of portion of Freemont Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-lines of the said portions of streets.
SCHEDULE.
THE south-eastern side of all that portion of street, situated in the North Auckland Land District, City of Auckland, known as Lee Street, fronting Lot 8 of Section 3 of a subdivision of Allotment 6, Section 4, Suburbs of Auckland.
Also the south-western side of all that portion of street, situated in the said land district and city, known as Freemont Street, fronting Lots 8, 9, and 10 of Section 3 of a subdivision of Allotment 6, Section 4, Suburbs of Auckland.
As the same are more particularly delineated on the plan marked P.W.D. 111237, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

Certain Land in respect of which there are no Electors included in the Borough of Gisborne.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
IN pursuance and exercise of the powers and authorities vested in him by section one hundred and thirty-nine of the Municipal Corporations Act, 1933, and of all other powers and authorities in anywise enabling him in this behalf, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby declare that the boundaries of the Borough of Gisborne are hereby altered so as to include therein and exclude from the County of Cook the land described in the Schedule hereto, being land in the said county in respect of which there are no electors.
SCHEDULE.
AREA INCLUDED IN THE BOROUGH OF GISBORNE AND EXCLUDED FROM THE COUNTY OF COOK.
ALL that area in the Gisborne Land District, being part of Section 9, Block II, Turanganui Survey District, and containing by admeasurement 18·5 perches, more or less, bounded on the east by the abutment of Cochrane Street, on the north and west by other part of Section 9 aforesaid, and on the south by the Gisborne–Motu Railway.

Closing Old Cemetery, Cromwell.

ORDER IN COUNCIL.
At the Government Buildings at Wellington, this 10th day of June, 1941.
Present:
THE HON. W. NASH PRESIDING IN COUNCIL.
WHEREAS it appears to the Governor-General that burials in the Old Cemetery, Cromwell, which said cemetery is described in the Schedule hereto, should be wholly discontinued :
And whereas a sufficient cemetery not within the limits of any borough or town district has been provided and prepared for the interment of the dead by the local authority of the district as required by the Cemeteries Act, 1908 :
Now, therefore, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council of the Dominion of New Zealand, and in pursuance of the powers and authorities vested in him by the said Cemeteries Act, 1908, doth hereby order and direct that from and after the first day of December, one thousand nine hundred and forty-one, the Old Cemetery, Cromwell, described in the Schedule hereto, shall be closed and burials therein discontinued, and, further, that the said cemetery shall, from and after the said first day of December, one thousand nine hundred and forty-one, be vested in the Cromwell Borough Council under the provisions and for the purpose of section seventy-eight of the said Cemeteries Act, 1908.
